What Happens When You Miss an Income Tax, GST or TDS Deadline?

A missed Indian tax deadline can trigger different fees, interest or further action depending on the return, payment or TDS obligation and the period involved.

Missing an Indian tax deadline can mean a late fee, interest on unpaid tax, a notice, or further consequences—but there is no single penalty that applies to income tax, GST and TDS alike. The result depends on which obligation was missed, the tax year or return period, whether tax remains unpaid, and whether you completed required steps such as verifying an income-tax return. Identify the exact default first, then check the amount and next action for your specific period.

First identify which deadline you missed

“Tax deadline” can mean a deadline to file a return, deposit tax, submit a withholding statement, or verify an uploaded income-tax return. Those are separate obligations, and paying one liability does not necessarily complete the others. Use this table to identify the situation before estimating what you owe.

Missed obligation Who is responsible Potential consequences
Income-tax return The taxpayer whose return is due A late-filing fee may apply; interest may apply if tax remains payable. The return must be filed within the applicable window and verified.
GST return The GST-registered person required to file for the period A late fee may apply; unpaid GST can attract interest. A notice may require filing, and an earlier unfiled return can restrict filing for a later period.
Income-tax TDS/TCS deduction or deposit The person or entity required to deduct or collect and remit tax Interest differs depending on whether tax was not deducted or was deducted but not deposited. Recovery and other proceedings may apply in relevant cases.
Income-tax TDS statement The deductor or collector responsible for reporting This is a separate compliance obligation from depositing the tax. Check the portal for the specific statement period, outstanding amounts and any notice.
GST TDS statement The person required to deduct GST TDS and report it GSTR-7 has its own filing obligation and due date; applicable late-fee details depend on the rules and notifications for the period.

For income-tax matters, keep the tax year and legal framework straight: the Income Tax Department says filings for Assessment Year (AY) 2026–27 and earlier remain under the Income-tax Act, 1961, while the Income-tax Act, 2025 framework applies from Tax Year 2026–27 onward. Do not carry a section number or deadline from one framework into the other without checking the applicable year. Income Tax Returns FAQs

If you missed an income-tax return deadline

A late return may still be possible, but the window matters

The Income Tax Department says a belated return may be filed within the statutory time limit that applies to the relevant Act and tax year. That does not mean every overdue return can still be filed: the available filing window, the status of any assessment and the applicable rules matter. Check the portal for the relevant year and return type, and act while filing remains available. The department’s return FAQ

Late-filing fee and unpaid tax are different liabilities

The department’s 2026 FAQ describes a late-filing fee of ₹1,000 where total income does not exceed ₹5 lakh, and ₹5,000 in other cases, under the provisions applicable to the return discussed there. The FAQ also says interest may be payable if tax remains due. These figures are not a universal charge for every year, taxpayer or kind of missed deadline: confirm the governing Act, year, eligibility and current portal calculation before relying on them. A late-filing fee does not settle unpaid tax or interest. Income Tax Returns FAQs

Uploading is not the same as completing the return

An income-tax return must be verified. The department says that if a return is uploaded by its due date but verified more than 30 days later, the verification date is treated as the date the return was furnished, with late-filing consequences applying as relevant. An unverified return is treated as invalid unless delay is condoned. The 30-day period is reflected in the department’s FAQ following Notification No. 2/2024 dated 31 March 2024. If you uploaded but did not verify, check the return’s status and complete an available verification or condonation step promptly. ITR-V FAQs

TDS deducted from your income does not replace filing your return

If tax was deducted from income you received, you still need to disclose that income in your return and claim the corresponding TDS credit there. Do not treat a tax deduction by an employer, bank or other payer as a substitute for filing your own return. Reconcile the deduction with the records available for the relevant year before submitting the return. ITR-1 FAQ

If you missed a GST return or payment deadline

Late filing and late payment have separate consequences

The Central Goods and Services Tax (CGST) Act provides for a late fee when specified returns are filed after their due date. Separately, section 50 provides for interest where tax is not paid within the prescribed period. Filing a return does not itself clear an unpaid tax balance, and paying the tax does not necessarily file the missing return. Check both the filing status and the amount due for the affected period. A default can affect later periods

Under the provisions cited in the CGST Act, a return defaulter may receive a notice requiring the return to be filed within 15 days. The Act also restricts furnishing a return for a period when a return for a previous period has not been furnished. This can turn one missed period into a filing obstacle for subsequent periods, so check whether any earlier return remains outstanding before attempting the next one. The notice period is a statutory requirement described in section 46; respond to an actual notice by its stated deadline and follow the instructions that apply to your case. CGST Act

Do not assume an old general fee figure is current for your return

The Act contains general late-fee provisions, but notifications and return-specific rules can change the amount or provide waivers. CBIC’s general FAQ gives an older ₹100-per-day and cap description dating from 2017; that is not a safe universal rate for every current form or period. Historical GSTR-3B figures in CBIC status material are also period-specific. Use the official portal and applicable notifications to check the amount for your form and filing period rather than applying a generic figure. CBIC GST FAQ; GST Concept and Status

If you missed an income-tax TDS or TCS obligation

Failure to deduct and failure to deposit are not the same default

For income-tax TDS/TCS, the department describes interest at 1% per month or part of a month when tax was not deducted, running from the date it was deductible until it is deducted. If you deducted the tax but did not deposit it, the stated rate is 1.5% per month or part, from deduction until payment. Because a part of a month counts under the stated calculation, do not assume that a short delay avoids interest. These rates come from the department’s 2026 Tax Payments FAQ; confirm the legal framework and calculation for the tax period concerned. Tax Payments FAQ

Default may bring recovery and other proceedings

The department’s TDS compliance guidance says a deductor may be treated as an assessee in default and may face recovery with interest. Penalty or prosecution proceedings may also arise in applicable cases; they are not automatic consequences of every late payment. The same guidance describes a 30% business-expense disallowance for specified payments to residents where tax was deductible but not deducted, or was not deposited by the return-filing deadline. Whether that rule applies depends on the payment and the governing period, so a business with a significant or unresolved default should obtain case-specific advice. TDS Compliance FAQs

A TDS statement is another task to check

Depositing withheld tax and filing the required statement are distinct parts of compliance. If the statement is late, identify its form and quarter or other relevant period, then check the department portal for the current late fee, status and any notice. The available official guidance here establishes different consequences for failure to deduct and failure to deposit; it does not establish one universal fee for every late statement. Do not use the interest rates for those defaults as a substitute for checking the statement’s own filing liability.

GST TDS is separate from income-tax TDS

GST TDS is governed by the GST system, not the income-tax TDS rules above. A person responsible for GST TDS may have to file Form GSTR-7 by its own due date. CBIC’s procedure document discusses that statement and late fees, but it dates from 2019; subsequent notifications may affect the details. Check the current rule for the relevant GST period before relying on an amount in older guidance. CBIC GST TDS procedure

What to do after discovering a missed deadline

  1. Name the missed obligation. Determine whether it is an income-tax return, a GST return, an income-tax TDS/TCS deposit, an income-tax TDS statement or a GST TDS statement. Do not treat them as interchangeable.
  2. Identify the year or period and form. For income tax, establish whether the matter falls under AY 2026–27 or earlier or under Tax Year 2026–27 onward. For GST and withholding, identify the specific period and required return or statement.
  3. Check whether tax is unpaid as well as whether a filing is late. A late fee, interest and the underlying tax balance are separate items. For TDS/TCS, also establish whether tax was not deducted or was deducted but not deposited.
  4. File or deposit what remains outstanding as soon as permitted. Check the portal for the correct form and available filing window. For a GST account, look for an earlier missing return that may prevent filing a later period.
  5. Reconcile records and finish required verification. For an income-tax return, match income and TDS credits to your records and complete verification. Review the return’s status rather than assuming an upload completed the filing.
  6. Review the official portal and applicable notifications. Confirm the computed late fee, interest, waiver eligibility and any notice for the actual form and period. Generic or historic figures may not match the current liability.
  7. Get professional help when the stakes are material. Seek a qualified Indian tax professional promptly if there is a demand or notice, an expired filing window, a substantial unpaid amount, or uncertainty about the applicable year or legal framework.

When a missed deadline needs urgent attention

Prioritize a notice, recovery communication, or a GST filing block over a general estimate of what the delay might cost. A formal notice has its own response requirement, and an unfiled earlier GST return can obstruct later-period filing. For income tax, an uploaded but unverified return may not have the filing date you expected. In each situation, establish the portal status and applicable period before making a payment or assuming the matter is resolved.

The practical answer is therefore not a single penalty amount: identify the missed duty, separate filing from payment and verification, and use the official calculation for the tax year or period at issue.
