Fiona Harvey sued Netflix in June 2024, seeking at least $170 million over what she alleged was a false and damaging portrayal in Baby Reindeer. That figure was her requested damages—not money awarded by a court. In September 2024, a judge dismissed several claims but allowed defamation and intentional-infliction-of-emotional-distress claims to proceed at that stage. Netflix appealed, and the trial-court case was stayed; the available records do not verify the appeal’s later outcome.
Why did Fiona Harvey sue Netflix?
Harvey filed a complaint on June 6, 2024, against Netflix, Inc. and Netflix Worldwide Entertainment, LLC in the U.S. District Court for the Central District of California. Her six claims arose from the series’ portrayal of the character Martha, who is based on comedian Richard Gadd’s experiences.
In the complaint, Harvey alleged that the series falsely depicted her as a twice-convicted stalker sentenced to five years in prison and as someone who sexually assaulted Gadd. Those are allegations in her filing, not findings established by the court. The complaint asserted defamation, intentional infliction of emotional distress, negligence, gross negligence, common-law right of publicity, and a statutory right-of-publicity claim under California Civil Code section 3344. Was Fiona Harvey awarded $170 million?
No. Harvey’s complaint sought at least $170 million in damages. A request in a lawsuit is not an award, and the figure should not be described as money she won or received. The September 2024 order did not award her that amount.

What did the judge decide?
On September 27, 2024, U.S. District Judge R. Gary Klausner dismissed Harvey’s negligence and gross-negligence claims, both right-of-publicity claims, and her request for punitive damages. The judge allowed the defamation and intentional-infliction-of-emotional-distress claims to proceed beyond the motions then before the court. Read the September 27 order.
The ruling was a decision about which claims could continue at that point in the case. It was not a final judgment that Netflix was liable, nor did it establish the truth of Harvey’s allegations. In explaining the distinction at issue, Judge Klausner wrote: “There is a major difference between stalking and being convicted of stalking in a court of law.”

What happened to Netflix’s appeal?
Netflix appealed the denial of its special motion to strike. After the appeal, the district court stayed proceedings while the appeal was being exhausted and vacated the pretrial and trial dates that were then in place.
