What Mortgage Fair-Lending Protections Cover and How to File a Complaint

A practical guide to U.S. mortgage fair-lending protections, warning signs, complaint channels, and records that may help explain what happened.

U.S. federal law protects people seeking or managing mortgages from certain forms of discrimination. The Equal Credit Opportunity Act (ECOA), implemented by Regulation B, and the Fair Housing Act (FHA) cover different protected characteristics and aspects of lending. If you think a lender or mortgage servicer treated you unfairly, write down what happened, keep the relevant paperwork, and consider filing a complaint with the Consumer Financial Protection Bureau (CFPB). Depending on the concern, HUD, the Federal Trade Commission (FTC), or a state consumer-protection office may also be relevant.

Which federal laws protect mortgage borrowers?

Two federal laws are central to mortgage fair lending: ECOA and the FHA. They overlap, but they do not have identical lists of protected characteristics. Which law applies can depend on the conduct and the relationship involved, so do not treat the lists as interchangeable or assume that one list covers every situation.

ECOA and Regulation B

ECOA applies to creditors and credit transactions, including mortgage and home-equity credit. The CFPB’s mortgage-specific consumer guide says a creditor—including a lender or mortgage broker—may not discriminate against an applicant because of:

  • Race or color
  • Religion
  • National origin
  • Sex
  • Marital status
  • Age, if the applicant is old enough to enter into a contract
  • Receipt of income from a public-assistance program
  • The applicant’s good-faith exercise of a right under the Consumer Credit Protection Act

Regulation B implements ECOA. The CFPB describes it as covering any aspect of a credit transaction, not just the initial approval decision. Its coverage includes applications, underwriting, denials, servicing and collection, and the revocation, alteration, or termination of credit. That can make the law relevant after closing as well as while a person is applying or refinancing.

The Fair Housing Act

The CFPB’s mortgage guide says the FHA protects people seeking a mortgage, home-equity loan, or loan to build, repair, or improve a home from discrimination based on race or color, religion, national origin, sex, disability (called “handicap” in the guide), or familial status. Those are the FHA bases identified in that guide; ECOA has a different list, including age, marital status, public-assistance income, and certain rights under the Consumer Credit Protection Act.

These protections are not limited to the person who will occupy a home or to a conventional purchase mortgage. The CFPB’s descriptions encompass specified home loans and credit transactions, including refinancing and home-equity credit. The particular law and protection relevant to a concern depend on the facts; this federal overview does not determine which claim may apply to an individual situation.

What kinds of mortgage conduct may raise a concern?

The CFPB identifies several warning signs: being refused credit despite qualifying, being discouraged from applying, being offered less favorable terms, or having an account closed. Regulation B’s coverage of credit transactions also makes servicing, collection, and changes to existing credit relevant areas to examine. A warning sign is a reason to ask questions or report a concern; it is not, by itself, proof that a lender violated the law.

Look beyond the approval decision

A mortgage concern may arise at different points in the relationship. For example, you might believe you were discouraged before submitting an application, assessed differently during underwriting, offered less favorable credit terms, or treated differently in servicing or collection. A change or termination of credit may also warrant scrutiny. Record the specific interaction and its place in the process rather than describing the issue only as “the lender discriminated.” A clear account helps an agency understand what happened and what part of the transaction you are asking it to review.

Think about the whole sequence, not only the final decision. Note what you asked for, what information or terms you were given, what happened next, and whether the treatment changed over time. If the concern involves a servicer rather than the original lender, identify that company and the account or servicing interaction involved. These details help make a report understandable without requiring you to decide in advance which law applies.

Separate a warning sign from an explanation

Lenders may consider information relevant to whether an applicant can repay a loan. The CFPB also says lenders may ask about immigration or residency status, but may not use that status to justify discrimination based on national origin, race, or another protected characteristic. Most mortgage lenders may ask about race, ethnicity, and sex to comply with antidiscrimination laws. A demographic question, standing alone, therefore does not establish discrimination; the context and how the information was used matter.

Some factors have qualifications that a short consumer guide cannot fully resolve. For example, the CFPB’s general lender-discrimination guide says age may be considered in a valid credit-scoring system, and income from public assistance may be assessed for its likelihood of continuing. Do not infer from a single question or decision that the lender acted unlawfully—or that a potentially protected factor could never be relevant under any circumstances. The details of the transaction and applicable law matter.

How should you prepare before filing?

You do not need to prove a legal violation before submitting a complaint. You can make your account easier to follow by organizing what happened and preserving the documents that may help explain it. The CFPB specifically recommends having dates, amounts, and other details ready; the records below are practical ways to gather that information, not a mandatory checklist.

Build a timeline

  1. List the dates. Note when you applied, spoke with the lender or servicer, received an offer or denial, and followed up.
  2. Identify the people involved. Record names where known, job roles, and which lender, broker, or servicer they represented.
  3. Describe what was said or done. Use the words you remember as accurately as possible. Separate what you directly observed from what you inferred.
  4. Record the loan details. Note the application, loan, and property involved, the amount requested or offered, and the terms at issue.
  5. Write down the response. Include what the lender said about its decision, what explanation or follow-up it offered, and whether the issue was resolved.

Keep relevant paperwork and communications

Save copies of the application, a denial or adverse-action notice, appraisal or other written valuation, rate and fee information, and relevant email or message exchanges. Keep contemporaneous notes of calls or meetings, including when they occurred and who participated. Preserve original messages and documents where possible, and organize copies so you can find the item associated with each event in your timeline. You can report a concern even if you do not have every document.

When you describe the concern, distinguish facts from conclusions. For example, you can report the terms you were offered and the words you recall without claiming to know why the lender acted that way. If you have an explanation from the lender, include it along with anything that seems inconsistent or unanswered. An agency can assess a report; your role is to give a clear, accurate account of what you experienced.

Where can you file a mortgage discrimination complaint?

The CFPB is a general route for complaints about consumer financial products, including mortgages. It also identifies other possible channels: HUD’s fair-housing complaint route, the FTC, and a state attorney general or state consumer-protection office. These avenues have different roles and procedures; filing with one should not be assumed to resolve every legal issue or preserve every deadline.

Consumer Financial Protection Bureau

Submit a complaint through the CFPB’s online complaint service or call 855-411-2372. Have your dates, amounts, and other details ready. The CFPB says it provides a way to follow the complaint’s status and progress. Its mortgage guidance identifies this as an option when you think a lender discriminated against you, and the agency also accepts complaints about mortgage-related consumer financial products.

Department of Housing and Urban Development

HUD’s fair-housing complaint route may be relevant when you believe a lender or mortgage servicer discriminated in a matter covered by fair-housing law. The CFPB identifies HUD as an option alongside its own complaint process. Check HUD’s current instructions for how to submit and what information it requests; the CFPB materials summarized here do not establish HUD’s detailed processing steps, deadlines, or likely outcome.

FTC and state consumer-protection offices

The CFPB also identifies the FTC and a state attorney general or consumer-protection office as additional reporting avenues for lender discrimination. The right office can depend on the issue and where you live. The federal overview does not compare state laws or specify each office’s intake procedure, so consult the relevant agency for its current instructions and consider local protections in addition to federal law.

How the complaint routes differ

The CFPB is the most direct general channel in this guidance for a complaint about a consumer financial product such as a mortgage. HUD is the specifically identified fair-housing route. The FTC and state offices are additional reporting options; the research reviewed here does not describe their detailed procedures or outcomes. A concern can touch both credit and housing issues, so select the channel that fits the conduct and consider whether another agency is also appropriate.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

These routes are not interchangeable guarantees of a particular result. A complaint to one office does not necessarily address every legal issue, and the materials do not establish that filing preserves deadlines under another process or law. If timing may matter, ask the relevant agency or a qualified lawyer about deadlines rather than assuming that a complaint pauses them.

A practical filing sequence

  1. Choose the agency route. Consider whether the report concerns a consumer financial product, fair housing, or another reporting route identified by CFPB.
  2. Gather the basics. Have the timeline, amounts, loan or property details, lender or servicer identity, and relevant documents ready.
  3. Describe the events plainly. Explain what happened and why it concerns you, including any decision, terms, or response you received.
  4. Keep a copy. Save what you submitted and any confirmation or status information so you can refer to it later.
  5. Follow the agency’s current instructions. The CFPB offers an online complaint service and phone line; check HUD, FTC, or state-office instructions directly for their procedures.

This sequence is organizational advice, not a required legal procedure. You do not have to identify a legal theory or use particular wording to make a report, and this guide cannot establish whether an agency will investigate or what it may do.

What do adverse-action notices and appraisals tell you?

Related lending rights can help you understand a decision or the information used in an application. They are useful records, but receiving—or not yet having—one does not by itself establish that discrimination occurred.

Reasons for a denial or less favorable offer

The CFPB’s lender-discrimination guide says that if an application is turned down or a consumer receives a less favorable offer, the consumer should receive an adverse-action notice stating specific reasons or explaining how to request them within 60 days. If you receive such a notice, keep it with your timeline and compare the stated reasons with the terms, information, and communications you have on file. A stated reason may help clarify the lender’s decision; it does not independently settle whether the decision was discriminatory.

If the notice says you can request the reasons, note the 60-day period described in the CFPB guidance and follow the notice’s instructions. Keep a copy of your request and any response. The notice is a source of information about a credit decision, not a final assessment of whether the decision complied with fair-lending law.

Copies of appraisals and written valuations

For covered applications for a first-lien loan secured by a dwelling, ECOA valuation rules generally require creditors to provide applicants free copies of appraisals and other written valuations developed in connection with the application. The CFPB’s materials also describe a written notice that copies will be provided promptly. Keep any valuation and related notice with the rest of your application records; a valuation may help you understand the lender’s file, but it is not on its own a finding of unlawful conduct.

What happens after you submit a complaint?

The CFPB says it provides a way to monitor complaint status and progress. The CFPB materials do not promise a particular result, explain that every complaint will be resolved in a specific way, or establish that a CFPB submission decides all legal claims. Agencies have different responsibilities and procedures, and you may need to contact more than one office if your concern spans consumer credit and fair housing.

Keep a copy of what you submit and any confirmation or status information you receive. If an agency asks for more details, your timeline and saved documents can help you respond consistently. Ask the agency directly about its process, what it can review, and any deadlines that may apply. Do not assume that making one report pauses or preserves a deadline under another process or law.

Where can you get individual help?

If you want legal advice about your own circumstances, the CFPB points consumers to local bar associations or legal aid as possible ways to find a lawyer. A lawyer can assess facts and deadlines that a general consumer guide cannot determine. Legal representation is not a prerequisite to filing a complaint.

For mortgage-payment or housing difficulties, the CFPB identifies HUD-certified housing counselors as a resource. A housing counselor is not the same as a lawyer or a complaint agency. Counseling may help with a mortgage or housing issue, while a complaint is a report to an agency and legal advice requires an appropriate legal professional. The CFPB also advises consumers to check local state protections, which may add relevant requirements beyond this federal overview.

What changed in the CFPB’s Regulation B resource in 2026?

The CFPB’s current Regulation B resource reports that a final rule issued April 22, 2026 removed the “effects test” from the regulation, revised the discouragement provision, and changed rules for special purpose credit programs. The resource further says the rule stated that ECOA does not recognize disparate-impact liability, and revised the discouragement provision to focus on statements of intent to discriminate rather than statements that merely create negative impressions. The agency’s page says the regulation was most recently amended July 21, 2026, while also noting that an updated version will be published.

This is a report of what the CFPB resource says, not a complete account of the official Federal Register record, subsequent litigation, or the rule’s legal effect in every case. The research reviewed for this article did not establish later litigation or independently confirm the effect of the amendments. Because those materials describe a recent regulatory change, do not rely on a general article to decide how they affect a particular dispute. Before making a legal conclusion based on the 2026 rule, check the current official regulation, the Federal Register notice, and any applicable court orders, or consult a qualified lawyer. The CFPB’s interactive regulation resource itself says it is not an official legal edition and does not replace official CFR or Federal Register publications.

Frequently Asked Questions

What should I do if I think a mortgage lender discriminated against me?

Write down what happened, including dates, people involved, amounts, and the terms or response you received. Keep relevant application records and communications. You can submit a complaint to the CFPB online or call 855-411-2372; depending on the concern, HUD, the FTC, or a state consumer-protection office may also be relevant.

Does a denial or a demographic question prove mortgage discrimination?

No. A refusal despite qualifying, discouragement, less favorable terms, or account closure may be warning signs, but a warning sign alone does not prove a violation. Most mortgage lenders may ask about race, ethnicity, and sex to comply with antidiscrimination laws; the context and use of information matter.

What is the difference between ECOA and the Fair Housing Act?

Both can apply to mortgage-related situations, but their protected-bases lists differ. The CFPB’s ECOA guide lists race or color, religion, national origin, sex, marital status, qualifying age, public-assistance income, and good-faith exercise of certain Consumer Credit Protection Act rights. Its Fair Housing Act guide lists race or color, religion, national origin, sex, disability, and familial status for specified home loans.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Can I complain about mortgage servicing, not just the original loan decision?

The CFPB describes Regulation B as covering aspects of a credit transaction beyond approval, including servicing, collection, and revocation, alteration, or termination of credit. The CFPB also identifies HUD as a possible fair-housing complaint route when a lender or mortgage servicer is alleged to have discriminated.

How long do I have to ask for the reasons for a denial or less favorable offer?

The CFPB’s lender-discrimination guide says an adverse-action notice gives specific reasons or information about how to request them within 60 days. Follow the notice’s instructions and keep your request and any response. This should not be confused with a filing deadline for a discrimination complaint; the reviewed guidance does not establish a general complaint deadline.

Do I have to hire a lawyer or prove discrimination before filing?

No. Legal representation is not a prerequisite to filing a complaint, and you can report a concern without proving a legal violation first. For advice about your individual facts or deadlines, CFPB points to local bar associations or legal aid as possible ways to find a lawyer.

The Bottom Line

Mortgage fair-lending protections can apply to more than loan approval: applications, underwriting, terms, servicing, collection, and changes to credit may matter. Keep a factual timeline and relevant records, then use the CFPB or another appropriate agency route to report your concern. A complaint is a way to raise the issue, not proof of a violation or a guarantee of an outcome; check current agency instructions and seek individual legal help if deadlines or the 2026 Regulation B changes may affect your situation.
