What Pokémon Game Names Are Trademarked? What the Official Records Show

The Pokémon name is a trademark, but individual game titles need their own exact-mark checks. Here is what the official records show and how to verify a specific title.

The Pokémon name is a trademark, and Nintendo says so directly in its legal notices. That does not mean every individual Pokémon game title is separately trademarked. The protection that can be verified is specific to an exact mark, an owner, a list of goods, a country, and a current register status. The one game-title record I can point to in U.S. material is a 2023 publication for opposition of POKÉMON LEGENDS ARCEUS, which is a procedural step and not proof of a finished registration.

The short answer, layer by layer

The franchise mark: POKEMON

Nintendo’s German legal information page lists copyright acknowledgments for many Pokémon games, including Pokémon Colosseum and Pokémon Dash, and states that Nintendo DS, Pokémon and Pokémon character names are trademarks of Nintendo. The page is a general statement of Nintendo’s position. It does not list which game titles are registered as trademarks, and the copyright lines it contains concern copyright rather than trademark.

A stronger record is the U.S. registration for the POKEMON word mark, registration number 2297050, owned by Nintendo of America Inc. The USPTO record describes the registration as active and renewed and lists computer game software, electronic game programs, video game cartridges, and video game software. This covers the name as a mark for those goods in the United States. It does not say that a particular subtitle, such as a numbered or subtitled game, has its own registration.

A title-level example: POKÉMON LEGENDS ARCEUS

The USPTO Trademark Official Gazette published POKÉMON LEGENDS ARCEUS for opposition on February 7, 2023. The listing is for standard characters and includes handheld units for playing video games. Publication for opposition is the stage at which a pending application is made public so third parties can object. It is not the same as a registration, and the source does not show whether the application later registered or was abandoned. Treat it as evidence that the title went through a U.S. application, with its current status still to be checked.

Why a franchise notice does not answer title questions

  • Exact wording matters. A mark protects a specific form of a name. Accents, spacing, and subtitles can change what is being claimed.
  • Owner matters. The U.S. POKEMON record names Nintendo of America Inc. Another company may hold a related or unrelated mark, so ownership should be read from each record.
  • Goods matter. A registration for video game software says nothing about clothing, toys, or stationery unless those goods are listed.
  • Country matters. A U.S. record does not establish the position in Japan, the European Union, or any other territory.
  • Time matters. Applications are published, registered, opposed, abandoned, renewed, or cancelled. A record from 2023 or 2025 is a snapshot.

How to check a specific game title

  1. Write the exact title as it appears on the product, including the accent in “Pokémon” and any subtitle. Searching “Pokemon” alone can miss or blur the filing you need.
  2. Search the USPTO’s public trademark search system for the exact wording, then check the Trademark Official Gazette if you find a publication record.
  3. For each hit, record the mark wording, owner, goods or services, serial or registration number, filing or publication date, and live status.
  4. Read the status field rather than assuming. A published application and an active registration are different results.
  5. If the title will be used in another country, run the same search in that country’s official register. The sources reviewed do not cover foreign registers.

What this means if you plan to use a Pokémon title

If you are naming a business, selling merchandise, or writing a product listing that uses a Pokémon game title, the check above is the starting point, not the finish line. A clear record for the franchise name does not settle whether a particular title or wording is safe to use in a particular market. For a decision with money behind it, a qualified trademark lawyer in the relevant country should review the exact mark and goods.

Limits of the evidence

The records above are a narrow set: one general legal notice, one U.S. registration record generated in October 2025, and one U.S. publication from February 2023. Nothing reviewed here lists every Pokémon game title, and nothing establishes the status of each title in each country. Anyone who needs a complete picture should query each exact title in the official register for the market in question.
