College athletes should be able to share fairly in the economic value they help create. Their performances, names and public appeal contribute to college sports’ value, while many athletes have only a short period of eligibility in which to compete. That is a case for meaningful compensation and clear protections—not for identical salaries for every athlete or a claim that every athlete is a professional.
What “getting paid” means now depends on the payment channel. For participating NCAA Division I schools, the House settlement’s rules permit direct institutional benefits alongside third-party name, image and likeness (NIL) deals. Those arrangements are distinct from a fund for damages tied to past restrictions.
Why should college athletes get paid?
They help create value
College sports generate economic and public value in part through athletes’ performances and identities. A fairness argument follows: when an athlete’s name, image or performance helps attract attention and commercial interest, the athlete should have a real opportunity to share in that value. The NCAA’s compensation restrictions were challenged under antitrust law, but that legal history does not mean a court has declared that every possible form of athlete compensation is required.
Compensation gives athletes more choice
Payment can give athletes resources and agency during a demanding period when they are balancing sport and education. The case for compensation is not that money automatically improves academic or health outcomes; the available evidence cited here does not establish that causal effect. It is that athletes should have a fair chance to benefit from their commercial contributions and to make choices about opportunities available to them.

How can college athletes be paid now?
There are three different channels to keep separate: direct benefits from participating Division I institutions under the House settlement framework, commercial NIL agreements with third parties, and proposed compensation for past restrictions. They have different payers, triggers and coverage.

These channels matter because “college athletes get paid” does not mean every athlete receives the same amount, from the same payer, for the same reason. NIL compensation depends on a commercial agreement; direct benefits operate within the settlement framework; and back damages address alleged past harm.

What changed under the House settlement?
The settlement changed the practical debate by permitting participating Division I institutions to provide direct benefits to athletes under a new framework, in addition to third-party NIL arrangements. Baker described the change as “a huge step forward for college sports” in his June 6, 2025 statement. The arrangement is not an unrestricted, identical salary system for all college athletes.
The Congressional Research Service reported that the settlement’s injunctive terms took effect on July 1, 2025, even though appeals delayed damages payments. That distinction is important: the prospective rules for direct benefits and the payments for past restrictions have different timelines.

What does fair compensation require?
Fairness is not the same as equal pay
A fair system does not have to pay every athlete the same amount. Athletes and sports differ in commercial opportunities, and the settlement framework sets a school-level limit rather than an individual entitlement. The harder policy question is how institutions distribute a finite pool of benefits among athletes and sports, and what standards make that distribution fair and understandable.
Keep education and athlete protections in view
Compensation should be considered alongside the educational, health and other support athletes rely on. A payment framework is not automatically fair if it makes those protections less clear or leaves athletes without understandable rules. The source material does not establish that the settlement has caused particular teams or programs to be cut, so predictions about specific losses should not be treated as settled results.

Transparency and review can coexist with compensation
Rules for disclosure, review and eligibility affect how useful compensation is in practice. The NCAA’s settlement summaries describe mechanisms for reviewing third-party agreements and disclosing them. Those safeguards can help distinguish genuine commercial deals from arrangements that do not involve real promotional work, but they also shape athletes’ ability to negotiate. The rules remain subject to change.

Critics and supporters disagree about whether current arrangements provide enough protection and how far future rules should go. A finite institutional pool raises legitimate questions about how money is divided across sports and athletes. Caps and agreement review may also limit bargaining. These are reasons to scrutinize the design and its effects, not proof that compensation itself is unfair or that a particular group has already lost opportunities.

The NCAA has presented the settlement as a way to provide athlete benefits and clearer NIL rules. In a September 28, 2026 Associated Press report, supporters of a federal college sports bill argued for athlete protections, while critics raised concerns about the proposed approach. The Senate passed the bill 77-22, but the report said it still needed House passage. That is a dated account of legislative status, not evidence that the bill became law.
What the current rules do—and do not—settle
The House settlement has opened a path for direct institutional benefits at participating Division I schools, alongside commercial NIL deals. It does not establish that every school, athlete or NCAA division receives the same payments. Nor do the settlement’s headline figures tell readers how much any individual athlete will receive, how a school will distribute benefits, or whether compensation will improve academic or health outcomes.
The case for paying college athletes is ultimately a case for a fair share of the value they help create, with transparent rules and meaningful protections. The details—who is covered, how compensation is allocated, and how athletes can challenge or understand decisions—determine whether that principle works in practice.
