Institutional access to Bitcoin has expanded, but that does not prove Bitcoin is more liquid than other assets—or that large trades now move its price less. Liquidity depends on measurable conditions such as bid-ask spreads, executable order-book depth and the price impact of a specific trade. The SEC’s 2024 approval of spot Bitcoin exchange-traded product (ETP) shares created a regulated securities-market route to Bitcoin exposure; it did not establish a comparative liquidity advantage.
What does “liquidity” mean for an investor?
Liquidity is the ability to buy or sell promptly without paying a large premium or moving the market price substantially. A headline volume figure alone cannot answer that question. The useful measure depends on what an investor is trying to trade and how much.

A fair claim that Bitcoin has a “liquidity advantage” must name the comparison—such as a specific asset or market—and the period, venues, order sizes, and metric. Without those details, the phrase is not a measured conclusion.
What changed when the SEC approved spot Bitcoin ETP listings?
On January 10, 2024, the U.S. Securities and Exchange Commission approved the listing and trading of a number of spot Bitcoin ETP shares. That decision opened a securities-market channel for Bitcoin exposure. It was not an endorsement of Bitcoin, crypto trading platforms, or intermediaries. SEC Chair Gary Gensler also cautioned that the action concerned products holding Bitcoin and did not signal approval of listing standards for crypto-asset securities.

The listed-products channel has securities-market rules: the products list on registered national securities exchanges, disclosures apply, and broker-dealers recommending ETPs to retail investors are subject to Regulation Best Interest; investment advisers have fiduciary duties. Those protections and obligations apply to the securities channel, not to every venue where Bitcoin trades.
Terminology matters, too. The approved products are commonly called spot Bitcoin ETFs in everyday coverage, but SEC Commissioner Caroline Crenshaw noted in her dissent that they were not registered investment companies under the Investment Company Act of 1940. “Spot Bitcoin ETP” is the more precise description when that legal distinction matters.

Why did the SEC discuss CME Bitcoin futures?
The SEC’s approval rationale was about surveillance and the ability to detect manipulation—not a finding that Bitcoin spot markets are deep or uniformly liquid. In its order, the Commission did not find the CME Bitcoin futures market to be of “significant size” relative to the spot market. It nevertheless concluded that spot and futures prices were sufficiently correlated that manipulation affecting spot prices would likely affect CME futures prices, where surveillance could help detect those effects.
That reasoning does not show that Bitcoin has low transaction costs or better liquidity than another asset. Correlation between price series is not a measure of executable depth. Commissioner Mark Uyeda criticized how the Commission applied the “significant size” concept, describing its use in other commodity ETP contexts as apparently involving liquidity and futures-market volume compared with the overall futures market for the commodity. His concurrence was a criticism of the Commission’s approach, not a current measurement of Bitcoin spot liquidity.

How can ETP trading affect the liquidity picture?
ETP shares and the Bitcoin held by an ETP are related markets, but their liquidity is not interchangeable. ETP shares trade on securities exchanges during their trading hours. Authorized participants can create or redeem shares to help keep the share price aligned with the value of the assets in the product. That arbitrage mechanism links the share price to portfolio value; it does not guarantee deep liquidity on every underlying Bitcoin venue.
The initial filings used cash creation and redemption. In a January 10, 2024 statement, SEC Commissioner Hester Peirce noted that cash mechanisms can require a fund to buy or sell Bitcoin. That process can involve bid-ask spreads, operational costs, and timing risk between a fund’s net asset value calculation and its trade execution, particularly in a volatile market. Those are implementation considerations raised in the SEC record, not measured current costs for every product.

Institutional channels may broaden access and add venues and arbitrage links. Whether that changes underlying spot-market liquidity, and by how much, depends on actual order books and execution data. The SEC materials do not establish that ETP approval caused Bitcoin spot spreads to narrow, market depth to rise, or institutional execution quality to improve.

Volume is activity reported by a venue; it is not the same as orders that an investor can execute at a predictable price. In her 2024 dissent, Commissioner Crenshaw cited a 2023 analysis by Cong and coauthors estimating that wash trading averaged as high as 77.5% of volume across a sample of 29 major unregulated crypto exchanges. The study covered its sampled exchanges and four cryptocurrencies. The figure is a historical, scoped estimate—not a live measure of Bitcoin-only trading or a rate that can be applied to every exchange.

Crenshaw also argued that global spot-market data were incomplete and that wash trading and surveillance concerns warranted caution. Those were the dissenting commissioner’s arguments, not findings adopted by the Commission. For an investor, the practical lesson is to examine the venue, data methodology, and executable quotes behind a volume number rather than treating aggregate volume as proof of liquidity.
How should investors compare routes to Bitcoin exposure?
Compare the dimensions that affect your own trade, rather than treating access to a listed product as a proxy for the liquidity of Bitcoin itself:
- Listed-share liquidity: Check the ETP’s bid-ask spread and available depth during exchange hours, and consider the size and timing of your order.
- Underlying spot execution: Look for venue-specific spreads, order-book depth at stated price bands, and execution costs for a stated order size. Keep spot-market data separate from ETP-share volume and CME futures volume.
- Costs beyond the displayed spread: Consider fund fees and any transaction costs involved in creating, redeeming, or trading shares.
- Custody and operations: Understand how the product holds and safeguards Bitcoin. Gensler said the SEC’s approval did not endorse particular custody arrangements.
- Access and protections: Consider the securities-market rules that apply to the ETP route and distinguish them from the rules governing a crypto trading venue or intermediary.
For meaningful comparisons, use the same time window, order size, venue type, and volatility conditions. A spread quoted for a small trade at one moment does not predict the execution cost of a large order during a sharp market move.
What the evidence supports—and what it does not
The SEC’s January 2024 action supports a clear conclusion about access: investors gained a regulated securities-market route to spot Bitcoin exposure through listed ETP shares. Its approval order also explains why the Commission believed CME futures surveillance could assist in detecting manipulation relevant to those products.

It does not supply current, comparable Bitcoin-versus-other-asset measurements for spreads, depth, price impact, or execution quality. Nor does it establish that spot Bitcoin became more liquid because ETPs were approved. A claim of a Bitcoin liquidity advantage therefore needs current market data with a defined comparison and measurement method; institutional participation by itself is not that evidence.
