California sued ExxonMobil on September 23, 2024, alleging that for decades the company promoted plastic recycling as a remedy for plastic waste while knowing that recycling could not deliver that outcome. The state asks a court for abatement, injunctive and equitable relief, disgorgement, and civil penalties. Those are requests, not rulings. No court has found ExxonMobil liable, and ExxonMobil disputes the state’s account. In February 2025, a federal court sent the case back to California state court, and that ruling addressed only where the case would proceed.
What California alleges
The state’s complaint, filed in San Francisco County Superior Court, says ExxonMobil and industry messaging presented recycling as a solution to growing plastic waste even though the company knew about the limits of recycling systems. These are the state’s characterizations in its pleading. A court has not adopted them.
The complaint separates two kinds of recycling. The distinction matters because the two are often discussed as if they were the same thing.
Mechanical versus advanced recycling

The California Attorney General’s September 2024 announcement said about 5% of U.S. plastic waste is recycled, and that the rate has never exceeded 9%. These are the state’s figures. The announcement does not identify the original study or its publication year, so treat them as the state’s numbers rather than an independent current estimate or a finding in the case.

What ExxonMobil says
As reported by the Associated Press, ExxonMobil’s response is that California’s recycling system is ineffective and that state officials have known this for years. That is the company’s position, not a court finding. It frames the dispute around the same question the state raises: whether recycling can deliver what its promotion promised.

What California is asking the court to order
- Abatement of the harm the state attributes to the company’s conduct
- Injunctive and equitable relief
- Disgorgement
- Civil penalties
These are the remedies the state has requested. A request for relief is not an award, and the record reviewed for this article shows no order granting any of them.
The Attorney General’s statements
Rob Bonta, California’s Attorney General, said in the state’s September 23, 2024 announcement: “For decades, ExxonMobil has been deceiving the public to convince us that plastic recycling could solve the plastic waste and pollution crisis when they clearly knew this wasn’t possible.”

After the federal court remanded the case, the California Department of Justice issued a statement in which Bonta said: “At the California Department of Justice, we stand ready to litigate this case, which directly affects California’s laws and its residents, and hold ExxonMobil fully accountable for its role in actively creating and exacerbating the plastic pollution crisis through its campaign of deception.”
Both statements are the Attorney General’s allegations and reactions. The headline’s phrase, “perpetuating the lie,” expresses the state’s framing. It is not a court conclusion.

The separate Texas case
ExxonMobil has also sued Bonta in Texas over statements he made about the company’s recycling claims. A 2026 federal order addressed whether claims based on some of those statements could proceed. That order concerns the defamation dispute between the company and the Attorney General. It does not resolve the California suit or its allegations.
What this means for consumers and investors
The lawsuit does not change how a recycling bin works, and its outcome cannot be predicted from the filings. For a household, the practical takeaway concerns labels and marketing claims. For an investor, it concerns legal exposure that remains open.

- Ask what a recycling rate measures: collection, sorting, or actual reprocessing into new material.
- Check the date and original source of any percentage before relying on it.
- Notice whether a claim refers to mechanical or advanced recycling. The complaint treats the two as distinct.
- Read “recyclable” as a statement about what is possible, not about what your local system actually processes.
Legal exposure
The state’s requested remedies include disgorgement and civil penalties, but the record shows requests only. Anyone assessing the company’s exposure would need the court’s eventual rulings, which this article cannot supply.
