What to Know About Your Final Pay When You Give Two Weeks’ Notice

Giving two weeks' notice does not guarantee a final paycheck on your last day. Here is how federal law, state rules, PTO policy and severance terms decide what you're paid and when.

Giving two weeks’ notice does not by itself mean your final paycheck arrives on your last day. Federal law generally requires covered wages to be paid by the regular payday for the pay period you worked, and some states set earlier deadlines. Whether unused vacation, PTO, or severance gets paid depends on state law, your employer’s policy, or a written agreement, not on the length of your notice.

What federal law requires

The U.S. Department of Labor’s Last Paycheck guidance states: “Employers are not required by federal law to give former employees their final paycheck immediately.” The same page notes that some states may require immediate payment, so the federal rule is a floor, not the whole answer.

The federal baseline is the regular payday for the pay period in which you worked. If that payday passes and you have not been paid, the Department recommends contacting its Wage and Hour Division or your state labor department.

The Fair Labor Standards Act sets minimum wage and overtime protections. It does not, by itself, require immediate final wages, paid vacation, paid sick leave, holiday pay, or severance. The Department’s Handy Reference Guide to the Fair Labor Standards Act and its Questions and Answers About the Fair Labor Standards Act describe these limits. Any broader protection for a particular payout usually comes from state law, a policy, or an agreement.

Which rule controls which part of your pay

Final pay is not one bucket. Different parts of what you are owed can be governed by different sources, and each can have its own timing.

Final paycheck timing depends on your state

Because some states require payment sooner than the regular payday, the first question is always which state’s law applies to your work. The Department’s 2023 State Payday Requirements table, dated January 1, 2023, summarizes regular payday frequencies. It is not a current chart of final-pay deadlines or unused-leave payout rules, so use it only as a starting point and confirm the current rule with your state labor agency.

If the regular payday passes and you have not been paid, take these steps:

  1. Confirm the payday for the pay period in which you worked your last hours, using your pay statement or your employer’s pay calendar.
  2. Ask your employer in writing for the date and method of payment, and keep the reply.
  3. If payment has not arrived by the payday, contact the Department of Labor’s Wage and Hour Division or your state labor department. The Department’s Termination guidance covers the end-of-employment topic more broadly.

Unused vacation and PTO

Federal law does not require an employer to pay out unused vacation, PTO, or sick leave. Whether you get a payout depends on whether your state requires it, whether your employer policy promises it, or whether a written agreement covers it. Some employers pay out accrued leave and others forfeit it, so your handbook or offer letter is the document to check first.

If you are counting on a payout, note your leave balance on your last pay statement and save the policy that describes how accrued leave is handled at separation.

Severance

Federal guidance on the Severance Pay topic treats severance as a matter of agreement. Your employer does not have to offer it under the FLSA. If you are offered severance in exchange for signing a release, the terms of that agreement, not the notice period, determine what you receive and when.

If your employer asks you to stop working before your notice ends

Being released before the end of your notice does not, under the federal baseline, change the regular-payday rule for the wages you earned. Whether it changes any state deadline, or whether it affects a leave payout or severance, depends on state law and the terms of your employment or agreement. Ask for the separation date and the final-pay date in writing so both are on record.

Health coverage after you leave

Losing job-based health coverage can trigger a COBRA continuation option. According to the Employee Benefits Security Administration’s COBRA Continuation Coverage guidance, as of October 8, 2026, the following apply:

  • Election window: generally 60 days, measured from the later of the date your coverage ends or the date you receive the election notice.
  • Cost: you usually pay the full premium, unless your employer agrees to pay some or all of it.
  • Duration: up to 18 months in the usual case; some qualifying events allow longer coverage.

Eligibility and timing depend on the plan and your situation, so check the election notice carefully and compare it with any marketplace options before the window closes.

Unemployment benefits

Unemployment eligibility is set by state law. Federal guidance on Termination says people unemployed through no fault of their own, as determined under state law, may qualify if they meet other requirements. Giving notice does not by itself establish or rule out eligibility, so apply through your state unemployment agency and describe the separation accurately.

Records to keep before your last day

  • Your written resignation notice and any reply from your employer
  • Time records and your final scheduled workdays
  • Recent pay statements showing hours, overtime, and deductions
  • Your current leave balance, typically shown on a pay statement or in the HR portal
  • The employee handbook section or policy on accrued leave and final pay
  • Any severance, separation, or release agreement, before you sign it
  • Your COBRA election notice and the date it was received

The federal rules set the baseline, but the answer for your paycheck, leave balance, and severance is most likely in your state’s law and your employer’s written terms. Those are the documents to confirm before you assume a date or a dollar amount.
