Spirit Airlines filed for Chapter 11 bankruptcy protection on August 29, 2025. That filing did not lead to a lasting reorganization: Spirit cancelled all flights and began an immediate wind-down on May 2, 2026, and a judge later approved liquidation. The bankruptcy case remained active in October 2026, but that does not mean Spirit is flying or that every customer will receive money back.
When did Spirit file for bankruptcy?
Spirit Aviation Holdings, Inc. and certain affiliates filed voluntary Chapter 11 petitions on August 29, 2025, in the U.S. Bankruptcy Court for the Southern District of New York. The jointly administered case is No. 25-11897 (SHL). The company initially continued operating as a debtor-in-possession under the court’s jurisdiction. Spirit’s SEC filing described debtor-in-possession financing with a maximum aggregate principal amount of $475 million. That was a historical financing authorization; it does not show that funds remained available when the airline later shut down.
What happened after the Chapter 11 filing?
A proposed restructuring did not save the airline
In March 2026, Spirit and certain lenders signed a restructuring support agreement and proposed a plan. The plan still required bankruptcy court approval and satisfaction of other conditions. Spirit’s SEC filing cautioned that there was no assurance the transactions would be completed. The proposal was not a completed reorganization that kept the airline operating. The March 2026 SEC filing sets out those conditions.
Spirit cancelled every flight and began winding down
On May 2, 2026, Spirit announced that its wind-down was effective immediately and cancelled all flights. It attributed the decision to sharply increased fuel prices, other business pressures and a lack of additional funding. That is the company’s explanation, not an independently established finding that one factor alone caused the shutdown. CEO Dave Davis said, “With no additional funding available to the Company, Spirit had no choice but to begin this wind-down.”

A judge approved liquidation
On May 5, 2026, the Associated Press reported that U.S. Bankruptcy Judge Sean Lane approved a rapid wind-down and liquidation process, including sales of assets such as aircraft, engines, spare parts, gates and airport slots. AP reported from court filings and company plans that Spirit had 114 Airbus A320-family aircraft: 66 leased and 28 company-owned, with another 20 owned aircraft already set for sale under a separate court-approved deal. The report also cited 18 spare engines. These are figures reported at the time, not a current fleet available for service.

It described a temporary liquidation crew of 130–150 employees, expected to shrink to around 40. Judge Lane said, “Today is a very challenging day. It’s not a day that anybody hoped would ever come.” AP’s report on the liquidation attributes these details to court materials and company plans.

Where do I file a claim in Spirit’s bankruptcy?
Use the official Epiq case portal to find current claim forms and docket information for case No. 25-11897 (SHL). Follow the portal’s current instructions for your claim category. A filing in the case is not a finding that your claim is allowed, and it does not establish that you will receive a payout.
The case was still active on Epiq’s docket in October 2026, which displayed filings dated October 1. That shows court administration continued after flights stopped; it does not determine any passenger’s claim or recovery.
