Don’t throw away, give away, or take hemp THC products somewhere until you’ve checked the rules where you live and confirmed how they may be disposed of. As of October 4, 2026, the Associated Press reported that a federal change to the definition of hemp was scheduled to take effect on December 11, 2026, after a delay. That date could change again. Secure the products away from children and pets while you check current federal and state guidance and ask your local disposal site whether it accepts them.
What the federal change means—and when it is due to take effect
The 2018 Farm Bill defined hemp using a delta-9 THC concentration of no more than 0.3% on a dry-weight basis and removed qualifying hemp from the Controlled Substances Act. That did not make every hemp-derived food, supplement, drug, or product making therapeutic claims lawful: the Food and Drug Administration (FDA) retained authority over cannabis-derived products under the Federal Food, Drug, and Cosmetic Act.
A 2025 federal law amended the hemp definition. New York State’s Office of Cannabis Management summarized the change as setting a limit of 0.4 milligrams of total THC per container for covered consumer cannabinoid products, including THC compounds such as THCa. It also described exclusions for cannabinoids not naturally produced by the plant and cannabinoids chemically synthesized outside it. The law’s transition period was 365 days after enactment.
The date is a separate issue from what the law changes. On October 3, 2026, the Associated Press reported that a short-term funding law signed the prior month delayed the effective date from November 12 to December 11, 2026. New York’s 2025 guidance predates that reported delay. Check the latest enacted federal law and current agency guidance before acting; do not rely on the earlier November date or assume the reported December date cannot change.

The amended definition distinguishes industrial hemp uses from cannabinoid products intended for inhalation, ingestion, or application. Whether a particular product falls within the covered category depends on its identity and formulation, as well as the law in force. A “hemp” label alone does not establish that a product is lawful.
What to do while you check

- Identify the product. Keep its packaging and note what it is intended for—such as inhalation, ingestion, or application—and any listed cannabinoid ingredients. Do not assume two products labeled “hemp” have the same legal status.
- Check the rules for your location. Consult your state cannabis regulator and local authorities, and check for current federal guidance and any later change to the effective date. State rules can have their own timelines.
- Secure it while you wait. Follow the FDA’s advice to keep delta-8 products out of reach of children and pets. Use secure storage that prevents access; storage does not establish that possession is lawful or replace disposal instructions.
- Ask before taking it anywhere. Contact the specific collection site, state regulator, or local waste authority and describe the product. Follow only instructions that apply to that product and jurisdiction.
State law can change the answer
Federal rules are not the only rules to check. States may use their own definitions, licensing requirements, cannabis-market rules, and effective dates. New Jersey illustrates why location matters: its Cannabis Regulatory Commission says that, under New Jersey rules taking effect in April 2026, products exceeding 0.4 milligrams of total THC per container or the applicable plant dry-weight threshold are designated cannabis. The state also has specific transition rules for intoxicating hemp beverages, and unlicensed production or distribution can be unlawful. These are New Jersey provisions, not a nationwide rule; check the regulator for your own state.

Where to dispose of hemp THC products
There is no universal disposal method established by the federal materials described here for consumer hemp THC products that may become illegal. The Drug Enforcement Administration provides information about year-round collection sites for unneeded medications, but that does not establish that a site accepts unprescribed consumer hemp-derived THC. Ask the particular site before bringing a product or putting it in a collection box.
If the site does not accept it, ask your state cannabis regulator or local waste authority for product-specific instructions. Until you have an answer, keep the item secured. Do not flush it, mail it, carry it across state lines, mix it with household waste, give it away, or return it unless current instructions for your location and product expressly permit that action.

Why secure storage matters
The FDA says delta-8 products have not been evaluated or approved for safe use in any context, and warns that formulations and labels can vary. Its consumer guidance advises keeping them out of reach of children and pets. The agency reported 104 adverse-event reports involving delta-8 THC products from December 1, 2020, through February 28, 2022; 55% involved medical intervention or hospital admission. National poison centers received 2,362 delta-8 exposure cases from January 1, 2021, through February 28, 2022, and 41% involved children under 18. These are historical reports for those date ranges, not estimates of current incidence.
If someone has a serious immediate reaction, the FDA advises calling 911 or going to an emergency room.
