What to Do If You Miss a Deadline in an Indian GST Assessment Notice

A missed GST deadline may concern a notice reply or an appeal from a final order. Learn how to identify the document, calculate the appeal window and preserve proof.

If you missed a deadline in an Indian GST assessment notice, first identify whether the document is a notice asking for a reply or a final order that you want to appeal. They have different procedures and clocks. For an appeal against an order under section 107 of the Central Goods and Services Tax Act (CGST Act), the ordinary limit is three months from communication of the order; the Appellate Authority may allow up to one additional month for sufficient cause. That extension is limited, so act promptly and preserve evidence of when and how the document was communicated.

This article assumes India’s GST system. Check the notice’s issuing authority, cited section, date, requested action and deadline, and confirm which State or Union Territory enactment applies to your case. A reply deadline printed on a notice is not automatically the statutory appeal period for a later order.

Start by identifying what you missed

“GST assessment notice” can refer to more than one document. The consequences depend on whether the department is inviting a response, has already made an assessment or demand order, or has issued another decision. Do not calculate an appeal deadline from the date on a preliminary notice unless an appealable order has actually been communicated.

Document or stage What the deadline concerns What to do first
Show-cause or other notice seeking a response A response or other action requested by the issuing authority by the date stated in that communication. Read the notice’s cited section and instructions. Contact the issuing authority or a GST professional promptly about the available response procedure; do not treat the section 107 appeal period as an automatic extension.
Final assessment, demand or adjudicating order Potentially an appeal to the Appellate Authority under section 107. Record the order’s communication date and calculate the ordinary appeal period from that date.
Best-judgment order under section 62 for failure to furnish a return A distinct statutory situation that may involve a return-based deemed-withdrawal mechanism subject to statutory timing and payment conditions. Check the current text of section 62 and the facts of the case before relying on this route. It is not simply another name for a late appeal.

Use the document itself to establish which stage you are in: identify its title, issuing officer or authority, section cited, operative decision, and any appeal instructions. If there are several communications, keep them together in date order. A demand order can be appealable, but not every communication that mentions an assessment is itself the order to appeal.

How much time is allowed to appeal an order?

For an appeal under section 107 of the CGST Act, the ordinary period is three months from communication of the decision or order. The GST Portal FAQ describes this period for an aggrieved taxpayer or unregistered person appealing an adjudicating authority’s decision or order. It identifies assessment orders under sections 62, 63 and 64, among other demand orders, as orders for which an appeal may be filed.

Section 107(4) allows the Appellate Authority to admit an appeal for a further period of up to one month if satisfied that sufficient cause prevented the appellant from filing during the ordinary period. This is a limited discretion, not a guaranteed grace period. The GST Council’s official material explains that the Appellate Authority cannot condone delay beyond that additional month under this provision. Do not assume that a late filing will be accepted simply because you explain the delay.

The relevant start point is communication of the order, not necessarily the date printed at the top of it. Service can take place in more than one way under section 169, including registered or speed post, email to the registered address, or making the communication available on the common portal. The facts and applicable service record matter when working out the communication date.

What to do now: a practical sequence

  1. Collect every version of the communication. Download the complete notice or order and any annexures. Save the portal entry or notice history, registered email, postal envelope and tracking details, and any records of direct service. Note the document’s section, issuing authority, order date and requested action.
  2. Build a dated chronology. Record when and how each communication was sent, delivered, opened or accessed, when you learned of the deadline, and what prevented action. Keep the chronology factual and supported by documents where possible. This helps separate a disagreement about the service date from an explanation for delay after communication.
  3. Determine whether an appealable order exists. If the missed date belongs to a show-cause notice, identify the response process stated in that notice and seek advice on the appropriate next step. If there is a final adjudicating order, assess the section 107 appeal period using its communication date.
  4. Calculate both relevant appeal dates. Work out the three-month ordinary period from communication. If it has passed, determine urgently whether the further period of up to one month may still be available. Do not rely on a rough estimate where the date is close or disputed; have the calculation checked against the complete record and applicable rules.
  5. Prepare the appeal and explanation together. The GST Portal identifies FORM GST APL-01 for an appeal to the Appellate Authority. If filing late within the possible additional month, set out why sufficient cause prevented timely filing and attach evidence that supports the explanation. There is no universal list of reasons that guarantees condonation: the authority assesses whether the statutory test is met.
  6. Use the applicable filing route and retain proof. Follow the current portal instructions for the relevant order and jurisdiction. Save the submitted application, attachments, acknowledgement and any later request for documents. If the portal or local instructions require a separate document submission, note its deadline and keep proof of delivery.
  7. Get case-specific help quickly if time is short or expired. Ask a GST practitioner or tax-litigation professional to review the order, service evidence, deadline calculation and proposed explanation, particularly where the additional month may have expired or the document type is uncertain.

Filing through the GST Portal

The GST Portal FAQ describes this route for starting a demand-order appeal. Portal menus can change, so check the current interface and instructions for your jurisdiction rather than relying on an old screenshot or a remembered label.

  1. Sign in to the GST Portal and open Services > User Services > My Applications.
  2. For Application Type, choose Appeal to Appellate Authority, then select New Application.
  3. Choose Demand Order as the order type and follow the on-screen process for the order being challenged.
  4. Complete the application, including the relevant order details and supporting material, using the portal’s current prompts. The appeal form identified in the CBIC appeal rules is FORM GST APL-01.
  5. Submit the application and save its acknowledgement and a copy of everything filed. Follow any directions shown for supporting documents, additional submissions or acknowledgement status.

CBIC’s appeal rules describe provisional and final acknowledgements and a document-submission process. Under the rule’s specified paper-document process, if documents are submitted after seven days, the filing date changes to the date those documents are submitted. That detail should not be generalized to every online filing or every jurisdiction: check the currently applicable filing method and instructions before relying on it.

What evidence can support a request to accept a late appeal?

The statutory test is whether sufficient cause prevented filing within the ordinary period. A clear, verifiable account is more useful than a bare statement that the deadline was missed. Gather the material relevant to your circumstances, without assuming that any one item or explanation compels the authority to condone delay.

  • The complete notice and order: Include the communication that led to the dispute, the final decision being appealed, and any attachments or cited calculations.
  • Service and access records: Preserve portal download or notice-history records, registered email information, postal envelope and tracking, and any record of direct service. Section 169 recognizes multiple modes of communication, so do not look only for a paper letter.
  • A dated account of the impediment: Explain when the event began and ended, how it prevented filing, and what steps were taken once filing became possible. Match the account to the dates in the service record and the chronology.
  • Documents that substantiate the explanation: Include relevant records that support the claimed impediment or the date you received or accessed the communication. Submit what the current application process requires and retain a complete copy.
  • Proof of filing and follow-up: Keep the application, attachments, acknowledgement and records of any later document submission or communication from the authority.

Do not state that a particular excuse is automatically sufficient: the cited statutory materials establish the test but do not provide a universal catalogue of accepted reasons. A practitioner can help assess how the facts and supporting records should be presented.

If the additional month has already passed

Section 107(4) provides a further period of up to one month, subject to sufficient cause. The official GST Council material states that this Appellate Authority cannot extend the period beyond that statutory limit. The available official material does not establish one generally available alternative remedy for every case once that period has passed.

Do not assume that a writ petition, rectification request or another procedure will revive an appeal. Whether any other step is available depends on the order, the procedural history and the governing law. Obtain prompt, case-specific legal advice, and bring the full order, service evidence and chronology to the review.

Special case: a section 62 best-judgment order

A section 62 order for failure to furnish a return is not interchangeable with an ordinary late appeal. Section 62 contains a return-based deemed-withdrawal mechanism subject to specified timing and payment conditions. Those conditions must be checked against the current statutory text and the taxpayer’s facts before relying on the mechanism; do not assume that filing a return by itself withdraws every such order.

If the order cites section 62, confirm that the provision applies to the situation and obtain advice on whether its distinct mechanism or an appeal is relevant. The applicable route depends on the exact order and compliance history.

Questions to take to a GST professional

A short, organized consultation is easier if you can answer these questions and provide the underlying documents:

  • Is this a show-cause notice, a final adjudicating order, a demand order, or a section 62 best-judgment order?
  • Which provision does the document cite, who issued it, and what action does it require?
  • When was the order communicated, and what evidence establishes the communication mode and date?
  • Has the three-month appeal period expired, and does the possible further month remain?
  • What prevented filing on time, and which records support that explanation?
  • Which current portal steps, filing requirements and jurisdiction-specific instructions apply?
