The CBI’s October 16, 2015 lookout circular instructed immigration authorities to prevent Vijay Mallya from leaving India. A replacement circular dated November 24 asked them to inform the agency of his movements instead. The CBI said the original detention selection was an inadvertent error and that detention was not justified at the time. But the available reporting does not identify who authorized the change or establish whether anyone outside the agency directed it.
What changed in the two lookout circulars?
The first circular, dated October 16, 2015, selected the option to stop Mallya from leaving India. The CBI later said its Mumbai branch office had selected detention inadvertently when it intended to obtain information about his movements.
A replacement circular dated November 24, 2015, directed immigration authorities to inform the CBI of Mallya’s arrival or departure rather than detain him. The Indian Express reported that the CBI’s accompanying letter said: “detention of the subject at this stage is not required by us. In case detention is required in future, it will be communicated separately.” That wording is reported from the letter by the newspaper; the original letter is not independently available here.
What explanation did the CBI give?
In a 2016 account reported by The Indian Express, CBI spokesperson Devpreet Singh described the October selection as an “inadvertent error” and said the agency wanted movement information. The CBI said it became aware of the issue after immigration contacted it about Mallya’s imminent arrival, then corrected the circular.

The agency’s reported rationale was that its investigation was at an initial stage, Mallya was cooperating, and there were no grounds to detain him then. Later CBI sources quoted in 2018 reports also said there was no warrant and that the original detention instruction was not sustainable in law. These are explanations attributed to the agency, not a court finding that the decision was legally correct or that the explanation was complete.
How the case and Mallya’s departure unfolded
- July 29, 2015: The CBI registered a case connected to allegations concerning a Rs 900 crore IDBI Bank loan to Kingfisher Airlines. The Indian Express quoted a CBI spokesperson as saying the case began on source information and that no bank had formally complained at registration.
- October 16, 2015: The first lookout circular called for Mallya to be prevented from leaving India.
- November 23–24, 2015: The CBI said immigration contacted it about Mallya’s imminent arrival. The replacement circular was dated November 24; Mallya arrived in Delhi that day.
- December 2015–February 2016: The CBI’s account, reported by The Indian Express, said Mallya was questioned in December and made further trips to and from India.
- March 2, 2016: Mallya left India and did not return, according to contemporaneous reporting. A later written answer in the Rajya Sabha records his departure and subsequent enforcement steps.
The Rajya Sabha answer says the Enforcement Directorate opened its investigation under the Prevention of Money Laundering Act in January 2016. It also records later enforcement and extradition steps. Those procedural details do not, by themselves, explain the CBI’s November 2015 decision. The sources cited here do not establish the current status of extradition or related proceedings.

Why Arun Jaitley became part of the controversy
In September 2018, Mallya said he had spoken to then finance minister Arun Jaitley before leaving for London and told him he was going. Jaitley rejected Mallya’s account as factually false. He said Mallya accosted him in Parliament with an offer to settle with banks, and that he told Mallya to speak to the creditors. Mallya acknowledged meeting Jaitley in Parliament but said he also told him he was leaving for London.
The reviewed reporting does not independently establish exactly what was said. Nor does the exchange prove that Jaitley knew about, influenced, or directed the CBI’s change to the lookout circular. It is context for the political dispute, not evidence of the circular’s authorization.

What the available record does—and does not—establish
The CBI’s account offers a stated reason for the change: an erroneous detention selection was corrected because the agency did not consider detention justified at that point. The reported letter gives that rationale a contemporaneous written form. But the record described in these reports does not identify the individual who approved the replacement circular, show the complete internal decision trail, or establish whether political direction played any part.
That distinction matters. The reported explanation is not proof of improper intervention, but neither does it answer every accountability question. To clarify why the notice was diluted, the CBI would need to explain who authorized the November 24 instruction and how the decision followed from the agency’s stated legal and investigative position.
