New Hampshire is the only state identified by the National Association of Insurance Commissioners (NAIC) as lacking a compulsory auto liability insurance law. That does not give drivers a free pass: New Hampshire still requires compliance with alternative financial responsibility requirements. Virginia is no longer an exception; its option to pay a fee instead of maintaining insurance ended July 1, 2024.
Which states do not require car insurance?
As of October 4, 2026, NAIC identifies New Hampshire as the only state without a compulsory auto liability insurance law. NAIC’s summary says auto insurance is not required there if the driver complies with alternative financial responsibility requirements. This is a consumer-level summary, not a substitute for checking current New Hampshire statutes and DMV instructions.
The word “require” needs care: a state may require financial responsibility without requiring every driver to prove it through an insurance policy. Other states may allow specific alternatives to a policy while still requiring financial responsibility. Check the rules for the state where the vehicle is registered and operated.
Can you drive without car insurance in New Hampshire?
Not necessarily without obligations. The absence of a compulsory insurance law does not erase a driver’s potential liability for injuries or property damage, or the state’s alternative financial responsibility requirements. NAIC does not specify the full current thresholds, accident triggers, or procedures in its consumer summary. New Hampshire RSA 264:15 concerns uninsured or hit-and-run motor vehicle coverage in policies; that statute alone does not establish all requirements for an uninsured driver. Review current state law and DMV guidance before driving without a policy.

Is Virginia still a no-insurance state?
No. Virginia eliminated its former option to pay an uninsured motor vehicle (UMV) fee instead of maintaining coverage effective July 1, 2024. Virginia DMV says registered vehicles must obtain a policy meeting the state’s liability limits, and vehicles must remain covered while registered.
Virginia DMV also lists other ways to meet financial responsibility: an insurance policy, a surety bond, a deposit of money or securities, or a self-insurance certificate. These are not the same thing as permission to disregard financial responsibility. Older articles that list Virginia as a state where drivers can simply pay a fee instead of maintaining coverage are outdated.

What to compare when checking your state’s rules
Do not stop at the question of whether a policy is mandatory. Confirm what the law requires for your vehicle and situation:
- Required proof: Is an insurance policy mandatory, or may you use another approved form of financial responsibility?
- Timing: When must you provide proof—for registration, operation, or after a crash?
- Crash responsibility: What financial obligations can follow if you cause injury or property damage?
- Consequences: What can happen if you fail to meet insurance or financial responsibility rules?
- Other contracts: Does a lender require coverage beyond what state law requires?
These distinctions are state-specific. For example, California’s consumer guidance says vehicle owners and drivers must establish financial responsibility, most commonly through liability insurance. Its separate guidance explains that a lender may require coverage that is not itself a state legal requirement for driving on public streets. That California example should not be applied as a rule in other states.

Check official rules before driving or registering a vehicle
State laws and DMV procedures can change. Verify current requirements with the relevant state DMV and statutes, especially if you plan to rely on an alternative to an insurance policy, have recently moved, or are deciding whether to keep a vehicle registered. A legal minimum also may not cover every loss you could face, so distinguish the state’s requirement from your own risk tolerance and any lender contract.
