The current rules focus on whether you were an ESI insured person and meet the employment and contribution conditions. ESIC has extended the Atal Beemit Vyakti Kalyan Yojana (ABVKY) through 30 June 2027, but current official guidance does not say whether someone living abroad can complete every claim, identity-verification and banking step remotely.
What ABVKY’s current rules say
On 27 July 2026, the Ministry of Labour and Employment announced that ESIC had approved ABVKY’s continuation from 1 July 2026 to 30 June 2027. The same release sets out the current eligibility conditions for an insured person:
- At least 12 months of insurable employment immediately before becoming unemployed.
- At least 78 days of contributions in one completed contribution period during the 12 months before unemployment.
The release says unemployment must not result from misconduct, occur during a lockout, or be due to superannuation. It also lists conviction for making a false statement under the ESI Act as an exclusion. These are the conditions stated in the 2026 release; earlier scheme documents may describe rules from previous periods. Ministry of Labour and Employment, 27 July 2026.
Does being an NRI prevent you from claiming?
The current government release describes eligibility in terms of an “insured person,” employment and contributions. It does not identify NRI status, citizenship or residence abroad as a separate eligibility test, and it does not expressly bar overseas residents. That silence does not confirm that an NRI can claim: the published material does not settle how overseas residence affects verification, required bank arrangements or any in-person steps.

Start by checking whether your employment was covered by ESI and whether your employment and contribution record meets the current conditions. Then ask ESIC whether your particular overseas residence affects the claim process or payment. Do not assume that NRI status automatically qualifies or disqualifies you.
How much relief does the scheme provide?
ESIC’s standard note, marked as of 1 January 2025, describes relief at 50% of average daily earnings for a maximum of 90 days. This is the stated rate and ceiling, not a promise that every eligible applicant will receive a particular amount or the full period. ESIC standard note, as of 1 January 2025.

Can you submit a claim while living abroad?
The 2026 government release says that online submission and processing of claims, with payment by direct benefit transfer (DBT) to beneficiaries’ bank accounts, are among the steps taken to expedite settlement. It does not describe an overseas-specific process or confirm that every verification and banking requirement can be completed remotely. Online processing, by itself, is not proof that an entire claim can be made from abroad. The 2026 release.
Before relying on a claim, confirm these case-specific details with ESIC:

- Your last insurable employment date and whether the timing meets the current rules.
- Whether the circumstances of your unemployment fall within the exclusions stated in the 2026 release.
- Which bank-account details ESIC can use for DBT in your case and whether any account or verification requirement must be completed in India.
- The current online claim steps and whether your overseas location requires additional verification or an in-person visit.
