The FDA cited problems with the company’s procedures for reporting drug-safety events; patients’ injury claims are being litigated but remain disputed; and Novo has brought its own lawsuits against Eli Lilly and Hims & Hers. Its 2026 financial outlook has also weakened, even as some second-quarter measures grew.
What “terrible trouble” means in this case
The phrase is a dramatic shorthand for different regulatory, legal and business developments involving Novo Nordisk. They have different sources and different evidentiary weight: an FDA warning letter describes the regulator’s findings about safety-reporting procedures; patient injury claims are allegations in litigation; and the cases Novo filed against other companies reflect Novo’s claims, not court findings. The company’s financial guidance is a separate signal of business pressure.
These developments concern Novo Nordisk, not a court-established conclusion that Ozempic caused a particular injury or that Novo is liable. Nor do the available financial figures show that the company has stopped being commercially successful.
What the FDA warning letter says
On March 5, 2026, the FDA issued a warning letter to Novo Nordisk Inc. about its procedures for receiving, evaluating and reporting postmarketing adverse drug experiences. The letter says serious and unexpected events were not consistently reported within the required 15-calendar-day period. It also describes the company’s failure to promptly investigate a report concerning a semaglutide patient who died by suicide.

The letter is about safety-reporting and investigation processes. It does not say semaglutide caused that patient’s death. FDA’s conclusion was that the company appeared not to have adhered to applicable statutory and regulatory requirements; that is a significant compliance concern, but it is not a finding that the drug caused the reported death.
What the Ozempic-related injury litigation alleges
Federal multidistrict litigation, MDL 3094, in the U.S. District Court for the Eastern District of Pennsylvania consolidates personal-injury lawsuits involving GLP-1 receptor agonists, including Ozempic, Wegovy and Rybelsus. The court describes shared questions concerning alleged injuries, risks, warnings and representations. Novo Nordisk and Eli Lilly deny the allegations.

Consolidation allows common issues in many lawsuits to be managed together; it does not decide whether the allegations are true. The court’s MDL overview does not establish that the medicines caused the alleged injuries or that either company is liable. It lists 2026 status conferences and an evidentiary hearing, but the available materials do not establish a final judgment on the merits. Case status can change, so a current docket check is needed for later rulings or trial developments.
Novo’s lawsuits are claims, not findings against its rivals
Eli Lilly: comparative advertising
On July 21, 2026, Novo announced that it had sued Eli Lilly over comparative advertisements for Zepbound and Mounjaro, alleging false advertising and unfair competition. Novo argues that the ads compared Lilly’s higher doses with lower-dose Novo products while omitting relevant dose information. That is Novo’s position in its complaint, not an established finding that Lilly’s ads were misleading or that a court granted relief.

Novo’s Group General Counsel, John F. Kuckelman, characterized the ads as misleading and said fine-print disclaimers could not fix the impression created by national campaigns. That statement is an executive’s argument for the company’s case, not a judicial ruling.
Hims & Hers: compounded semaglutide
On February 9, 2026, Novo announced a lawsuit against Hims & Hers concerning compounded semaglutide. Novo alleges patent infringement and describes the products at issue as unapproved. Those patent, safety and marketing characterizations should be understood as claims by Novo unless independently established. The available materials do not confirm the case’s final outcome.

What Novo’s 2026 financial outlook shows
Novo’s August 4, 2026 report for the first half of the year presents a mixed picture. In the second quarter, adjusted operating profit was DKK 33,389 million, up 11% at constant exchange rates. Reported operating profit, by contrast, fell 16% at constant exchange rates. The two measures differ: the report discusses rebate reversals and impairment charges as factors affecting comparisons, so one should not be substituted for the other.
Novo revised its full-year 2026 outlook to 0% to -6% growth for both adjusted sales and adjusted operating profit, measured at constant exchange rates. This is a company forecast, not a guarantee of the final result or an independent estimate. Taken together, the figures support a description of a pressured outlook, not a claim that the company has ceased to be commercially successful.
