What Is the GENIUS Act, and Why Do Critics Say It Could Benefit Trump?

The GENIUS Act establishes a federal framework for payment stablecoins. Critics focus on its reported ethics restriction, which covers Congress but not the president and his family.

The GENIUS Act became law on July 18, 2025, after passing the Senate 68–30 and the House 308–122. It creates a federal framework for payment stablecoins, including rules for issuers, reserves, disclosures and compliance. Critics’ “grift” concern is narrower: they say the law’s ethics restriction does not cover the president and his family, even as the Trump family has reported ties to a stablecoin venture. That is a political conflict-of-interest criticism, not a finding that the Act or anyone’s conduct is illegal.

What is the GENIUS Act?

The Guiding and Establishing National Innovation for U.S. Stablecoins Act, known as the GENIUS Act, is a federal law governing payment stablecoins. It was enacted as Public Law 119-27 on July 18, 2025. The statutory text sets requirements related to who may issue payment stablecoins, how issuers are supervised, reserve backing, public disclosures, and compliance and enforcement.

A payment stablecoin is designed to maintain a stable value, commonly by reference to a currency such as the U.S. dollar. The law establishes a framework for that category; it does not mean every cryptocurrency is a stablecoin or that every digital asset falls under the same rules.

Did the GENIUS Act become law?

Yes. The Senate passed S. 1582 by 68–30 on June 17, 2025. The House later passed it 308–122, and President Donald Trump signed it on July 18, 2025. The Senate vote was one step in the process, not the date the law took effect.

There is an important distinction between enactment and implementation. Federal Register materials published in 2026 described proposed implementing rules and the Act’s effective-date formula: January 18, 2027, or 120 days after primary federal payment-stablecoin regulators issue final implementing regulations, if that occurs earlier. That means enactment alone does not establish that the full regulatory framework is already effective. The current status of final rules should be checked against later agency publications.

What does the GENIUS Act require?

The law’s main focus is the issuer and the safeguards behind a payment stablecoin. The White House’s July 18, 2025 fact sheet summarized the Act as requiring issuers to maintain 100% reserves in liquid assets and to publish monthly disclosures describing reserve composition. Those figures and descriptions are the administration’s summary of the law, rather than an independent assessment of how the framework will work in practice.

The Act also addresses issuer eligibility and supervision, along with compliance obligations that include anti-money-laundering and sanctions-related requirements. The White House presented these provisions as consumer protections and a way to support U.S. leadership in digital assets. Its claims about future investment, innovation and increased demand for the dollar are administration projections, not established outcomes.

Why do critics say the law could benefit Trump?

The criticism centers on a perceived conflict of interest. The Associated Press reported that the Act restricts members of Congress and their families from profiting from stablecoins, but does not extend that restriction to the president and his family. AP also reported Trump-family ties to World Liberty Financial and its USD1 stablecoin.

That combination prompted critics to argue that the law leaves a gap where a presidential financial interest could overlap with the sector the law regulates. Senator Jack Reed, who opposed the bill, argued that it could greenlight Trump’s USD1 venture and said it did not do enough for consumers, taxpayers or national security. Those are Reed’s arguments, not an adjudicated finding that the law was written for the Trump family or that it authorizes unlawful conduct.

Senator Jeff Merkley said that passing the Act without stronger anti-corruption measures “stamps a Congressional seal of approval on President Trump selling access to the government for personal profit.” AP reported Senator Elizabeth Warren warning that the measure would create a “super highway” for Trump corruption. Both statements are political criticism; neither is a legal determination.

How do supporters and opponents frame the trade-offs?

Critics object that the reported restriction on congressional members and their families does not cover the president and his family, amid reported Trump-family ties to USD1.
Economic effects The administration says the law could encourage innovation, investment and dollar leadership. These prospective benefits are not established outcomes; opponents warn of risks, including conflicts of interest and inadequate safeguards.

The disagreement is therefore partly about the law’s safeguards and partly about who is covered by its ethics provisions. The statutory text establishes the legal framework; political claims about future benefits, harms or conflicts should be evaluated as claims by the officials making them.

What should stablecoin users take from the law?

The Act creates a federal rulebook for payment-stablecoin issuers, but it is not a guarantee that a particular stablecoin is risk-free, insured like a bank deposit, or immune from changes in value or access. A user considering a stablecoin should distinguish the law’s issuer requirements from the financial and operational risks of holding a specific token. The final rules and their effective date also matter: 2026 Federal Register materials described proposed, not final, implementing rules.
