The memo described the firm spending “a lot of time with active-duty military, veterans, chiefs of police, sheriffs,” and said those relationships were “critical to the success of our companies.” It added: “We believe there is long-term value in expanding our network in collaboration with Daniel and are excited to have him as part of our team.” These are the firm’s stated business rationale, as relayed by TechCrunch; they are not independent evidence of the hire’s impact. What was the outcome of Daniel Penny’s criminal case?

Penny was tried in New York over the 2023 subway encounter that preceded Jordan Neely’s death. The two charges had different outcomes:

  • Second-degree manslaughter: On December 6, 2024, jurors said they could not reach agreement. At prosecutors’ request, the judge dismissed this count.
  • Criminally negligent homicide: On December 9, 2024, the jury found Penny not guilty. It is accurate to say he was acquitted of this charge.

The Manhattan District Attorney’s Office published a statement on the verdict, while contemporary CBS New York coverage describes the separate sequence for the manslaughter count. The verdict should not be described as an acquittal of manslaughter: that count ended with a deadlock and dismissal, not a jury finding of not guilty. Why did the hire draw attention?

That supports describing the decision as controversial, but the available reporting does not establish a representative measure of public opinion.
