Philadelphia District Attorney Lawrence S. Krasner sued Elon Musk and America PAC on October 28, 2024, asking a Pennsylvania court to stop the PAC’s petition-linked $1 million giveaway. Krasner alleged that the promotion amounted to an illegal lottery and involved unfair or deceptive practices. A judge denied the emergency injunction on November 4; that ruling was not a broad declaration that every similar promotion is lawful.

Why did the Philadelphia DA sue Elon Musk?

The Commonwealth of Pennsylvania, acting through Krasner, filed a civil enforcement action against Musk and America PAC in the Philadelphia Court of Common Pleas. The official Pennsylvania case page lists the complaint and related court filings.

America PAC’s promotion was tied to a petition supporting constitutional rights to free speech and to bear arms. The Associated Press reported that registered voters in swing states could participate by signing the petition. Krasner’s complaint alleged that people provided personal identifying information and made a political pledge in exchange for a chance to receive $1 million. Those were allegations made by the Commonwealth, not established findings that the defendants broke the law.

What the complaint alleged

The complaint invoked Pennsylvania nuisance law and the state’s Unfair Trade Practices and Consumer Protection Law. It characterized the petition-linked payments as an illegal lottery and alleged that the promotion used unfair or deceptive practices. The filing stated Krasner’s legal claims; it did not itself prove them.

What happened to the lawsuit?

  1. October 28, 2024: The Commonwealth filed its civil action in Philadelphia state court.
  2. November 1, 2024: After the defendants sought to move the case to federal court, a federal judge remanded it to Pennsylvania state court. In a statement that day, lead counsel John Summers said the Commonwealth’s position was that state court had jurisdiction to issue an injunction. That was counsel’s argument, not a court holding.   3. November 4, 2024: The state court denied Krasner’s request for an emergency injunction.
  4. November 12, 2024: The Pennsylvania case page lists the court’s findings of fact and conclusions of law as filed.

Did the judge stop Musk’s $1 million giveaway?

No. The judge denied Krasner’s request for emergency relief, so the injunction he sought was not issued. The Associated Press reported that Judge Angelo Foglietta wrote: “DA Krasner failed to provide any evidence of misuse beyond mere speculation.”

At the hearing, America PAC’s lawyers said recipients were selected to serve as paid spokespeople, rather than winning a game of chance, according to the AP. That was the defense’s explanation; it should not be mistaken for a finding resolving every question about the promotion.

Was the giveaway ruled an illegal lottery?

The available ruling on the emergency petition did not establish that the giveaway was an illegal lottery. Krasner alleged that it was, but the judge denied the requested injunction after finding the evidence presented insufficient to support relief at that stage. Denial of an emergency injunction is narrower than a ruling that all similar promotions are lawful, and it does not answer every potential question under federal election law.
