A proper officer under GST is an officer assigned to carry out a particular function under the applicable GST law. The title or rank alone does not establish that the officer can take every kind of GST action: authority depends on the provision involved, the function assigned, and the applicable jurisdiction and assignment instrument.
What does “proper officer” mean under GST?
“Proper officer” is a statutory role, not a general rank that automatically carries every GST power. In practical terms, it means the officer authorized to perform the particular function assigned by the provision being applied. The Central Goods and Services Tax Act (CGST Act) uses the term for distinct tasks, including audit, inspection and search, tax determination, and recovery. The precise authority for an action must be checked against the relevant law and current assignment instruments.

The CGST Act addresses the term in section 2(91), while section 5 concerns powers of officers. Because the applicable wording and assignment instruments can change, consult the current official text rather than relying on an old extract or a general list of officer ranks.
What powers can a proper officer exercise?
There is no single bundle of powers that every proper officer may use in every case. The governing provision sets the task and its conditions; approvals, procedural steps, and limits may differ by action.

Being authorized for one task does not, by itself, establish authority for another. For example, an audit assignment alone does not show that the same officer may conduct a search or recover an amount in a particular case.
How are appointment and assignment different?
Appointment
Appointment concerns a person’s status as an officer under the relevant law and service framework. It does not, on its own, answer whether that person may perform every statutory GST function.
Assignment
Assignment identifies the statutory duties an officer may perform. To assess a specific action, match the officer to the function authorized by the applicable provision and the relevant assignment notification, order, or other instrument. Do not infer authority solely from a designation such as “commissioner,” “superintendent,” or another rank.
How do jurisdiction and central or state administration affect authority?
The issuing administration and governing law matter. A notice issued under central GST law should be assessed by reference to that law and its applicable assignment instruments; a state GST notice should be checked under the relevant state law and instruments. A central officer’s authority should not be assumed to cover every state GST function, or vice versa. Any cross-empowerment or shared authority must be established under the current applicable instruments.
Jurisdiction is not settled by an officer’s title alone. Check both the function assigned and the relevant territorial or administrative jurisdiction. There is no basis for treating one general list of ranks as a complete, current jurisdiction map for every GST administration and function.
How can you check whether a GST officer is authorized?
- Identify the issuing administration. Note whether the notice or action is issued by a central or state GST authority and identify the law named in it.
- Read the exact legal basis. Record the Act, section, rule, or other provision cited. The provision tells you what function is being exercised and what procedure may apply.
- Match the function to the officer. Check the current assignment notification, order, or other applicable instrument for authority to perform that specific function.
- Check the jurisdiction. Confirm the relevant territorial or administrative scope under the applicable law and instrument.
- Check required conditions and deadlines. Look for any stated approval, statutory grounds, service requirements, response period, or limitation period that applies to the action.
These checks help identify the questions raised by a notice; they do not, by themselves, prove that it is valid or invalid. That depends on the facts, the applicable law, and the instruments in force when the action was taken.

What should you do if a notice appears to be outside the officer’s authority?
Do not ignore a notice merely because you question the issuing officer’s authority. Preserve the notice and its attachments, note how and when it was served, identify the cited provision, and check the response deadline and procedure stated in it. If authority or jurisdiction appears doubtful, raise the specific issue through the applicable response or review route, supported by the relevant provision and assignment instrument. GST legislation and officer assignments can change. An order made under a different statute does not establish an officer’s authority under GST, even if its title refers to a “proper officer.” Always match the instrument to the Act and function named in the notice, and verify that it is current. This is especially important when an explanation gives a fixed rank-to-power table without identifying the relevant notification, jurisdiction, and date.
