Ireland’s Data Protection Commission (DPC) fined Meta Platforms Ireland Limited €1.2 billion on May 12, 2023, over Facebook users’ personal data transfers from the EU/EEA to the United States. The DPC also ordered Meta to suspend future transfers and stop specified unlawful US processing, including storage, within set periods. The case did not order Facebook to stop operating in Europe. As of the DPC’s September 21, 2026 fines-register update, the fine was listed as pending appeal.
Why did the DPC fine Meta?
The DPC found that Meta Ireland infringed Article 46(1) of the General Data Protection Regulation (GDPR) by continuing to transfer personal data from the EU/EEA to the United States after the Court of Justice of the European Union (CJEU) issued its Schrems II judgment. The decision concerned transfers made through Facebook by Meta Platforms Ireland Limited—not every Meta service. The DPC’s decision summary describes the finding.
Meta said it had relied on Standard Contractual Clauses (SCCs), which it believed complied with data-protection requirements. The company also pointed to legal uncertainty after the CJEU invalidated the EU–US Privacy Shield in 2020. Those were Meta’s arguments, not the DPC’s conclusion about whether its transfers complied with the GDPR. Meta’s May 2023 response explains the company’s position.
How did the decision reach the DPC?
The DPC’s draft decision drew objections from four of 47 concerned supervisory authorities. All four said an administrative fine should be imposed; two also called for measures addressing data already transferred to the US. The DPC referred unresolved objections to the European Data Protection Board (EDPB) under the GDPR’s Article 65 dispute-resolution process.

The EDPB adopted Binding Decision 1/2023 on April 13, 2023. The DPC issued its final decision on May 12, 2023, on the basis of that binding decision. The EDPB’s Binding Decision 1/2023 sets out its role in resolving the dispute.
What did the order require Meta to do?
The DPC’s remedies were directed at the transfers and processing it found unlawful. The periods below ran from notification of the decision to Meta, rather than starting on the day it was announced.

The suspension and compliance measures did not amount to an order to shut down Facebook or stop serving European users. They addressed transfers and the handling of affected personal data. The DPC’s summary of the final decision describes the measures.

As of the DPC fines register update dated September 21, 2026, the €1.2 billion decision—reference IN-20-8-1—was listed as “Pending Appeal.” The DPC says a fine cannot be collected while an appeal is pending, so the register does not establish that Meta has paid it. It also does not establish the appeal’s final outcome. The DPC fines register is the source for the listed status.

In a May 22, 2023 statement, Meta said it would appeal the substance of the decision and its orders, including the fine, and seek a stay of the implementation deadlines. Meta called the decision “flawed” and “unjustified”; those words express the company’s position, not a judicial finding. Meta’s statement records what it said at that time.
