Philadelphia District Attorney Larry Krasner sued Elon Musk and America PAC in October 2024, asking a judge to stop a $1 million giveaway tied to signing a petition. Krasner alleged that the program violated Pennsylvania lottery and consumer-protection laws. A judge denied his request for emergency relief on November 4; that ruling did not establish that Musk illegally bought votes.
What the Philadelphia lawsuit was about
Krasner filed a civil action in Philadelphia against Musk and America PAC. The case, identified by the Pennsylvania Unified Judicial System as “241003509 Krasner v Musk Philadelphia,” challenged a program advertising a $1 million giveaway connected to signing a petition. The advertised amount was the giveaway’s headline prize, not a payment each signer was promised.
The district attorney asked for an injunction to stop the program. His complaint alleged that it was an illegal lottery under Pennsylvania law and involved unfair or deceptive practices prohibited by the state’s Unfair Trade Practices and Consumer Protection Law. Those were allegations in the complaint, not findings that the defendants had violated the law. The docket and filings are available on the Pennsylvania Unified Judicial System case page.
What the PAC said, and what the judge decided
At the November 4 hearing, America PAC’s lawyers said recipients were selected as paid spokespeople, rather than chosen as winners in a game of chance, the Associated Press reported. That was the defense’s explanation, not a ruling that every part of the program was lawful.

Judge Angelo Foglietta denied Krasner’s emergency request for an injunction on November 4. The court’s docket lists findings of fact and conclusions of law dated November 12. In its November 13 account, the AP reported that the judge said Krasner had not provided evidence of misuse beyond speculation. The AP quoted the judge as saying, “DA Krasner failed to provide any evidence of misuse beyond mere speculation.” That is a reported statement from the findings, not a determination that the program complied with every applicable law.
Krasner claimed that more than 1 million people registered, according to the AP. That figure is attributed to the district attorney; it should not be treated as an independently verified count.

Why the case went to federal court first
Musk and America PAC sought to move the case to federal court. On November 1, 2024, the federal court sent it back to Philadelphia state court, a step known as remand. The DA’s office described the dispute as a state-law matter; that was the plaintiff’s position. The remand addressed where the case would proceed, not whether the giveaway violated Pennsylvania law.
The state judge then considered Krasner’s request for emergency relief and denied it on November 4. The state-court docket lists the complaint, the November 1 order, the November 4 order, and the November 12 findings.

Was this a finding that Musk bought votes?
No. The lawsuit concerned a giveaway linked to petition signing, and the district attorney argued that it violated state law. The emergency-injunction ruling did not find that Musk illegally bought votes. Describing the case as a court ruling that Musk bought votes would go beyond the reported findings and the court action described in the docket.

The Philadelphia injunction case focused on the advertised $1 million giveaway. Separate lawsuits concerned offers of payment for petition signatures and referrals, including claims that promised payments were not made or were insufficient. A January 7, 2026 opinion from the U.S. District Court for the Eastern District of Pennsylvania addressed those separate payment disputes: it allowed some contract claims to proceed, dismissed some matters without prejudice, and dismissed one wage-law claim without prejudice.
