The right setup depends on the asset and ledger, your role in the transaction, the rules in the relevant jurisdiction, and who controls the signing keys. Decide first whether your organization will manage custody itself or use an authorized provider; then define how keys, client assets, records, approvals, and operational risks will be controlled.
Start by separating the wallet from the custody arrangement
A wallet is part of the technical setup used to control or authorize activity involving digital assets. Custody is the broader operating and legal arrangement: who safeguards or controls assets, who can authorize transactions, how client positions are recorded, and what protections apply if a provider fails. A wallet address alone does not establish legal ownership, and recording a transfer on a ledger does not by itself establish legal settlement finality.
For an institution, the decision is not simply “which wallet?” It is who holds or controls the keys, who approves transfers, how asset and client records are maintained, and which laws govern the service. The sources do not prescribe one wallet architecture or endorse a particular provider.
Choose who will control the keys
Self-managed custody
If your organization manages custody, key governance becomes an internal operational responsibility. Document who may authorize transactions, what approvals are required, how keys are safeguarded, and how access and control can be recovered. Establish transaction controls and retain evidence of asset positions so the organization can reconcile what its records say with the relevant ledger.

EU Commission Delegated Regulation (EU) 2025/303 addresses approval and safeguarding of cryptographic keys, including multisignature wallets. That reference does not make multisignature mandatory for every system; the suitable controls depend on the design and applicable rules.
Outsourced custody
Outsourcing can be an option where permitted, but it does not remove the institution’s need to assess risk and oversee the arrangement. In a May 7, 2025 clarification, the U.S. Office of the Comptroller of the Currency (OCC) said national banks and federal savings associations may engage in permissible crypto-asset activities, including custody and execution, subject to appropriate third-party risk management. The OCC also says custody must be conducted safely and in compliance with applicable law.

Before relying on a provider, verify its authority in the relevant jurisdiction and the precise service it is permitted to perform. “Custody” may not describe every service a firm offers, and permission to provide one service should not be treated as permission to provide another.
Compare the arrangements on controls, not labels
Use these questions to assess a self-managed or outsourced model. A provider’s product name or wallet type does not answer them.

These are evaluation criteria, not a vendor scorecard or a prescribed network integration. The required answer for each depends on the asset, settlement design, role, and jurisdiction.
Apply segregation rules only within their scope
European Union: MiCA custody requirements
ESMA’s MiCA Article 75 materials discuss client position registers, custody agreements, and legal segregation of client crypto-assets from the provider’s estate. Those requirements are relevant to the applicable MiCA service and should not be generalized into a global rule for every token or custody model.

United Arab Emirates: payment-token custody
The Central Bank of the UAE’s C 2/2024, Article 23, effective August 31, 2024, applies to payment-token custody. It requires a dedicated wallet for customer payment tokens, separate from wallets holding other virtual assets, and records of segregation. This is a specific UAE requirement for payment tokens, not a rule for all tokenized assets everywhere.

Primary issuance under a specific MiCA interpretation
In its answer to Q&A 2417 dated June 18, 2026, ESMA said that an issuer’s primary delivery of crypto-assets to a purchaser is not automatically custody and administration or transfer service for another person under the described facts. That narrow interpretation does not settle the treatment of ongoing custody or other transaction structures.

Capital treatment of eligible tokenized securities in the United States
On March 5, 2026, the Federal Reserve Board, FDIC, and OCC clarified that eligible tokenized securities should generally receive the same treatment under the U.S. capital rule as their non-tokenized forms; the technology used to issue or transact in a security generally does not change that treatment. This statement is limited to capital treatment of eligible securities. It does not determine ownership, settlement finality, custody requirements, or treatment in other jurisdictions.
Separately, in an OCC release on March 7, 2025, Acting Comptroller Rodney E. Hood said: “The OCC expects banks to have the same strong risk management controls in place to support novel bank activities as they do for traditional ones.” The statement concerns bank risk management; it is not an endorsement of a particular wallet design.
What you need to decide before selecting an arrangement
A specific choice requires facts that the question alone cannot supply: the asset and its legal rights, the settlement asset, the ledger, your role, applicable jurisdiction, threat model, governance requirements, and integration needs. Establish those first. Then determine whether self-management or an appropriately authorized custody provider can meet the resulting key-control, recordkeeping, segregation, and risk-management requirements.
