What did Alex Mashinsky plead guilty to?
On December 3, 2024, Mashinsky pleaded guilty before U.S. District Judge John G. Koeltl to one count of commodities fraud and one count of securities fraud, according to the U.S. Attorney’s Office for the Southern District of New York. The two counts carried a combined statutory maximum of 30 years in prison. That was the maximum available by statute, not the sentence the judge ultimately imposed.
At the plea, Mashinsky said, “I accept full responsibility for my actions,” the Associated Press reported. The guilty plea is the basis for describing his responsibility for the two fraud counts; other details about the alleged schemes below are attributed to prosecutors.
How did Celsius work, and what did “Unbank Yourself” mean?
Celsius marketed itself as a crypto platform where customers could earn weekly rewards through its Earn program, borrow against crypto collateral, or keep crypto in custody. Earn deployed customer assets to generate returns. “Unbank Yourself” was a marketing slogan, not a criminal charge; prosecutors said Celsius used the slogan alongside claims about safety and returns.

The DOJ said Mashinsky made public statements that misrepresented Celsius’s profitability, investment activity, liquidity, and the risks and rewards customers faced. Celsius paused customer withdrawals on June 12, 2022, according to the government’s plea announcement.
What did prosecutors say about the CEL token?
Prosecutors described a separate scheme involving CEL, Celsius’s proprietary token. They said Mashinsky and others misled customers and market participants about CEL trading activity and Celsius’s support for the token’s price, while Mashinsky sold his own CEL holdings. The U.S. Attorney’s Office put the proceeds from his CEL sales at approximately $48 million.
That figure is Mashinsky’s reported proceeds from token sales, not an estimate of customer losses, a forfeiture amount, or money recovered for Celsius customers. The same DOJ announcement described U.S. Attorney Damian Williams calling the case “one of the biggest frauds in the crypto industry.”

The judge imposed the 12-year sentence on May 8, 2025, as reported by Ars Technica. The report said prosecutors and victims sought a substantially longer term, while Mashinsky’s defense sought a shorter sentence. Those positions were requests, not the ruling; the sentence imposed was 12 years.
The cited reports do not establish Mashinsky’s current custody status, whether he has appealed, or the present status of creditor distributions.
