In July 2025, Senators Elizabeth Warren and Richard Blumenthal and Representative Maxine Waters called Zelle “a P2P payment platform associated with significant scams and fraud” and asked the banks that own it for information about scams, reimbursement and consumer protection. That was a request for information. It was not a court finding, a regulation or an enforcement order.
The phrase rests on three kinds of material: a federal lawsuit the Consumer Financial Protection Bureau (CFPB) filed in December 2024 and later dropped, a 2024 Senate investigation whose staff report examined fraud disputes at three large banks, and a New York state lawsuit filed in 2025 that survived a motion to dismiss in July 2026. Each is either an allegation or an investigator’s finding. None is a final judgment of liability, and Zelle’s operator disputes the claims.
What lawmakers asked the banks to do
Zelle is run by Early Warning Services (EWS), a company owned by banks. The July 2025 request went to those bank owners and asked for three things: statistics on scams that start on social media, their reimbursement policies, and the steps they are taking to protect consumers.
The request did not ask for a specific outcome, and the sources cited here do not establish whether or how the banks responded. Two points of wording matter. “Significant” is the lawmakers’ characterization, and it is built on allegations that the agency making them never tested in court. The request also concerns scams that begin on social media and end in a Zelle payment, which is narrower than fraud across the whole network.

How the claims developed
- February 15, 2024: Senators Sherrod Brown, Jack Reed and Elizabeth Warren pressed Zelle CEO Cameron Fowler to clarify whether banks and credit unions were required to reimburse qualifying imposter scams, to widen reimbursement categories and to simplify reporting.
- July 23, 2024: The Senate Permanent Subcommittee on Investigations held a hearing with Fowler and payment executives from JPMorgan Chase, Bank of America and Wells Fargo. The subcommittee’s majority staff released a 62-page report alongside the inquiry.
- December 20, 2024: CFPB Director Rohit Chopra announced a lawsuit against EWS, JPMorgan Chase, Bank of America and Wells Fargo. The CFPB alleged inadequate protections and described account-takeover cases involving one-time passcodes and stolen devices.
- March 2025: The CFPB dropped the lawsuit, according to the lawmakers’ July 2025 announcement.
- July 3, 2025: The lawmakers’ information request described above.
- August 13, 2025: New York Attorney General Letitia James sued EWS, alleging more than $1 billion in losses during 2017–2023 and seeking damages, restitution and anti-fraud safeguards.
Comparing the sources
The claims differ in who is speaking, what they measure and what they ask for. Mixing them up is the most common way the numbers get misread, so the table keeps them apart.

How to read the four figures
These figures cannot be added together or compared directly. They cover different groups, periods and measurements.
More than $870 million: the CFPB allegation
Lawmakers attributed this amount to the CFPB lawsuit, which they said alleged losses for “hundreds of thousands of consumers.” Treat it as the amount the agency alleged, not an adjudicated loss total. The lawmakers’ summary does not say what period it covers.

More than $1 billion: the New York allegation
The Attorney General’s office alleges more than $1 billion in Zelle-related losses from 2017 through 2023. That is a state allegation covering a different period from the CFPB figure. Zelle disputes the state’s case, including the methodology its claims imply, so the number is not an agreed or verified total.
$64 million of $166 million: the Senate staff count for 2023
The subcommittee’s majority staff reported that the three banks it examined reimbursed about 38% of $166 million in fraud disputes filed in 2023, or $64 million, and left more than $100 million unreimbursed. The population is disputes at those three banks in that year. It does not describe the whole network or all Zelle transactions.
0.02%: Zelle’s transaction share
Zelle states on its informational page that 0.02% of transactions involve a report of scam or fraud. This is the operator’s own metric. It measures the share of transactions that trigger a report, not the share that are fraudulent and not the share of money lost or left unreimbursed. It has not been independently validated.

Four threads are in play, and only one is a live court case.
The CFPB suit: nothing was tested in court
Because the agency dropped the case, its allegations were never adjudicated. Chopra’s statement at the filing, that “these banks broke the law by running a payment system that made fraud easy and then refusing to help the victims,” was the agency’s characterization, not a court ruling.

The New York suit: proceeding to discovery
This is a separate action from the CFPB case. On July 22, 2026, Bloomberg Law reported that a New York judge denied EWS’s motion to dismiss at the pleading stage, so the case continues into discovery. That ruling means the complaint may proceed. It does not decide whether the allegations are true or whether EWS is liable. Because that report is the most recent development available here, later filings may have changed the posture, so check the court record before relying on the current status.

The Senate inquiry and the lawmakers’ request: no public outcome
The sources cited here do not establish what the banks provided in response to the 2024 hearing or the 2025 request, or whether either changed a reimbursement policy.

Zelle disputes the allegations. In August 2025, responding to the New York suit, a spokesperson said: “Zelle® leads the fight to stop fraud and scams in America. This lawsuit is a political stunt to generate press, not progress.” That is the operator’s position, not an independent assessment. Its informational page also carries the 0.02% figure discussed above.

The 2024 Senate staff report recommended:
- Improved real-time information sharing among EWS, banks, law enforcement and other financial institutions.
- Limits on how financial data is used, with clearer disclosure of that use.
- Options for parents to disable Zelle for their children and to receive notifications about large transactions by children.
- An amendment to the Electronic Fund Transfer Act that clarifies the status of EWS and similar payment facilitators.
The February 2024 letter asked the operator to clarify which imposter scams qualify for reimbursement and make that policy public, to cover more scam types, and to simplify how customers report unauthorized transfers and scams.
If a Zelle payment goes wrong
Zelle payments run through participating financial institutions, so the bank or credit union that holds your account is your first point of contact.
