When Flights Are Diverted: What Are Passengers’ Rights?

A diversion does not automatically mean compensation. Your rights depend on onward transport, final arrival delay, the cause, and the rules governing your itinerary.

A diversion does not automatically entitle you to cash compensation. Your options depend on whether the airline will get you to the airport on your ticket, how late you reach your final destination, why the diversion happened, and which jurisdiction’s rules apply. Ask the airline to confirm your onward plan before deciding whether to accept a changed itinerary or seek a refund.

What to do when your flight lands somewhere else

  1. Ask how you will reach your ticketed destination. Ask the airline whether it will arrange transport from the diversion airport or reroute you, and request the plan in writing if possible. Canada’s Canadian Transportation Agency (CTA) specifically says an airline must transport passengers to the airport on their ticket unless they choose not to accept that transportation.
  2. Check your options before accepting a substitute. If you do not want to travel on a significantly changed itinerary, ask the airline to explain any refund option before accepting a voucher, credit, or alternative. Under the U.S. Department of Transportation’s (DOT) refund guidance, whether you reject the changed or offered itinerary and accept other compensation matters.
  3. Ask why the flight diverted. Keep the airline’s explanation; the cause can affect assistance or compensation eligibility under some rules.
  4. Track arrival at the destination on your ticket. Touchdown at the diversion airport is not necessarily arrival at your final destination for delay-rights purposes.
  5. Keep records and receipts. Save your itinerary, boarding pass, airline messages, the diversion explanation, details of transport or refunds offered, and receipts for expenses. These records can help you explain what happened, but they do not guarantee reimbursement for expenses you arrange yourself.

Which rights may apply in the EU, UK, Canada, or United States?

The rules are not interchangeable. The relevant route, operating carrier, cause, arrival delay, and your response to an alternative can all matter. The table summarizes what the official sources establish; it is not a guarantee that a particular diversion qualifies.

Jurisdiction What the official guidance establishes What not to assume
European Union The European Commission’s passenger-rights guidance describes reimbursement or rerouting, assistance, and compensation in specified disruption circumstances under Regulation 261/2004. A diversion alone does not establish a right to compensation. The event must fit the applicable rules, and itinerary and operating-carrier scope matter.
United Kingdom The UK government guide says compensation may be due when arrival at the final destination is more than three hours late and the delay was caused by the airline. That threshold is not a worldwide rule, and it does not mean every diversion qualifies. Check UK-specific eligibility and exceptions.
Canada CTA guidance says the airline must transport passengers from the diversion airport to the airport on their ticket unless they decline. Under Canada’s Air Passenger Protection Regulations (APPR), rights vary by disruption cause and carrier size; the rules cover flights to, from, and within Canada, including connections. Do not assume the same rebooking or compensation outcome for every airline or cause.
United States DOT treats a change to an origin or destination airport as a significant change for refund purposes. If you reject the changed or offered alternative itinerary and do not accept a credit, voucher, or other substitute compensation, DOT guidance says you are entitled to a refund. DOT also says federal rules do not require airlines to provide airport-delay amenities. Taking the alternative generally means no refund under this rule. Do not assume U.S. federal law requires EU-style delay compensation, meals, or hotels for an ordinary delay; an airline may have its own commitments.

How transport, refunds, compensation, and care differ

  • Transport or rerouting is about getting you onward to the destination on your ticket. It is separate from returning the ticket price.
  • A refund returns ticket money when the applicable test is met. In the United States, DOT’s guidance makes rejecting the changed itinerary and not accepting substitute compensation material to refund eligibility.
  • Compensation may be an additional payment under some regimes, but depends on the law that applies and its conditions. The UK government guide, for example, ties possible compensation to a delay of more than three hours at the final destination caused by the airline.
  • Care while waiting means assistance during disruption, which may be addressed by some rules or airline commitments. There is no universal right established here to a hotel, meal, or taxi for every diversion.

Whether you accept an offered alternative can affect which remedies remain available. Ask the airline to explain the consequences before making a choice if you are unsure.

How to pursue an unresolved claim

Start with the airline and keep a copy of your complaint and its response. If the issue remains unresolved, consult the regulator or official dispute route for the jurisdiction governing your itinerary. Complaint procedures and deadlines can vary, so check the relevant authority’s current instructions rather than relying on a general deadline.

For EU rights in particular, use the Commission’s current public guidance: a reported political agreement to revise passenger rules does not by itself establish that amended provisions have entered into force.
