For Indian tax purposes, a non-resident generally needs a Tax Residency Certificate (TRC), prescribed treaty information and supporting documents to claim relief under a Double Taxation Avoidance Agreement (DTAA) on India-source income. For India’s Tax Year 2026–27, the applicable framework is the Income-tax Act, 2025: the non-resident’s treaty-information form is Form 41. This is an India-focused guide; the answer differs if you are an Indian resident seeking a certificate to claim treaty relief in another country.
When is a TRC needed for DTAA relief in India?
A TRC is evidence that the claimant is resident in the other treaty country. For a non-resident seeking DTAA relief on income from India, the Income Tax Department describes the required documentation as a TRC from the tax authority of the country of residence, supplementary prescribed information and supporting records. See the department’s DTAA and foreign tax credit guidance and Double Taxation Relief guidance.

Having a TRC does not, by itself, establish that a lower rate applies. The relevant treaty, the type of income and the claimant’s facts determine whether treaty relief is available and what conditions must be met. Depending on the treaty article, those conditions may include beneficial ownership or other eligibility requirements. The payer may also require documents through its own process.

Which tax-year framework and form apply?
The transition depends on when the relevant tax year begins, not simply on the year named in a filing. India’s Tax Year 2026–27 begins on 1 April 2026, so it falls under the Income-tax Act, 2025. The Income Tax Department’s Income Tax Forms FAQ and Non Resident FAQs describe the transition.

| Claim pathway | Indian-side form or certificate | Applicable period |
|---|---|---|
| Non-resident claims treaty relief on India-source income | For the new framework, provide treaty information in Form 41 and the required TRC and supporting documentation. | Income-tax Act, 2025 for tax years beginning on or after 1 April 2026; Income-tax Act, 1961 for tax years beginning before that date. |
| Indian resident seeks an Indian residence certificate for use abroad | Under the new framework, apply in Form 42; the Assessing Officer issues Form 43 after reviewing and accepting the details. | Income-tax Act, 2025 for tax years beginning on or after 1 April 2026; earlier periods fall under the 1961 Act framework. |
The Form 41 manual identifies it as the prescribed form for treaty details supplied by a non-resident seeking DTAA relief under section 159 and Rule 75. The manual lists a residence-country tax identification number and the relevant certificate among the prerequisites. Check the Form 41 User Manual for filing requirements.
Is Form 10F replaced by Form 41?
Not as a blanket rule for every year. The applicable form depends on the tax year’s start date and the framework governing it. For tax years beginning on or after 1 April 2026, the new portal’s non-resident treaty-information form is Form 41. Do not treat Form 41 as a universal replacement for earlier-period requirements; confirm the form applicable to the specific period.

If you are an Indian resident claiming treaty relief abroad
If you are an Indian tax resident and need an Indian residence certificate to claim relief in another country, you are following a different route from a non-resident claiming relief in India. Under the Income-tax Act, 2025 framework, apply to the Assessing Officer in Form 42. The officer issues Form 43 after receiving the application and being satisfied with its details, according to the Form 42 User Manual.
For the earlier framework, the department’s guidance identifies Forms 10FA and 10FB for applying for and receiving a residence certificate. An Indian certificate supports a claim abroad, but the destination country’s treaty, its documentation requirements and the payer’s process govern how you use it.

How to work out what to file
- Identify the direction of the claim. Establish whether a non-resident is claiming relief on India-source income, or an Indian resident needs an Indian certificate for use abroad.
- Pin down the relevant tax year. Use the tax year’s start date: before 1 April 2026 means the 1961 Act framework; on or after that date means the 2025 Act framework. “Assessment Year 2026–27” is not interchangeable with “Tax Year 2026–27”; the department says income associated with AY 2026–27 remains under the earlier Act.
- Use the form for the correct pathway and period. For a non-resident’s India claim under the new framework, consult Form 41 requirements. For an Indian resident’s certificate application under the new framework, use Form 42.
- Check the treaty article for the payment. Confirm the income category, treaty residence and any other conditions that apply to the claimant and payment.
- Confirm the evidence and timing with the relevant parties. Check the tax authority that issues the TRC and the payer or destination-country process for any required documents and submission deadline.
What a TRC does not establish
- It does not guarantee a lower treaty rate. Entitlement depends on the applicable treaty article and facts, not just possession of the certificate.
- It is not a domestic withholding certificate. A TRC is residence evidence for a treaty claim; it is distinct from a source-country certificate that may reduce or eliminate withholding under domestic law.
- It is not a foreign tax credit claim. A foreign tax credit concerns relief for tax already paid and is a separate process from establishing treaty residence for a payment.
No single treaty rate, certificate validity period or submission deadline applies to every country pair and payment type. Check the relevant treaty, issuing authority and payer instructions rather than assuming a universal rule.
