In Western Australia, rights depend on whether a person has a long-stay agreement, the agreement’s terms and the notice or other action taken by the operator. State law provides a dispute pathway, but the government’s current review is still examining whether tenants get enough warning and information about their options.
Who is covered by WA’s residential parks law?
The Residential Parks (Long-stay Tenants) Act applies to specified long-stay arrangements. These include renting a relocatable home and its site, or renting a site for three months or more. Holiday stays are excluded. Living in a caravan park does not by itself establish that someone is a long-stay tenant under the Act.
That distinction matters when a park is closing: a resident’s legal position depends on the arrangement and its documents, not just on the fact that they live at the park.
What protections apply if a resident is told to leave?
Reforms that took effect in January 2022 changed disclosure requirements and some termination and rent-review rules. Among those changes, operators can no longer terminate site-only agreements without grounds, and cannot terminate fixed-term agreements because a park is sold. These protections do not resolve every possible closure scenario, so a particular resident’s agreement, notice and circumstances need to be considered.

The State Administrative Tribunal (SAT) can make orders in disputes under the Act, including orders about compensation, vacant possession and termination of long-stay agreements. The tribunal’s powers do not mean that every resident will qualify for a particular order; the specific dispute and evidence matter. What is WA’s current review examining?
The 2026 statutory review is looking at the law across three stages: entering a park, living there and leaving. It specifically asks whether tenants are adequately told about the risk of being required to leave and given enough information about their options. Those are questions for the review, not findings that the current rules are inadequate or that a particular closure has caused homelessness.

Public consultation closed on 20 March 2026. Consumer Protection says it will prepare a report and recommendations after submissions and surveys have been reviewed. The review page and its discussion-paper information describe the process.
What should a resident do after receiving a closure or move-out notice?
- Keep the paperwork. Save the agreement, any disclosure documents, notices, emails, letters and records of conversations. Note when each notice was received.
- Clarify the arrangement. Check whether the agreement is for a site, a relocatable home and site, or another kind of stay, and whether it is fixed-term. Those details can affect which statutory protections apply.
- Get advice before acting on a deadline. A notice should not be assumed to settle a resident’s rights. Contact a tenancy or legal service with the agreement and notice available. SAT is the forum that can make orders in disputes under the Act.
- Plan for housing in parallel. If there is a risk of losing accommodation, contact a homelessness referral service promptly rather than waiting for a dispute to conclude.
Where can someone at risk of homelessness get help?
Legal Aid WA lists Entrypoint Perth as a free assessment and referral service for people who are homeless or at risk of homelessness in Western Australia. Its listed numbers are 1800 124 684 and 6496 0001. Legal Aid WA also lists Crisis Care at 1800 199 008 after hours. Check the current Legal Aid WA residential tenants information for service details.

Housing options are case-specific. Availability, location, transport, accessibility, household suitability, cost and stability beyond an emergency stay can all affect whether an option is workable; the government and service sources cited here do not provide comparative costs or real-time availability.
Is moving a caravan onto other land a fallback?
Not automatically. WA guidance generally restricts caravan use to licensed parks unless an approval or exemption applies. A temporary stay on private land can require local-government approval, and unapproved use can carry offence risks. Check the state’s current temporary accommodation and camping outside of caravan parks fact sheet before relying on this option.

The cited government and tribunal material explains the tenancy framework, review and dispute pathway, and Legal Aid WA lists a referral service for people without housing or at risk. It does not identify a particular WA park closure that resulted in residents becoming homeless, or quantify how many people have been affected. That absence from these sources is not proof that no such cases exist.
