The claim was brought by Stichting Massaschade & Consument (SMC); the allegations have not been established by a court. As of 8 October 2026, the case update described a hearing on procedural issues and an upcoming filing deadline—not a ruling that Sony broke the law or owes compensation.
What does the Dutch lawsuit allege?
SMC says Sony’s control of digital game distribution on PlayStation consoles prevents competing storefronts from putting pressure on prices. The foundation alleges that this lets Sony charge excessive prices for digital games and in-game content, a claimed effect it calls the “Sony-tax.” Those are the claimant’s characterizations, not judicial findings. The comparison at the center of the price argument is between digital and physical copies of the same game. SMC’s announcement of 24 June 2025 says economic research it commissioned found that digital versions cost consumers an average 47% more than physical copies of the exact same games. That figure is SMC’s description of its research; it is not an independently verified figure or a result accepted by a court in the sources available. It also does not establish that every digital game costs more than its physical counterpart or that physical copies are always cheaper or available. What is the case asking the court to do?
SMC says it is asking the District Court of the Central Netherlands to order Sony to stop the conduct the foundation alleges is unlawful and to pay compensation to affected PlayStation users. This is the remedy SMC seeks, not an award already made or a prediction that the court will grant it. The action is listed in the Netherlands’ official register for collective claims; SMC describes its requested relief in its case FAQ.

What is the latest procedural status?
SMC’s case-progress page says an oral hearing took place on 29 June 2026 concerning applicable law, the court’s jurisdiction and whether SMC may represent the claimants. It says the parties may make short submissions by 21 October 2026 about Supreme Court decisions in other collective actions, after which the court is expected to issue an interim decision on those procedural questions. Who does SMC say may be included?
SMC describes the proposed group as people ordinarily resident in the Netherlands who own a PlayStation 4 or PlayStation 5, have a Sony PlayStation Network account and made at least one purchase in the PlayStation Store from 29 November 2013 onward. This is the claimant’s description of the group, not confirmation that every person meeting those criteria has been admitted to a class or will receive compensation. How is this different from the UK and US PlayStation cases?
Similar complaints about PlayStation digital distribution have appeared in other countries, but they are separate proceedings with different claimants, proposed groups and procedural histories.

What should PlayStation buyers take away?
- The Dutch case is a claim about competition and alleged consumer harm in digital PlayStation distribution, not a court-established finding that Sony deliberately set artificially high prices.
- SMC’s 47% figure is the foundation’s account of its economic research comparing digital and physical copies of the same games; the court has not been reported as accepting that result.
- SMC’s proposed group is limited by its stated Netherlands residency, console, account and purchase criteria. The claimant’s description alone does not establish eligibility or an entitlement to money.
- The Dutch, UK and US matters are distinct. In particular, the proposed US settlement is not a settlement for Dutch or UK PlayStation users.
