Why 39 States Joined the Live Nation–Ticketmaster Lawsuit

The 39-state coalition joined the DOJ’s antitrust case in August 2024. The case later split between a proposed settlement and continued litigation, which produced a jury verdict in April 2026.

The figure refers to an August 2024 expansion of a federal antitrust case—not a new development in 2026. The lawsuit accused Live Nation Entertainment and its subsidiary Ticketmaster of anticompetitive conduct in live entertainment and ticketing. By 2026, some plaintiffs had proposed a settlement while others continued to trial; a jury later found for the litigating states, but the latest dated records cited here do not establish the case’s final outcome.

What does “39 state AGs” mean?

In May 2024, the U.S. Department of Justice (DOJ) filed suit with 29 states and the District of Columbia. An amended complaint in August added ten state plaintiffs, bringing the state attorneys general count to 39, alongside D.C. TechCrunch reported the 39-states-plus-D.C. formulation; Nebraska’s Attorney General’s Office described DOJ and the 39 state attorneys general as 40 co-plaintiffs. The defendants are Live Nation Entertainment, Inc. and its subsidiary Ticketmaster L.L.C. The case was filed in the U.S. District Court for the Southern District of New York. The governments alleged violations of antitrust law involving live entertainment and ticketing; those allegations should not be treated as findings unless a court or jury has ruled on them. Why did the states join the case?

The state officials joined the DOJ’s challenge to the companies’ alleged conduct in live entertainment and ticketing. Nebraska Attorney General Mike Hilgers framed the action as a response to market dominance and high consumer fees, saying consumers deserved the benefits of competition. That was a plaintiff official’s position, not a judicial finding. The lawsuit sought to address alleged anticompetitive practices; the coalition count alone does not determine whether any particular ticket fee was unlawful.

How did the case split in 2026?

The plaintiffs followed two tracks: a proposed settlement involving the United States and six states, and continued litigation by other states and D.C. Their procedural positions and results are different.

Track Parties and status What it means
Proposed settlement The June 12, 2026 proposed final judgment names the United States and Arkansas, Iowa, Mississippi, Nebraska, Oklahoma, and South Dakota as settling plaintiffs. The filing describes agreed terms, but the judgment’s provisions remain proposed unless and until court approval is verified. The company said approval was required under the Tunney Act. Continued litigation The remaining litigating states and D.C. proceeded to trial. On April 15, 2026, a jury returned a verdict for them on all claims that remained. The jury awarded damages calculated per ticket sold, but did not calculate the number of covered tickets. What did the jury verdict decide—and leave open?

The April 2026 verdict was for the states that continued the litigation, on the claims remaining before the jury. The damages award was expressed per ticket, but the jury did not determine how many tickets were covered. That leaves a material step between the verdict and a final, quantified damages outcome.

Live Nation disputed the verdict and the damages award and said it intended to appeal as needed, according to its July 30 filing. The same filing reported a $450 million accrual for the six months ended June 30, 2026, which the company described as its estimate of ultimate loss associated with the settling states and jury damages award. It is an accounting estimate, not a court-determined final damages amount.

What is known about the case’s status?

The DOJ case page was updated June 30, 2026. Live Nation’s July 30, 2026 filing said post-trial motions were scheduled for argument the following day. These dated records establish that post-trial proceedings were still in progress at that point, but do not establish what happened after the scheduled argument or whether the proposed settlement was later approved. Nothing in these cited records establishes that concertgoers had received refunds or that Ticketmaster had been ordered to separate from Live Nation. Those outcomes should not be inferred from the coalition’s 2024 expansion, the 2026 jury verdict, or the proposed judgment alone.
