You could owe money if you agreed to pay, share a legal obligation under applicable state law, or mishandled your parent’s funds. A nursing-home agreement, a debt left after death, and Medicaid estate recovery each raise different questions.
When can an adult child be responsible for a parent’s medical bills?
Start by asking what legal basis the provider or collector says makes you responsible. A family relationship alone is not a universal basis for personal liability. The answer can depend on your state, the document you signed, and whether you were acting for yourself or as a representative for your parent.
- You signed an agreement to pay. A personal guarantee or co-signature may create an obligation. The wording and circumstances matter.
- You share another legal obligation. Joint-account status or certain state-law rules can affect liability. State law may also recognize filial-support or “necessaries” duties, but their application is not uniform nationwide.
- You acted only as a representative. Handling a parent’s affairs or arranging payment from the parent’s funds is different from promising to pay from your own. Your authority and the agreement’s terms matter.
Ask the creditor to identify the specific contract, account, or statute it relies on, and request a copy of the document. Do not assume that a bill addressed to you, a signature as “responsible party,” or a collection call settles whether you owe the debt.
Can a nursing home make you pay your parent’s bill?
For a nursing facility covered by the federal Nursing Home Reform Act, admission or continued stay cannot be conditioned on a relative or other third party guaranteeing payment. The Consumer Financial Protection Bureau (CFPB) stated in its 2022 Consumer Financial Protection Circular 2022-05: “A nursing facility may not condition a resident’s admission or continued stay on receiving a guarantee of payment from a third party, such as a relative or friend.” The protection applies regardless of whether the resident qualifies for Medicare or Medicaid.

An authorized representative may arrange payment from the resident’s available income or resources without promising to use the representative’s own money. That federal rule is not blanket immunity from every separate contract obligation or state-law claim; what you signed and how you acted still matter.
Read the agreement, not just the signature label
The CFPB warns that nursing-home agreements can contain confusing or conflicting terms. Review any clause labeled “responsible party,” as well as language about “joint and several liability,” personal guarantees, or damages tied to handling a Medicaid application. The label alone does not determine liability: look for what the agreement actually promises you will do and whose funds it allows you to use.

If a facility insists that you accept personal responsibility as a condition of admission, you can refuse that guarantee and seek a lawyer’s review. The federal protection concerns guarantees required as a condition of admission, expedited admission, or continued stay; it does not automatically resolve every dispute about a separate promise or the handling of a resident’s funds. CFPB guidance on nursing-home debt and contract terms provides further consumer information.
Does a parent’s medical debt become yours after they die?
Generally, a deceased person’s debts are handled through their estate under state law. The estate may pay valid claims from estate assets, but it may not have enough to pay every debt. A child is not ordinarily required to use separate personal funds solely because of the family relationship.

Personal exposure may be different if you co-signed, are jointly responsible on an account, or fall within a state-law exception. The CFPB and Federal Trade Commission explain that an executor or administrator may be contacted about a deceased person’s debt, but serving in that role does not by itself make the representative personally responsible for paying it. State probate rules govern claim procedures and priority.
The CFPB’s FAQ, “Can a debt collector contact me about a deceased relative’s debts?” (last reviewed October 19, 2023), addresses who collectors may contact and the distinction between an estate representative and a person who owes the debt. A collector’s contact with you is not, by itself, proof that you must pay.

What is Medicaid estate recovery, and can it make a child pay?
Medicaid estate recovery is a claim against an enrollee’s estate, not an automatic bill to the enrollee’s adult child from the child’s separate assets. Federal rules require states to seek recovery for specified Medicaid benefits—including nursing-facility services, home- and community-based services, and related hospital and prescription-drug services—for qualifying enrollees age 55 or older. The rules include limits and require states to provide hardship-waiver procedures.
States administer recovery under their own procedures, so the estate rules, applicable exceptions, and hardship process depend on the state and circumstances. CMS’s Estate Recovery guidance describes the federal framework; it does not establish that a child automatically owes the amount personally.

What should you check if someone says you owe the bill?
- Identify the kind of claim. Is it a provider bill while your parent is living, a nursing-home admission agreement, a debt asserted after death, or a Medicaid estate-recovery claim?
- Ask for the basis in writing. Request the bill and any contract, guarantee, account record, or statute the creditor says makes you liable.
- Review your role and signature. Determine whether you signed personally, co-signed, held a joint account, or signed only as an agent or representative. Check what the document says about payment and whose funds may be used.
- If a parent has died, separate estate administration from personal payment. Check state probate procedures and deadlines before taking action with estate assets; consult local counsel if the claim or priority is disputed.
- Check state-specific law. Filial-support, spouse-liability, community-property, probate, nursing-home, and Medicaid estate-recovery rules can vary. Current local legal advice is especially important if the amount is substantial, a lawsuit is threatened, or contract language is unclear.
If a collector misstates who is personally liable, or you dispute a nursing-home debt, CFPB materials identify potential consumer-protection concerns and complaint channels. The appropriate response and any deadline depend on the claim and the notice you received; do not assume one deadline applies to every dispute.
