Put the request in writing, identify the witness and the exact statement, explain why its accuracy or credibility matters, and ask the authority to rule on the request before using that evidence.
This is a natural-justice issue, not an automatic right in every GST proceeding. Indian High Courts have applied the Supreme Court’s reasoning in Andaman Timber Industries v. Commissioner of Central Excise, but the outcome depends on the evidence, the statutory setting, the timing of the request and the controlling jurisdiction.

What the cross-examination issue means in a GST case
During an investigation, a GST officer may record statements from employees, suppliers, customers, transporters or other persons. A show-cause notice or proposed order may then use those statements to support tax, interest, penalty or confiscation allegations. If the taxpayer says the witness was mistaken, misunderstood the transaction, omitted important context or was not in a position to know the facts, questioning the witness may be necessary to test the evidence.

Courts examine whether refusing a meaningful opportunity to test material adverse evidence denied a fair hearing. The Delhi High Court’s 29 July 2025 judgment linked this analysis to the opportunity of hearing under section 75(4) of the CGST Act when a third-party statement is used against the taxpayer.

The request is materially stronger where the statement is actually relied upon. A witness whose evidence is irrelevant to the proposed finding presents a weaker case for compulsory questioning. The taxpayer should show the connection between the statement and the precise demand or penalty being considered.
When is the request strongest?
An adverse statement is identified in the notice or proposed order
Point to the witness by name or designation and identify the statement by date, page, paragraph or passage. Explain where the show-cause notice, relied-upon documents or draft findings use it. A general demand to “cross-examine all witnesses” gives the adjudicator less information on which to assess materiality.
The statement supports a disputed finding
Explain the chain of reasoning: for example, the statement is being used to establish who supplied goods, whether invoices reflect real transactions, whether consideration was paid, or whether a person knew of an alleged contravention. Then identify the factual proposition you contest. The request should make clear that the issue could affect the tax demand or penalty, rather than merely expressing dissatisfaction with the investigation.

You challenge truth, context or credibility
State why written objections alone may not be enough. Relevant subjects can include the witness’s basis of knowledge, the circumstances in which the statement was recorded, whether questions were translated accurately, internal inconsistencies, later corrections, pressure or inducement, and whether the statement accurately describes the transaction. These are reasons to seek questioning, not assumptions that a witness acted improperly.
The request is made before the authority decides the case
Ask the adjudicating authority in time for it to consider the request before relying on the statement in the adjudication order. The Madhya Pradesh High Court described the opportunity as one to be afforded at an appropriate stage of the proceedings. Waiting until after the final order makes it easier for the department to argue that the request was late or that the taxpayer accepted the procedure.
The witness is available and the procedure is workable
Courts may consider practical issues such as whether the person can be produced and whether questioning can be limited to disputed matters. Offer a focused examination rather than an open-ended exercise, while preserving the objection if the authority refuses altogether.

These factors are a practical synthesis of the reported decisions, not a statutory checklist or guarantee. The relevant court may weigh the full record differently.
What the principal decisions say
| Decision | Date and setting | What it illustrates | Qualification |
|---|---|---|---|
| Andaman Timber Industries v. Commissioner of Central Excise, Kolkata-II | Supreme Court of India, judgment delivered 2 September 2015; central excise matter | When witness statements formed the basis of the order, denying cross-examination was treated as a serious natural-justice defect. The Court rejected speculation about what the taxpayer might prove through questioning. | It was decided under central excise law, not the CGST Act. GST courts use its reasoning in their own statutory and factual contexts. |
| Nishad K.U. v. The Joint Commissioner | Kerala High Court, 17 December 2024 | Statements recorded during a GST investigation were relied upon, and the adjudicator assumed cross-examination could not affect credibility. The court held that the authority could not presuppose what questioning might establish. | The result turned on the materiality of the statements and the hearing offered in that proceeding. |
| W.P. No. 12326 of 2024 | Madhya Pradesh High Court, final order 20 May 2024 | Fair hearing required an opportunity to cross-examine witnesses whose evidence was relied on in the show-cause notices before the case was decided. The judgment also discussed access to documents. | Document access and cross-examination are related fairness issues but are not the same remedy. |
| W.P.(C) 4853/2025 | Delhi High Court, judgment 29 July 2025 | Discussed section 75(4) of the CGST Act and the proposition that hearing may include cross-examination when an adverse third-party statement is used. | Apply the reasoning with attention to the exact evidence and procedural posture. |
| M/S JSW Steel Limited proceedings | Karnataka High Court source dated 13 August 2025 | Recorded the Revenue’s argument that the CGST Act does not create a general right and the taxpayer’s natural-justice response; it also referred to Nishad K.U. and an appeal. | The materials reviewed do not establish the final Division Bench disposition of W.A. No. 303 of 2025. Do not treat the account as a settled statement of Karnataka law. |
How to make a defensible written request
- Identify the evidence. List each witness, the date and description of the statement, and the passage relied on. Attach the statement if you have it, or request a copy if it has not been supplied.
- Connect it to the allegation. Quote or paraphrase the finding for which the department uses the statement and explain how that finding affects tax, interest, penalty or another proposed consequence.
- Specify the dispute. Set out the factual assertions you deny or qualify. Explain whether the dispute concerns the witness’s personal knowledge, the transaction’s context, an inconsistency, translation, recording conditions or another credibility issue.
- Explain the subjects for questioning. Give a focused list of topics. Practical examples include how the witness obtained the information, who was present when the statement was recorded, whether documents were shown, whether the witness later corrected anything, and whether the statement covers the period or transaction in issue.
- Ask for a decision before reliance. Request that the witness be made available for cross-examination before the adjudication order relies on the statement. Ask the authority to decide the request by a reasoned order if it proposes to refuse it.
- File through a traceable channel. Use the filing method available in the proceeding and retain the acknowledgment, email delivery record, portal receipt or other proof. Keep the request in the adjudication file and refer to it in every later written submission.
- Renew the request if the evidence changes. If a later notice, report or order introduces a new witness statement, make a fresh, specific request rather than assuming the earlier application covers it.
No single mandatory application form, universal deadline or filing channel is established by the decisions summarized here. Follow the instructions in the particular notice and applicable state or central GST procedure.
Documents to request separately
Cross-examination does not replace access to the material needed to answer the notice. Ask separately for relied-upon statements, annexures, reports, relied-upon electronic records and other documents necessary to understand the allegation. The Madhya Pradesh decision discussed document access and section 67(3)’s rule concerning return of documents that are not relied upon. That rule about returning non-relied-upon documents is distinct from the question whether a witness must be produced for questioning.

If the department says a statement is not being relied upon, ask the authority to record that position and confirm that the statement will not be used in the order. If the final order later relies on it, the change in position should be identified in the appeal or other challenge.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. What if the authority refuses or does not answer?
Assess whether the refusal affected the outcome
A refusal is more significant when the final order relies substantially on the disputed statement and gives no other adequate proof. It is less likely to be decisive where the statement is peripheral and independent records establish the same fact. Show exactly where the order uses the statement and why the missing questioning could have affected credibility or the factual finding.
Preserve the procedural record
Keep the application, proof of filing, reminders, the authority’s response or silence, the statement, the show-cause notice, written submissions and the final order. In any challenge, the sequence matters: when the statement was disclosed, when the request was made, whether the authority ruled on it, and whether the order relied on the evidence anyway.

Consider the available remedy
Andaman Timber, as quoted by the Kerala High Court, described denial of cross-examination in the circumstances before it as a serious natural-justice flaw. The reported GST decisions show that a court may set aside or remand an order where a meaningful opportunity was denied, but a result is not automatic in every matter. The ordinary statutory appeal, limitation period, alternate-remedy rules and the jurisdiction’s approach to writ petitions all matter. Obtain advice on the record before choosing a remedy or allowing an appeal deadline to expire.
“According to us, not allowing the assessee to cross-examine the witnesses by the Adjudicating Authority though the statements of those witnesses were made the basis of the impugned order is a serious flaw which makes the order nullity inasmuch as it amounted to violation of principles of natural justice because of which the assessee was adversely affected.”
The Kerala High Court also stated in Nishad K.U.: “The Adjudicating Authority cannot presuppose or presume what could be the subject matter of the cross-examination, or what benefit would be derived by the person proceeded against, through such cross- examination.” These are judicial statements, not a promise that every request will be granted.
Do these 3 things before closing this tab:

GST disputes are heard within different High Court jurisdictions, and a decision’s status matters. Compare the proceeding under the CGST Act or another tax statute; whether the statement was actually relied upon and how central it was; whether the taxpayer disputed it and asked in time; and whether the decision is a final, reasoned judgment or merely a party’s argument recorded at an interim stage.
The Karnataka material concerning M/S JSW Steel Limited is an example of why caution is required. It records competing submissions about whether the CGST Act itself confers a general cross-examination right and refers to an appeal from an earlier decision. The reviewed passages do not establish the final merits disposition of W.A. No. 303 of 2025. A taxpayer in Karnataka should verify the signed judgment and any later appellate order before relying on a definitive statement of the law.
A practical decision guide
| Question | If “yes” | If “no” |
|---|---|---|
| Does the notice or proposed order rely on a named witness statement? | Identify it and request questioning before adjudication. | Ask what evidence is actually relied upon; a demand for cross-examination may be premature. |
| Is the statement material to tax, penalty or another finding? | Explain the causal link and the prejudice from not testing it. | Explain why the apparently minor statement still affects a disputed issue, or focus on more material evidence. |
| Have you identified a concrete factual or credibility dispute? | List the proposed subjects and questions. | Clarify the dispute before filing; a vague request is easier to reject. |
| Was the request filed before the order? | Preserve proof and seek an express, reasoned ruling. | File immediately and explain any delay; do not assume a post-order request cures the problem. |
| Did the final order rely on the statement despite refusal? | Assess appeal or other challenge with the complete record. | There may be no cross-examination issue unless the evidence later becomes material. |
Bottom line for a GST taxpayer
Make a precise, early written request whenever an adverse witness statement is both disputed and material to the proposed GST outcome. Tie the request to the exact passage and finding, describe what questioning could test, ask for a decision before reliance, and preserve every filing and response. The natural-justice principle is powerful, but it is fact- and jurisdiction-sensitive; it should not be presented as an unconditional right or as an automatic basis for cancelling every order.
