The right next step depends on where your case stopped. An H-1B registration that was not selected, a USCIS petition that is pending or denied, and a Department of State visa application refused at a consulate are different decisions made by different agencies. Find the exact registration notice, USCIS notice, or consular refusal sheet first. Then coordinate with the employer or petitioner and, when your status, work authorization, deadlines, or travel are at risk, obtain individualized advice from qualified immigration counsel.
Start by identifying the decision-maker and document
Use this quick classification before taking action. Do not treat a visa refusal as proof that the underlying petition was denied, or a registration nonselection as a USCIS petition denial.

Keep copies of every notice, the date it was issued, delivery records, your passport and visa application documents, the I-129 receipt and approval (if any), and your Form I-94 and current status records. Those details determine what you can do next.

If your H-1B registration was not selected
USCIS describes selection as authorization to file a cap-subject Form I-129 petition; it is not approval of a petition or issuance of a visa. A nonselection notice therefore is not a petition denial. Confirm the status in the employer’s or attorney’s official registration account rather than relying on an informal message.

Discuss realistic alternatives with the petitioner
- Ask whether the position or employer may qualify for a cap-exempt H-1B route.
- Review whether another existing immigration or employment status could apply to you.
- Discuss a future registration period if appropriate.
- Have the employer’s immigration team evaluate any other employment-based strategy.
The available route depends on your facts, the employer, the job, your education and experience, and your current status. The registration material does not establish a general appeal, guaranteed later selection, or right to submit a replacement registration after nonselection. Do not assume that filing another registration will solve the problem. USCIS warns that duplicate registrations for the same beneficiary by the same registrant may be invalid. Ask counsel before any new filing.
If USCIS has not decided the petition
A pending I-129 petition is a USCIS adjudication issue, even if you are waiting abroad for a visa interview. The employer or petitioner normally controls the petition account and received the receipt notice, so ask that party for the receipt number and a copy of every USCIS notice.
Check the case using the correct tools
- Enter the receipt number in USCIS case status. Check that the form, classification, petitioner, and service center match your notice.
- Use USCIS’s Processing Times FAQs and the current processing-times page for the exact form, category, and office. USCIS estimates reflect historical processing experience; they are not a promised decision date.
- If the case is outside the posted inquiry date, submit an inquiry through USCIS e-Request or the channel identified by USCIS. The tool will determine whether the case qualifies.
- Save the inquiry confirmation number, the date submitted, copies of the information supplied, and any response.
If the tool says an inquiry is not yet available, repeated submissions will not create a deadline. Continue monitoring the case and ask the petitioner or attorney to contact USCIS through the permitted channel. A premium-processing filing has its own receipt and contact instructions; follow those instructions rather than assuming that a regular-processing estimate applies.

Do not book irreversible travel, resign from another job, or set a start date solely from an estimated processing time. Whether you may work or remain in the United States while a petition is pending depends on your current status, I-94, work authorization, prior filings, and dates. Have the employer’s counsel review those records before you act.

If USCIS denied the H-1B petition
A USCIS denial concerns the petition filed by the employer or other petitioner. It does not itself decide whether a consular officer will issue a visa. Read the entire decision, including the factual and legal grounds, the date of the decision, and every instruction about review, motions, or a new filing.
Build a response plan from the actual notice
- Give the complete denial to the petitioner and immigration counsel immediately.
- List each ground separately and collect the evidence USCIS said was missing, inconsistent, or insufficient.
- Record any response, motion, appeal, or refiling deadline stated in the notice. There is no single review deadline that applies to every H-1B denial.
- Confirm how the denial affects your current status, I-94 expiration, employment authorization, payroll, and planned travel before making a decision.
USCIS review options are not universal. Depending on the decision, counsel may evaluate a motion, an appeal where available, a corrected or new petition, or a different immigration strategy. Do not automatically appeal, refile, or leave the country without examining the notice and your status timeline. USCIS advises people who are uncertain about forms or applications to consider help from an authorized service provider; for a consequential denial, use qualified case-specific counsel.
If the consulate issued a 221(g) refusal
The Department of State uses a 221(g) refusal when the applicant has not established eligibility to the officer’s satisfaction at that stage. The officer may request documents or information, or place the case in administrative processing. The refusal sheet should identify what is needed and how to provide it.

- Read every line of the refusal sheet and the consulate’s submission instructions.
- Prepare a complete, consistent response. Use the specified upload portal, courier, email address, or appointment process; do not substitute a different channel.
- Submit as soon as practical and keep proof of delivery, uploaded files, and correspondence.
- Track the case through the official Department of State or consular status channel identified in your instructions.
State’s Administrative Processing Information page says requested information should be provided within one year of the refusal. If it is not provided during that period, the applicant must reapply and pay another visa fee. The page also states: “The duration of the administrative processing will vary based on the individual circumstances of each case.”

When the case is in administrative processing
Administrative processing has no universal timeline. A case can remain in that stage for an individually determined period, and the Department of State’s appointment wait estimates do not include administrative processing. A CEAC status of “refused” can appear in a 221(g) case and, by itself, does not establish that the case has reached a final, unchangeable ineligibility. Follow the officer’s instructions and official status information.
Do not promise a decision date or assume that repeated inquiries will accelerate review. If you face a documented, unique hardship, you may explain it to the consular section using its published contact method. Keep your employer informed because the delay can affect the proposed start date, travel, housing, and payroll arrangements.
If the visa was refused for another reason
Read the refusal sheet for the Immigration and Nationality Act section. The consular officer, not USCIS, decides whether the visa applicant qualifies. An approved H-1B petition does not override a separate visa ineligibility.
Refusal under INA 214(b)
The Department of State’s Visa Denials guidance states, specifically for a 214(b) refusal, “There is no appeal process.” Reapplication is possible, but it requires a new application and a new fee. A stronger reapplication normally needs relevant additional information or a significant change in circumstances; simply repeating the same presentation does not create an appeal.

Other refusal grounds
Do not apply the 214(b) rule to every refusal. Other sections can have different procedures, possible waivers, or consequences that may be permanent. Ask counsel to explain the exact ground, whether a waiver is legally possible, what evidence is relevant, and whether reapplication would be premature. Keep the refusal sheet because the section number controls the analysis.

Check the Department of State’s Global Visa Wait Times page and the individual embassy or consulate’s instructions immediately before making plans. Estimates are updated and vary by post; they are not guarantees and exclude administrative processing. The table’s petition-based H/L/O/P/Q column concerns interview appointments, not H-1B petition decisions.
Guidance updated July 15, 2026 says nonimmigrant visa applicants should generally seek an appointment in their country of nationality or residence, or at a designated processing post. Applying elsewhere may mean longer waits and more difficulty demonstrating eligibility, and fees may not transfer. Check the specific post’s current rules before paying or moving an appointment.

Can you keep working or stay in the United States while waiting?
There is no safe one-line answer. The result depends on your current nonimmigrant classification, the expiration date on your I-94, any employment authorization, the timing and type of filings, whether the petition is for change of status or consular processing, and what USCIS or the consulate has actually decided.

Before you or your employer changes work, travel, or residence plans, assemble:
- Your passport biographical page and visa pages.
- Your latest Form I-94 and approval notices.
- All pending and prior USCIS receipt and decision notices.
- Your employment start date, payroll records, and proposed H-1B filing dates.
- Any consular refusal sheet, document request, or administrative-processing notice.
Give that packet to the employer’s immigration team or qualified counsel. Do not infer work authorization from a registration selection, a pending petition, a CEAC status, or an appointment estimate.
Protect your finances while the case is unresolved
Immigration delays can create nonrefundable costs even when no agency has issued a final denial. Ask the employer in writing which filing fees, courier costs, relocation expenses, and travel changes it will cover and which costs remain yours. Keep receipts and cancellation terms. Do not pay a second visa fee merely because an appointment estimate moved; a new fee is required in situations such as a 214(b) reapplication or failure to provide 221(g) information within the one-year period, while other cases depend on the instructions you received.
Set a personal decision calendar with the notice date, I-94 expiration, employment start date, document-submission deadline, inquiry-eligibility date, and any appointment cancellation deadline. Recheck official pages before each deadline because processing estimates and post instructions change.
