TSMC’s U.S. investment did not eliminate the possibility of tariffs on Taiwanese chips. A reported 100% tariff in March 2025 was a proposal under discussion, not a tariff imposed on all Taiwanese chips. In January 2026, the White House issued a narrower Section 232 measure: a 25% duty on specified covered products, with exceptions, while directing negotiations and preserving the possibility of further tariffs. Taiwan’s later-described preferential treatment for semiconductors is qualified, including by quota limits. Whether a particular shipment is covered depends on its product classification, applicable exceptions and the agreement’s implementation.
What changed after TSMC announced its investment?
On March 4, 2025, Taiwan Semiconductor Manufacturing Company (TSMC) said it intended to add $100 billion to its ongoing $65 billion U.S. investment plan. That would bring its then-planned total to $165 billion, supporting three additional fabrication plants, two advanced packaging facilities and a research and development center in Phoenix, Arizona. The announcement was a company investment plan; it did not itself settle U.S. tariff policy.

That same day, WIRED reported that administration deliberations included tariffs as high as 100% on TSMC and other Taiwanese chipmakers. The report, citing an unnamed person familiar with the matter, said one version could also reach electronic devices containing Taiwanese chips. It described a possible proposal, not an adopted tariff or proof that the proposal remained active in that form later.
The formal action that followed was different in scope. In January 2026, the White House issued a proclamation under Section 232 concerning semiconductors, semiconductor manufacturing equipment and derivative products. It set a 25% duty for a defined group of covered products effective January 15, 2026, subject to stated exclusions and end-use exceptions. The proclamation also directed negotiations with trading partners and said the administration could consider significant tariffs depending on their status or outcome.

How the reported proposal differs from the 2026 duty
| Measure | Status and date | Rate and scope | What to take from it |
|---|---|---|---|
| Tariffs reported by WIRED | Reported deliberations, March 4, 2025; based on an unnamed source | Possible rates as high as 100% on Taiwanese chipmakers; one version could have included devices containing Taiwanese chips | Not an issued tariff. The report does not establish that this proposal was adopted or remained active in that form. |
| White House Section 232 proclamation | Issued January 2026; covered duty effective January 15, 2026 | 25% on specified covered products, not all chips or all goods containing chips; exceptions and end-use provisions apply | A formal measure with a defined product scope, alongside negotiations and the possibility of further significant tariffs. |
| U.S.–Taiwan trade framework | Taiwan Executive Yuan account dated January 20, 2026; USTR fact sheet dated February 2026 | Preferential reciprocal-rate treatment is described for originating goods; semiconductor and derivative treatment under Section 232 is qualified, including zero tariffs within quota limits in Taiwan’s account | Preferential treatment is not an unconditional exemption for every semiconductor shipment. Quota limits and implementation matter. |
The White House’s 25% figure applies to the proclamation’s defined covered products, not to every Taiwanese chip. The proclamation lists exclusions and end-use exceptions covering certain data-center, repair or replacement, research and development, startup, consumer, industrial and public-sector uses. The rate alone therefore cannot determine the duty on a particular import: product classification, origin, end use and the applicable exception all matter.
What preferential treatment does Taiwan receive?
Taiwan’s January 20, 2026 account of the trade arrangement describes a 15% reciprocal rate framework that is exempt from stacking, as well as zero tariffs within quota limits for semiconductors and derivatives under Section 232. USTR’s February 2026 fact sheet describes the 15% treatment for originating goods as the higher of the most-favored-nation rate or 15%, and says Taiwan receives preferential treatment in semiconductor-related Section 232 measures.

These descriptions do not mean every chip shipment from Taiwan is automatically duty-free. The semiconductor provision is quota-limited in Taiwan’s account, and actual treatment depends on the operative agreement, product classification and implementation. The available public descriptions do not establish the current quota quantity or resolve how every provision applies to an individual import.

A tariff is charged on covered imports, but who ultimately bears its cost can vary. Depending on the product and supply-chain contracts, costs could fall on importers, chipmakers, device makers or customers—or be absorbed in company margins. WIRED quoted Tufts University historian Chris Miller describing the possibility of margins being squeezed at multiple stages of the supply chain. That was an expert assessment of potential effects, not a measurement of realized price changes.

Semiconductors are used in many finished products, but the 2025 report’s broader scenario involving devices containing Taiwanese chips should not be confused with the narrower product coverage in the 2026 proclamation. The material cited here does not establish an economy-wide price effect, a specific consumer price increase or a current duty for any particular device. A household should not infer that a phone, computer or car will automatically cost more because it contains a Taiwanese chip.
How much has TSMC committed to U.S. expansion?
TSMC’s March 2025 announcement put its then-planned U.S. investment at $165 billion: the additional $100 billion plus its previously announced $65 billion. In July 2026, the Associated Press reported another planned $100 billion expansion, bringing announced U.S. investment commitments to $265 billion. These are announced investment plans, not tariff rates or evidence that investment commitments automatically exempt TSMC products from duties.

What should importers check before estimating a tariff?
A shipment-specific answer requires more than knowing that a product contains a chip made in Taiwan. Importers should verify the governing measure and customs guidance for the shipment’s classification and circumstances.

- Check the legal measure and effective date: Distinguish the January 2026 proclamation’s covered products from a reported proposal or a later negotiating position.
- Review exceptions and end use: Check the proclamation’s annexes and applicable exceptions for the precise product and intended use.
- Verify Taiwan-specific terms: Confirm whether preferential treatment applies, whether quota limits are relevant and how the agreement has been implemented.
The White House proclamation and current U.S. Customs and Border Protection guidance are the appropriate starting points for a real import decision.
