USDA’s Poultry Grower Payment Rule: What It Changes and When It Takes Effect

The USDA rule covers broiler tournament payment practices, ranking comparisons and disclosures for certain required farm investments. Its delayed effective date is December 31, 2027.

USDA’s final poultry grower payment rule targets how chicken companies compare broiler growers for tournament-based pay and what they must disclose when they request or require additional farm investment. Its effective date has been delayed from July 1, 2026, to December 31, 2027, according to USDA’s May 2026 announcement. The rule sets general requirements; it does not determine what any particular grower will earn or how a specific contract dispute will be resolved.

What the USDA poultry grower payment rule does

Published on January 16, 2025, the final rule amends regulations under the Packers and Stockyards Act. It addresses three areas of broiler production: payment practices in grower ranking systems, dealer policies for fair comparisons, and information provided when a live poultry dealer requests or requires a grower to make an additional capital investment. USDA describes these as measures intended to address unfairness and deception in payment and investment practices. USDA AMS’s rule overview

Ranking systems, often called tournaments, compare growers’ production results and can affect their payments. USDA’s final-rule FAQ says a dealer may not reduce a grower’s compensation rate because of the grower’s grouping, ranking, or comparison. How the 25% threshold works

The 25% figure is an annual, complex-wide threshold—not a cap on the portion of an individual grower’s pay that can come from rankings. USDA says the Secretary presumes a Packers and Stockyards Act violation when aggregate gross annual payments based on grower grouping, ranking, or comparison exceed 25% of total gross payments to growers in a complex. In practical terms, the FAQ describes a test of ranking-based payments across the complex as a whole. It should not be read as saying that any particular grower is limited to receiving 25% of compensation through ranking or tournament pay.

What the rule addresses in tournament comparisons

USDA’s 2025 factsheet says tournament formulas can be complex, making expected revenues or payment ranges difficult for growers to understand. It also identifies concerns that comparisons may not account for differences in inputs or production practices. The rule’s fair-ranking provisions respond to those concerns; USDA’s description does not establish that every dealer or contract uses an unfair formula. USDA’s 2025 factsheet

What companies must disclose about additional farm investment

The rule covers certain information a live poultry dealer must provide when it requests or requires an additional capital investment from a grower. USDA says the concerns behind this provision include growers being asked to make costly investments without enough information about the investment’s purpose, process, expected outcomes, or reasonable recoupment. What chicken growers should take from the rule

  • It establishes general requirements for covered broiler grower payment systems and certain capital-investment disclosures; it does not calculate an individual grower’s pay.
  • For a contract or dispute, the rule summary alone cannot determine a grower’s rights or likely outcome.
