What to Ask Local Officials Before a Data Center Is Approved

Before a data center approval, ask who has authority, what evidence supports the proposal, who pays for infrastructure, and how impacts and promised benefits will be monitored.

Before a data center is approved, ask officials to identify the decision in front of them, who has authority over it, and what project-specific evidence will be available before a vote. Then press for clear answers about electricity and water needs, neighborhood impacts, public costs and benefits, and the commitments that can be enforced. The right approvals vary by state, locality, utility arrangements, and project.

Start with the decision and who controls it

Which approval is actually pending?

Ask officials to name the specific action and the body expected to take it. It could involve rezoning, a special exception, site-plan review, a building permit, a utility or substation review, an incentive decision, or more than one of these. Ask what remains undecided and what approvals are still required before construction or operation.

Which issues are local, and which are not?

Ask which questions the local body can decide and which belong to state agencies, utilities, or another authority. The State of Michigan’s data-center guidance, for example, distinguishes state regulation of matters such as electric service, water withdrawals, air emissions, and wastewater from local land-use and community-impact authority. That division is an example, not a rule for every state. Pennsylvania DCED’s Pennsylvania Data Center Planning Toolkit likewise frames review around the roles and legal authority local governments actually have.

Request the application record, the review schedule, the applicable local standards, and the name or office responsible for each part of the review. A hearing on one approval should not be mistaken for a decision on every permit or utility matter.

Get a precise description of the proposal

What is planned, and what is still tentative?

Ask for the proposed site, building scale, construction and operating timeline, anticipated power and water infrastructure, and intended end user or tenant if known. Ask officials to separate binding commitments from conceptual plans and estimates. If project details are confidential, ask what is being withheld, the legal basis and duration for withholding it, and what meaningful information residents can see before land-use, utility, or incentive decisions are final. The University of Iowa Hubbell Environmental Law Initiative’s Iowa Data Center Decision Tool specifically raises narrowly tailored confidentiality and timely public information as decision issues.

What changes could trigger another review?

Ask whether a material change in site layout, scale, utility demand, cooling system, backup power, or operating plan would require additional review or public notice. Ask where such changes and the final approved plans will be recorded.

Ask who pays for electricity demand and infrastructure

How much power is expected?

Request the project’s expected and peak electricity demand, when that demand would begin, and the proposed source of power. Ask whether the figures are estimates or commitments, who prepared them, and whether they reflect the full campus or only an initial phase. Also ask what transmission lines, substations, or other upgrades may be needed, who will build them, and how reliability will be maintained.

Could residents bear any costs?

Ask how utility and infrastructure costs will be allocated, whether any upgrades could affect customer rates, and what protections prevent project-related costs from being shifted to other customers or taxpayers. Useful direct questions include: “Will this raise local water or electricity rates?” and “Do residents pay the cost of increased energy demand by data centers?”

Fairfax County’s data-center FAQ says residents do not directly pay for the electricity data centers use, but may bear a portion of infrastructure-improvement costs needed to support increased demand. That is the county’s explanation of its context, not a universal answer: costs depend on local utility arrangements, regulation, and the project’s infrastructure.

Ask where the water comes from and what happens to it

Request estimates for water withdrawal and consumption by source and season, along with the proposed cooling system. Ask whether estimates account for peak conditions and future phases, and what happens during drought or other supply constraints. Request the relevant permits, utility-capacity analyses, and plans for wastewater and stormwater management.

Ask who will monitor actual use after opening, how often results will be reported, and what response is required if use exceeds the approved projection or local capacity. Michigan’s guidance identifies water use and environmental impact as recurring community questions; Pennsylvania DCED’s toolkit calls for consideration of infrastructure capacity, including water. Neither establishes a single water-use limit for all projects.

Check the site against plans and neighborhood standards

Does the proposed use fit local plans and zoning?

Ask which land-use approvals are needed and whether the site is consistent with adopted plans and zoning. Ask how nearby homes and other uses were considered, and what standards apply to setbacks, screening, lighting, building design, and landscaping.

What will neighbors experience during operation?

Request a qualified noise study that describes the equipment and evaluates nighttime conditions, low-frequency sound where relevant, backup generators, and cumulative noise from other sources. Ask what limits will be enforceable, how compliance will be measured, who will conduct monitoring, how complaints will be handled, and what corrective action follows a violation.

Fairfax County describes noise studies, visual screening, design requirements, minimum distances, and hearings as parts of review in its jurisdiction, with requirements depending on project size and location. The Iowa decision tool raises measurable dBA and low-frequency dBC standards and post-construction testing or reporting. These are review considerations and local examples; the cited guidance does not establish a nationwide noise limit.

Ask how construction, emergencies, and operations will be managed

  • Construction: What hours, traffic routes, worksite controls, and dust or stormwater measures will apply? How will disruptions be reported and addressed?
  • Emergency readiness: What access, fire-protection, hazardous-material, and emergency-response plans are required? Which local responders have reviewed them?
  • Backup systems: What backup energy systems are proposed, and what operating, testing, or emissions requirements apply to them?
  • Ongoing contact and reporting: Who is the named operational contact for residents and responders? What routine reports or post-construction tests will be made public?

The Iowa decision tool identifies emergency access, hazardous materials, stormwater, construction hours, and post-construction testing or reporting as possible standards. The applicable requirements must be confirmed against local rules and the actual application.

Calculate public value after incentives and costs

Ask officials to show the project’s expected public costs and benefits separately, rather than relying on a headline investment figure. Request estimates for temporary construction jobs and permanent jobs, local hiring, wages, tax payments, tax abatements or other incentives, added public-service demand, infrastructure costs, and long-term obligations. Ask who prepared each estimate, what assumptions it uses, and how often the estimates will be checked against actual results.

Ask whether public costs are one-time or recurring, which entity pays them, and whether the locality could face obligations if the project changes, expands, or closes. Pennsylvania DCED’s toolkit includes fiscal and economic impacts in local review, while Michigan’s guidance identifies jobs and taxes among common community questions. A project’s investment total by itself does not establish its net benefit to residents.

Turn promised benefits into enforceable commitments

For each promised benefit—such as local hiring, infrastructure, or community investment—ask:

  • Who is legally responsible for delivering it, and what agreement or approval contains the obligation?
  • What exactly is due, and by what date or milestone?
  • How will progress be reported, and who independently verifies it?
  • What remedy applies if the commitment is missed or the project changes?

Pennsylvania DCED’s GRID Requirements page describes binding developer commitments in that state permitting context. It should not be read as giving every municipality the same authority; officials should identify the legal mechanism available for the specific local decision.

Make public review meaningful before the decision

Ask when technical reports and proposed agreements will be available, how residents can comment, whether hearings are required, and how officials will answer material comments. Ask how later revisions to the plans or demand estimates will be disclosed. The Iowa decision tool emphasizes meaningful public information before final decisions; Fairfax County’s guidance describes hearings within its own processes. Requirements differ by jurisdiction, so ask officials to identify the rules that apply to this application.

Compare proposals using the same evidence

If officials are considering more than one site or proposal, request the same categories of information for each. A common comparison prevents a well-documented proposal from being judged against a less complete one on headline claims alone.

These comparison areas synthesize the Pennsylvania toolkit and Iowa decision framework. Do not treat missing information as proof that a proposal has no impact; ask officials to mark what is unknown and whether a decision can wait until the evidence is available.

Keep a record of answers and unresolved questions

For a useful public record, submit questions in writing, refer to the specific application or agenda item, and ask officials to identify the document or rule supporting each answer. Record which answers are estimates, which are enforceable conditions, and which remain unresolved. If considering a sound-level meter for preliminary observation, treat consumer readings only as notes about when or where sound is noticeable—not as regulatory measurements or a substitute for qualified studies and standards.
