A domestic single-member LLC usually has this default classification unless it elects corporate treatment. “Disregarded” does not mean the LLC disappears or is ignored for every federal tax purpose: employment and certain excise taxes have separate rules.
What “disregarded entity” means
The term describes a federal tax classification, not whether an LLC exists as a legal entity. A state creates the LLC under its laws; for federal income-tax purposes, the IRS generally treats a domestic LLC with one owner as part of that owner rather than as a separate taxpayer, unless the LLC elects corporate classification. People often call this default treatment “sole proprietorship” taxation when the owner is an individual. That shorthand concerns income-tax reporting; it does not change the LLC’s state-law form. Nor does it mean that the LLC files nothing or has no tax responsibilities of its own.
How ownership affects an LLC’s default tax classification

These are general federal rules, not a determination for every ownership arrangement. A change in owners can change the default classification. The IRS FAQ, Entities, explains how to classify a domestic LLC; the spouse community-property treatment is a specific exception, not a blanket rule for all LLCs owned by spouses.

Where an individual owner reports the LLC’s income
An individual owner generally reports the LLC’s activity on the part of the individual return that fits the activity: Schedule C for a business, Schedule E for applicable supplemental income or loss, or Schedule F for farming. Use the instructions for the relevant tax year; the IRS’s 2025 Schedule C instructions apply to that tax year and should not be assumed to cover later years.
An individual conducting a trade or business is generally subject to self-employment tax on net earnings under sole-proprietor rules. The fact that the LLC is disregarded for income-tax purposes does not, by itself, determine how every payment, tax, or activity is treated.

Why a disregarded LLC may still file tax returns
Disregarded treatment does not extend to all federal taxes. A single-member LLC is treated as a separate entity for employment tax and certain excise taxes. If it has employees, the LLC generally reports and pays employment taxes under its own name and EIN. Certain excise-tax activities likewise require the LLC’s name and EIN. The IRS describes these exceptions in its single-member LLC guidance.
So the practical question is not simply whether an LLC is “disregarded.” It is which tax or reporting obligation is involved: the owner’s income-tax return, employment taxes, or a specified excise tax.

Which taxpayer identification number goes on a W-9?
For income-tax information reporting, a disregarded single-member LLC generally uses its owner’s name and taxpayer identification number (SSN or EIN), rather than the LLC’s EIN. The IRS W-9 instructions include an example of an individually owned disregarded LLC; follow the current Form W-9 instructions for the form you are completing.
That rule is distinct from employment and certain excise-tax reporting, for which the LLC uses its own name and EIN when required. An EIN used for one obligation should not automatically be substituted for the owner’s TIN on income-tax information returns.

Does a single-member LLC need its own EIN?
A sole owner whose LLC has no employees and is not subject to relevant excise taxes generally does not need a separate federal EIN solely because the LLC exists. The IRS says an EIN may still be obtained for reasons such as opening a bank account or meeting a state requirement. An LLC generally needs its own EIN if it has employees, must file specified excise-tax forms, or elects corporate or S corporation treatment. Check the IRS Entities FAQ and applicable filing requirements for your circumstances.
How an LLC can elect corporate or S corporation treatment
An eligible entity can generally elect corporate classification by filing Form 8832, Entity Classification Election. A qualifying LLC seeking S corporation treatment may file Form 2553; the IRS treats a valid S corporation election as an election to be classified as a corporation as well, so a separate Form 8832 is not required first. S corporation treatment is not automatic, and not every LLC qualifies. Review the IRS Form 8832 information and Form 2553 information before choosing a classification.

An election can change the return and tax obligations associated with the LLC. The right choice depends on facts such as ownership, business activity, payroll, and the consequences of the election; the default rules alone do not establish which treatment is best for a particular owner.

- Confirm how many owners the LLC has and whether a special ownership rule, such as the qualifying community-property rule, applies.
- Identify the specific obligation: income-tax reporting, a W-9 or other information return, employment tax, or excise tax.
- Use the owner’s TIN for income-tax information reporting where the disregarded-entity rule applies; use the LLC’s own EIN for applicable employment or excise-tax reporting.
- Check whether an election has been made and whether the LLC meets the requirements for the chosen classification.
