Why Gujarat High Court Questioned the ‘Hue and Cry’ Around Mahesh Langa’s GST Case

At an October 14, 2024 hearing, the Gujarat High Court questioned the publicity surrounding journalist Mahesh Langa’s case as he withdrew his challenge to a 10-day police remand. The court allowed the withdrawal and, according to a report of the hearing, expressed no opinion on the fraud allegations. Its remarks were about publicity and adjudication—not a ruling that the allegations were true or false.

What happened at the October 14 hearing?

Mahesh Langa, an Ahmedabad-based journalist with The Hindu, had petitioned the Gujarat High Court to challenge an Ahmedabad court’s order placing him in police custody for 10 days. At the October 14 hearing, his counsel said he wanted to withdraw the petition. Scroll and Bar & Bench reported that Justice Sandeep N Bhatt questioned why the matter was receiving so much publicity and said cases would be considered on their merits. (Scroll; Bar & Bench)

Scroll reported the judge as saying, “We don’t want any publicity, at least during the course of adjudication,” followed by, “This is not fair.” He also said: “Whoever it is – even politician, reporter or some normal citizen – the court of law is court of law. When we consider, it is on merits. Why such extra hue and cry?” These are quotations reproduced in Scroll’s report, not verified here against an official transcript.

Langa’s counsel said there was nothing against the court. The judge reportedly replied that his comment was directed at whoever might be trying to create that impression. The exchange concerned publicity and the court’s approach to adjudication; it did not amount to a finding on the case evidence.

What did withdrawal mean for the allegations?

It meant the High Court did not decide Langa’s challenge to the remand on its merits. LiveLaw reported that the court permitted withdrawal and stated it had expressed no opinion on the merits. The hearing therefore neither established guilt nor cleared Langa of the allegations. (LiveLaw)

That distinction matters: a remand order concerns custody during an investigation, while a determination of criminal liability would require a separate process. The reported October 14 outcome was the withdrawal of a petition challenging the custody order—not a judgment resolving the alleged GST fraud.

What was Langa accused of?

Contemporaneous reporting said the arrest followed a complaint by the Central Goods and Services Tax department concerning an alleged scheme involving bogus companies and fraudulent input tax credit claims. These were allegations under investigation, not findings made at the High Court hearing. (Scroll)

Scroll reported that police relied substantially on a statement from a relative and that investigators had not found transactions directly tying Langa to the alleged fraud. How did the remand challenge fit into the timeline?

  1. October 7, 2024: Scroll reported that Gujarat Police units raided 14 locations in connection with the case.

  2. October 10: Langa and others were sent to 10 days of police remand, according to Scroll’s account.

  3. October 11: Langa filed the petition challenging the remand order, as reported by Scroll.

  4. October 14: His counsel sought to withdraw the petition, and the High Court permitted withdrawal without expressing an opinion on the allegations, according to LiveLaw.

Was the later bail decision part of the same High Court hearing?

No. A separate proceeding followed in the Ahmedabad magistrate’s court. Bar & Bench reported that the magistrate denied bail on October 25, 2024, and described the magistrate’s reasoning as indicating an active role in the investigation. That report referred to alleged transactions involving Dhruvi Enterprises, bogus input credits and DA Enterprise. These remained allegations or the magistrate’s stated reasoning at that stage; the bail decision was not the Gujarat High Court’s October 14 ruling. (Bar & Bench)

What is known about the case now?

The reports covered here establish what happened at the October 2024 remand hearing and describe subsequent developments only through the separately reported October 25 bail decision. They do not establish the final status of the investigation, any trial, or connected proceedings as of October 8, 2026.
