Why Congress Sought an Investigation Into BJP Donations From Firms Facing Agency Action

Congress sought an investigation into reported BJP donations by companies facing central-agency action, citing questions about timing while stopping short of alleging the cases were illegal.

Congress sought an investigation after a joint investigation by Newslaundry and The News Minute reported that companies facing action by central agencies donated to the BJP. The figures raised questions about timing, but the reporting does not establish that agency action caused the donations or that any quid pro quo occurred.

What prompted Congress’s request?

On February 23, 2024, Congress general secretary KC Venugopal wrote to Union Finance Minister Nirmala Sitharaman asking for an investigation into donations to the BJP by companies that had faced action by central agencies. The letter followed a joint Newslaundry–The News Minute investigation published on February 20, 2024, as described by Scroll.

Venugopal also asked whether the government would issue a white paper on BJP finances and cooperate with a Supreme Court-monitored investigation, according to Hindustan Times.

What did the reporting say about the donations?

The joint investigation reported that at least 30 companies donated nearly Rs 335 crore to the BJP between financial years 2018–19 and 2022–23 while facing action by central agencies during that period. The agencies included the Enforcement Directorate (ED) and the Income Tax Department; Congress’s letter also raised concerns involving the Central Bureau of Investigation (CBI). The figures and period were reported by The News Minute and Scroll.

Within that broader pattern, Scroll reported that 23 companies had not donated to the BJP before raids. Venugopal’s cited figures, reported by Hindustan Times, put those firms’ donations during the period at Rs 187.58 crore. This is a narrower group and figure than the reported total for at least 30 companies.

Why did Congress say the pattern warranted scrutiny?

Congress questioned why companies that had faced agency action were donating to the ruling party, and whether the timing was coincidental. Venugopal’s statement, reported by The News Minute, said: “We are nowhere alleging that the cases filed, or the action taken by the investigating agencies are illegal, but it does warrant an investigation, on why these ‘dubious’ firms who have ED cases against them are donating to the ruling party BJP, despite ED investigation against them. Is it a mere coincidence that they are donating to the BJP, after ED action?”

The distinction matters: Congress called for an inquiry into the reported pattern but said it was not alleging that the cases or agency actions were illegal. A donation and an agency action occurring within the same period do not, by themselves, show why the donation was made or establish a connection between the two.

  • Congress’s position: The timing and pattern warranted investigation, including scrutiny of possible coercion or quid pro quo.
  • Not established by the cited reporting: That agency action caused a donation, that a company and the BJP reached an agreement, or that any agency action was unlawful.

What happened to the requested investigation?

The cited reports establish that Venugopal made the request on February 23, 2024. They do not establish whether the requested investigation was later opened, completed or rejected.
