What Super PACs Can and Cannot Do in U.S. Elections

Under federal rules, a Super PAC may raise unlimited contributions from many otherwise permitted sources and spend without an amount limit on qualifying independent expenditures. It cannot use that money to contribute directly to federal candidates or committees, and its spending must remain independent of candidates, campaigns, and party committees. The independence requirement—not the size of its fundraising—is the defining limit.

What a Super PAC is

The Federal Election Commission (FEC) describes a Super PAC as a political committee that makes only independent expenditures. It is not simply a candidate campaign with a larger budget: it is a separate committee whose federal election activity must be independent of candidates and party committees.

As an Amazon Associate I earn from qualifying purchases.

That distinction explains both sides of the rules. The committee may raise money without the usual contribution limits for the independent activity it supports, but it cannot turn that money into a candidate contribution or coordinate its spending with a campaign. The fundraising freedom and the independence requirement go together.

In other words, “unlimited” describes the amount a Super PAC may raise for its permitted independent activity; it does not describe a general-purpose pot of money that can be transferred or used at will. The committee’s identity as an independent-expenditure-only committee remains important even when it raises or spends large sums.

What a Super PAC can do

Accept unlimited contributions from permitted sources

A Super PAC may solicit and accept unlimited contributions from individuals, corporations, labor organizations, and other political committees for independent political activity, according to the FEC. “Unlimited” describes the amount that may be given by those permitted sources to support the committee’s independent activity; it does not mean every person or organization may contribute, or that the committee can use the money for any political purpose.

The permission is specific to Super PACs and, as discussed below, the non-contribution accounts of Hybrid PACs. It should not be generalized to every political committee or to every account a committee maintains. Nor does it remove source prohibitions: a contribution can be barred even if it is intended for independent activity and even if there is no amount ceiling for a permitted donor.

Spend without an amount limit on qualifying independent expenditures

An independent expenditure is spending for a communication that expressly advocates the election or defeat of a clearly identified candidate and is not made in consultation or cooperation with, or at the request or suggestion of, that candidate, the candidate’s authorized committee or agent, or a political party committee. Under federal rules, qualifying independent expenditures are not subject to an amount limit, although reporting requirements may apply.

For example, a Super PAC may pay for a communication advocating the election of a clearly identified candidate if it makes the communication independently. Whether a particular communication qualifies depends on the legal definition and the facts surrounding its creation and distribution; the label a committee puts on an expense does not by itself make it independent.

The two requirements work together: a communication must fit the definition of an independent expenditure, and it must satisfy the applicable independence rules. Spending that does not qualify cannot be made permissible simply because the committee has raised unlimited funds. The FEC’s definition focuses on express advocacy concerning a clearly identified candidate, so not every political message should automatically be described as an independent expenditure.

What a Super PAC cannot do

Give its funds directly to a federal candidate or committee

A Super PAC’s authority to raise unlimited contributions is not permission to pass unlimited money to a candidate. The FEC’s registration guidance describes a Super PAC as a committee that will not use its funds to make direct, in-kind, or coordinated-communication contributions to federal candidates or committees. Its role is to finance independent activity, not to serve as a contribution account for a candidate.

An in-kind contribution is a contribution in the form of goods, services, or spending that benefits a candidate rather than a cash transfer. If a communication that appears to be an independent expenditure is coordinated under the applicable rules, it can be treated as an in-kind contribution. The committee therefore cannot avoid the contribution restriction simply by paying a vendor instead of sending a candidate money.

This is a key answer to the question “Can Super PACs give money directly to candidates?” Under the federal Super PAC model described by the FEC, no: the committee does not use its funds to make direct candidate contributions. Its unlimited fundraising authority is for independent political activity, not a way to make unlimited candidate donations.

Coordinate its spending with a candidate, campaign, or party committee

Independence is not just a question of who paid for an advertisement. The FEC evaluates coordination through three parts: who paid for the communication, what the communication says or concerns, and the interaction between the payer and the campaign or party committee. The applicable test is fact-specific.

If the coordination test is met, the communication can count against contribution limits as an in-kind contribution. If the payer is a corporation or labor organization, a coordinated communication can also result in a prohibited contribution. It is therefore inaccurate to reduce the rule to whether campaign staff and committee staff discussed a particular advertisement: the content and conduct elements matter as well as payment.

For that reason, “they spoke” and “they never spoke” are both incomplete shortcuts. The analysis considers the communication and the relevant interaction under the applicable FEC framework; whether coordination exists depends on the facts and the applicable test, not on one isolated detail. A committee considering an actual communication should not treat this overview as a substitute for applying the current regulation and controlling authorities.

Who may contribute—and who is barred

The FEC’s permission to accept unlimited contributions applies to individuals, corporations, labor organizations, and other political committees, subject to source prohibitions. The FEC identifies foreign nationals, federal contractors, national banks, and federally chartered corporations among the sources barred from contributing to Super PACs.

So the practical question is not only “How much can this donor give?” It is also “Is this donor permitted to contribute to this kind of committee?” A large contribution from a permitted source and a contribution from a prohibited source are not treated alike merely because both are intended to support independent political activity.

The rules described here concern federal campaign finance. They should not be read as a complete statement of state or local campaign-finance law, which is outside the scope of the FEC materials discussed here. The FEC’s examples of permitted and prohibited sources also should not be turned into a blanket rule that every corporation or union may fund every type of political committee.

Super PAC, traditional PAC, and Hybrid PAC compared

The main distinction is whether the committee may make candidate contributions or must keep all of its spending independent. The FEC materials summarized here establish the Super PAC and Hybrid PAC account distinctions. They do not provide current dollar caps for traditional PAC contributions, so specific limits are not included below.

Committee or account Can contribute to federal candidates? Contribution amount rules Source restrictions Must spending be independent?
Super PAC No. It does not use its funds for direct, in-kind, or coordinated-communication contributions to federal candidates or committees. Unlimited contributions may be accepted for independent activity. Prohibited sources include foreign nationals, federal contractors, national banks, and federally chartered corporations. Yes. It makes only independent expenditures.
Traditional PAC Not established by the FEC material summarized here. Specific current limits are not stated in the FEC material summarized here. Specific source rules are not stated in the FEC material summarized here. Not stated in the FEC material summarized here.
Hybrid PAC: non-contribution account The account may not be used to make candidate contributions; it supports independent expenditures and certain other independent activity. Unlimited funds may be accepted into this account. Unlimited contribution permission is subject to applicable source prohibitions. Yes, for the independent activity it funds.
Hybrid PAC: separate contribution account Yes. It may make contributions to federal candidates. Subject to contribution limits. Subject to source prohibitions. No; it is the separate account that may make candidate contributions.

A Hybrid PAC is related to a Super PAC but is not the same thing. It may maintain a non-contribution account that accepts unlimited funds for independent expenditures and certain other independent activity, alongside a separate account subject to contribution limits and source prohibitions that may make federal candidate contributions. Keeping those accounts distinct is central to understanding why a Hybrid PAC can have both forms of activity while a Super PAC is an independent-expenditure-only committee.

When comparing the two, look at the specific account rather than only the committee’s name. A Hybrid PAC’s unlimited-fund non-contribution account and its separate contribution account have different purposes and rules. The Super PAC description, by contrast, is an independent-expenditure-only committee; the Hybrid PAC structure does not mean a Super PAC itself can make candidate contributions.

How registration and reporting work

Register after crossing the political-committee threshold

The FEC says a committee becomes a political committee after its contributions or expenditures exceed $1,000 in a calendar year. It must register within 10 days after crossing that threshold. This $1,000 figure is a registration trigger, not a contribution cap, spending limit, or maximum amount a Super PAC may raise.

The trigger is based on contributions or expenditures during the calendar year, and the registration deadline follows the point at which the threshold is crossed. It should not be confused with a donor limit or with the amount the committee may spend on qualifying independent expenditures.

Report independent expenditures

Political committees report independent expenditures on Schedule E. Depending on the circumstances, additional 24-hour and 48-hour reports may also be required. The exact filing obligation depends on the activity and applicable reporting rules, so the existence of one reporting form does not mean every expenditure follows the same deadline.

Registration and reporting are part of the framework alongside the spending restrictions. A committee should identify what it did and determine which reporting duties apply, rather than assume that registration alone satisfies every filing obligation. The research summarized here establishes the Schedule E requirement and the possibility of additional 24-hour and 48-hour reports, but a particular filing deadline depends on the circumstances.

Reporting is a separate obligation from the substantive independence rule. A committee does not make coordinated spending lawful merely by reporting it, and filing a report does not by itself establish that an expenditure qualifies as independent.

A practical way to assess a Super PAC activity

For a reader trying to understand whether an activity fits the Super PAC model, these questions help organize the issue. They are not a substitute for applying the controlling law to specific facts.

  1. Identify the committee and account. Is the activity being undertaken by a Super PAC, or by a Hybrid PAC’s non-contribution account? Do not assume that every account associated with a Hybrid PAC follows the same rules.
  2. Check the source. The unlimited-contribution permission does not override source prohibitions. Determine whether the donor is among the sources barred under federal rules.
  3. Identify what the spending pays for. Is it a communication expressly advocating the election or defeat of a clearly identified candidate, or another kind of independent activity? The definition of an independent expenditure is specific.
  4. Examine independence under the applicable test. Consider who paid, the communication’s content, and the interaction between the payer and the candidate, campaign, or party committee. No single shorthand—such as whether two people spoke—settles every case.
  5. Separate contribution rules from filing duties. Check whether the committee has crossed the registration threshold and what reporting obligations apply to the expenditure, including any additional deadline.

Limits of the explanation

The FEC presents its pages as guidance and directs readers to the statute, regulations, advisory opinions, and applicable court decisions. The explanations here describe the federal framework in plain language; they do not resolve every fact-specific question or state and local rule. For a live compliance decision, consult the current controlling authorities and qualified counsel.

Frequently Asked Questions

What can a Super PAC do that a regular PAC can’t?

Under the federal rules summarized here, a Super PAC may accept unlimited contributions from permitted sources for independent political activity and make qualifying independent expenditures without an amount limit. This material does not provide current contribution limits or a full account of traditional PAC rules, so it does not support a complete dollar-for-dollar comparison with a regular PAC.

Can Super PACs give money directly to candidates?

No. The FEC describes a Super PAC as an independent-expenditure-only committee that does not use its funds to make direct, in-kind, or coordinated-communication contributions to federal candidates or committees. Unlimited fundraising is not permission to pass unlimited money to a candidate.

Can Super PACs coordinate with campaigns?

No. Their spending must remain independent. The FEC coordination framework considers who paid, the communication’s content, and the interaction between the payer and the candidate, campaign, or party committee. If the test is met, the communication can count as an in-kind contribution; the result depends on the facts, not merely whether staff discussed an ad.

Who can donate to a Super PAC?

The FEC says Super PACs may accept unlimited contributions from individuals, corporations, labor organizations, and other political committees, subject to source prohibitions. Foreign nationals, federal contractors, national banks, and federally chartered corporations are among the barred sources identified in the FEC guidance.

Do Super PACs have to disclose their donors and spending?

Super PACs register and have reporting obligations. The FEC says political committees report independent expenditures on Schedule E and may have additional 24-hour or 48-hour reports depending on the circumstances. The summary here does not specify every donor-reporting field or deadline, so consult current FEC forms and guidance for a particular filing.

What does the $1,000 threshold mean for a Super PAC?

It is a registration trigger, not a contribution limit or spending cap. The FEC says a committee becomes a political committee after its contributions or expenditures exceed $1,000 in a calendar year and must register within 10 days after crossing the threshold.

Is a Hybrid PAC the same as a Super PAC?

No. A Hybrid PAC may maintain a non-contribution account that accepts unlimited funds for independent expenditures and certain other independent activity, alongside a separate account subject to contribution limits and source prohibitions that may make federal candidate contributions. A Super PAC is an independent-expenditure-only committee.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The Bottom Line

Under federal rules, Super PACs can raise unlimited amounts from permitted sources and spend without an amount limit on qualifying independent expenditures. They cannot contribute those funds to federal candidates or coordinate their spending with campaigns or party committees. Source restrictions, registration, and reporting still apply; the $1,000 registration threshold is not a spending cap.
