For many qualifying benefits deposited directly, the bank must automatically protect up to two months’ worth. The rules differ for paper-check deposits and for debts such as taxes, federal agency debts, child support, or alimony.
First determine where the money was taken
“A debt collector took my Social Security check” can describe two different events, and the distinction matters:
As an Amazon Associate I earn from qualifying purchases.
- Money was withheld before payment. A government agency may have authority to withhold some benefits for certain debts or court orders. These cases do not follow the same rules as an ordinary private creditor trying to collect from a bank account.
- Money was frozen or taken after it reached your bank account. For an ordinary private debt, the creditor generally must sue, win a judgment, and obtain a court order directing the bank or credit union to turn over money. A freeze while the bank or court processes the matter is not necessarily the final decision about whether funds can be taken.
The Consumer Financial Protection Bureau (CFPB) explains the private-debt process and bank protections in its guidance on whether a debt collector can take federal benefits such as Social Security or VA payments. A rule for an ordinary private debt does not, by itself, resolve a tax levy, federal agency collection, support order, or separate state-law protection.

Also identify who is collecting and what kind of debt is involved. The same bank-account freeze can raise different rules depending on those details.

What to do if your bank account is frozen or garnished
- Read the bank’s garnishment notice. Look for the court name, case number, creditor, amount, response deadline, and instructions for claiming an exemption or asking for funds to be released. Procedures and deadlines vary by jurisdiction, so use the notice rather than assuming a general deadline applies. If you do not understand the instructions, contact the court clerk or seek legal help promptly instead of waiting for the freeze to resolve itself.
- Notify the court, bank, and collector in writing. State that the money came from Social Security, Supplemental Security Income (SSI), VA benefits, or another protected source, as applicable. The CFPB says the judge needs to know the source of the income before deciding whether money may be turned over. Keep copies and proof of delivery where available. Be specific about which account and deposits you believe are benefits, and ask what process is used to review or release the funds.
- Gather records that trace the funds. Useful records can include benefit statements and account transaction history showing deposits. These help establish the source; no single document is required in every jurisdiction. If payments came by paper check, keep any check or deposit record you still have. If the account also contains other money, records may help distinguish the benefit deposits from other funds.
- Use the exemption procedure in the notice. Submit the required forms or other response to the court and follow its instructions for requesting release of protected funds. A judge may consider the source of the money and applicable federal or state exemptions. Do not assume that telling the bank by phone is a substitute for filing the court response the notice describes.
- Ask about legal help promptly. A local legal-services organization, an attorney-referral service, or—if you are an older adult—the Eldercare Locator may help you find relevant assistance. Availability and eligibility vary, so do not assume representation will be free or available in every case. Local legal help can also explain the procedure and deadlines that apply in your state.
- Question any bank fee. Ask the bank to explain a fee associated with the garnishment. CFPB guidance says a fee may be charged in some circumstances when an account contains more than two months’ benefits and other money, but a fee cannot be charged if the balance is below two months’ worth of benefits when the garnishment order arrives.
How the automatic bank protection works
When a bank receives a garnishment order, it generally reviews the account’s activity during the preceding two months for qualifying federal benefits deposited directly. The bank must leave up to two months’ worth of those benefits accessible to the account holder. This protection is based on qualifying deposits and the account’s history; it is not a blanket guarantee that every dollar in the account is exempt.
The two-month figure is a look-back protection tied to qualifying direct deposits, not a promise that all money received over any longer period will remain untouched. If the account contains funds beyond the protected amount, the extra balance may be frozen or turned over, subject to other applicable federal or state exemptions. A person may need to raise any additional exemption through the process described in the notice.
CFPB example: direct deposits and a larger balance
The CFPB’s illustrative example assumes monthly Social Security direct deposits of $1,000. The bank identifies $2,000 in benefits from the prior two months and must leave that amount accessible. If the account balance is $3,000, the remaining $1,000 may be frozen or turned over, subject to any other applicable protections. This is an example, not a universal allowance for every account or situation.

The example helps show why the current balance alone may not answer what is protected. The bank looks at qualifying benefit deposits in the preceding two months; other deposits, timing, and applicable exemptions can affect what happens to amounts above that protected total.
Why money beyond two months may be at risk
The automatic review protects up to the qualifying two-month amount; it does not automatically protect every additional dollar in the account. Other federal or state exemptions may apply, so the amount above that threshold is not necessarily collectible in every case. Assert any other exemption through the applicable procedure.
Direct deposit and paper checks are treated differently
For qualifying benefits received by direct deposit, the bank performs the automatic two-month review described above. If Social Security arrives by paper check and is later deposited, the bank does not have to conduct the same automatic review. The full account balance could be frozen initially, and you may need to use the court’s procedure to show that the funds came from protected benefits.

If your Social Security money was taken from your bank account after a paper-check deposit, do not assume the freeze means the money has lost its protected status. The practical issue is that the bank may not automatically identify the source. Preserve the check or deposit record if available, benefit statements, and account history that connects the payment to the money in the account. Follow the notice’s process to present that information; do not assume that the bank will identify the funds automatically.
Different debts and benefits can change the answer
Social Security is not categorically immune from collection. The applicable rule depends on who is collecting, what the debt is, where the money was taken, and which benefit you receive. SSA says that Section 459 permits withholding of current and continuing payments for child support, alimony, or restitution. Other authorities address federal tax and federal non-tax debts. These are distinct from an ordinary private creditor’s effort to garnish a bank account.
| Collection situation | What the official guidance says | What to check |
|---|---|---|
| Ordinary private debt; money in a bank account | A private creditor generally must sue, win a judgment, and obtain a court order directing the bank or credit union to turn over money. The bank’s automatic review can protect up to two months of qualifying directly deposited federal benefits. | Check the court notice, deposit method, account activity, and exemption procedure. |
| Overdue federal taxes | The Social Security Administration (SSA) says the IRS may levy up to 15% of each Social Security payment for overdue federal tax debt. | Identify whether the action is an IRS levy on benefits or a separate bank-account garnishment. |
| Federal non-tax debt | SSA says the Treasury Department may withhold benefits for delinquent non-tax debts owed to federal agencies. Agencies may sometimes collect without the court process a private creditor generally needs. | Confirm the agency and debt type; do not assume the private-creditor process applies. |
| Child support, alimony, or restitution | SSA says Section 459 allows withholding of current and continuing payments for child support, alimony, or restitution. The CFPB also identifies Social Security and SSDI as benefits that may sometimes be garnished for government debts or child or spousal support. | Check the order, the benefit type, and whether the action is direct withholding or a bank-account garnishment. |
| SSI | The CFPB says some benefits, including SSI, remain protected even for government debt or support obligations. Rules depend on the particular benefit and collection authority. | Identify the benefit precisely and raise its source with the agency, bank, or court handling the action. |
These are broad federal distinctions, not a substitute for checking the specific notice and applicable state law. State law may provide additional protections or different procedures. Do not assume that a rule for Social Security retirement benefits automatically answers a question about SSDI, SSI, or another federal benefit. Likewise, an authority to withhold a benefit payment does not necessarily describe how a bank must handle a balance after deposit.

The SSA’s FAQ on whether Social Security benefits can be garnished or levied, dated April 16, 2025, states: “Social Security is required to withhold money from benefits when the court sends us a garnishment court order.” The same FAQ discusses support and restitution orders, federal tax levies, and federal non-tax debts as distinct authorities.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Questions to answer before you respond
- Who initiated the collection? A private creditor, the IRS, Treasury or another federal agency, and a support-related authority may have different powers.
- Where was the money taken? Direct withholding from a benefit payment is different from a freeze or garnishment after deposit.
- How did the benefit arrive? Direct deposit triggers the automatic bank review; a paper-check deposit may require you to prove the source.
- Which benefit is involved? Social Security retirement, SSDI, SSI, and other federal benefits do not necessarily have identical protections.
- Can you trace the balance? The bank’s review concerns qualifying deposits during the preceding two months. Records may help show where other money came from and support a claim under another exemption.
What not to assume
- A bank freeze does not automatically mean the court has decided the money is collectible.
- The two-month direct-deposit protection does not mean every dollar in the account is protected.
- A paper-check deposit may not receive the same automatic review as direct-deposited benefits.
- The rules for an ordinary private creditor do not settle the rules for federal taxes, federal agency debts, support, restitution, or state-law exemptions.
- Federal guidance is general U.S. guidance. The forms, deadlines, and local assistance options depend on where you live.
Frequently Asked Questions
Can a debt collector take my Social Security check?
For an ordinary private debt, a creditor generally must sue, win a judgment, and obtain a court order before directing a bank to turn over account money. Different authorities can apply to federal taxes, federal agency debts, child support, alimony, or restitution. First determine whether money was withheld from the benefit before payment or frozen after it reached your bank account.
Can a bank freeze Social Security benefits?
A bank receiving a garnishment order generally reviews the prior two months of account activity for qualifying federal benefits deposited directly and must leave up to two months’ worth accessible. A freeze is not necessarily the final decision. Paper-check deposits may not receive the same automatic review, so the recipient may need to use the court’s exemption process to show the funds’ source.

My Social Security money was taken from my bank account—what do I do?
Read the garnishment notice for the court, case number, deadlines, and exemption instructions. Promptly tell the court, bank, and collector in writing that the money came from Social Security or another protected benefit, gather benefit statements and account records, and follow the notice’s procedure to ask for release. Seek local legal help if you need assistance understanding the process.
Does the two-month protection cover all the money in my account?
No. The automatic protection applies to up to two months’ worth of qualifying federal benefits deposited directly. Money beyond that amount may be frozen or turned over, although other federal or state exemptions may apply. The CFPB example uses $1,000 monthly deposits: $2,000 from two months must remain accessible, while some or all of a remaining $1,000 in a $3,000 balance may be at risk.
Can Social Security be taken for taxes or child support?
Different collection authorities apply. SSA says the IRS may levy up to 15% of each Social Security payment for overdue federal taxes, and that Section 459 permits withholding for child support, alimony, or restitution. Treasury may withhold benefits for delinquent non-tax debts owed to federal agencies. Benefit type matters too; CFPB says some benefits, including SSI, remain protected even for some government debt or support obligations.
The Bottom Line
If a collector or bank has frozen Social Security money, do not assume the freeze is final—or that every kind of debt follows the same rule. Read the notice, promptly document the benefit source for the court, bank, and collector, and follow the exemption procedure. Direct deposit, paper checks, benefit type, debt type, and state law can all affect the outcome.
