What Happens When a Cryptocurrency Case Is Appealed After Acquittal?

A U.S. federal jury acquittal ordinarily ends a criminal prosecution, including one involving cryptocurrency. A limited exception may apply after a guilty verdict followed by a judge’s acquittal.

In a U.S. federal criminal case, a jury’s not-guilty verdict ordinarily ends the prosecution: the defendant is released, and prosecutors cannot appeal if doing so would require another trial or renewed fact-finding. The fact that the case involves cryptocurrency does not create a different rule. A narrow exception can apply when a judge enters an acquittal after a jury has already found the defendant guilty.

Can prosecutors appeal an acquittal?

Usually, not when the acquittal is a jury’s finding that the defendant is not guilty. The U.S. Courts explains that the defendant is released and the government may not appeal a not-guilty verdict: U.S. Courts: Criminal Cases.

The constitutional protection against double jeopardy bars a government appeal when success would expose the defendant to a second trial or further proceedings to determine facts necessary to establish guilt. The Supreme Court has addressed this limit in United States v. Martin Linen Supply Co. and United States v. Scott.

What is the narrow exception?

A different situation arises if a jury first returns a guilty verdict and the judge then enters a judgment of acquittal. The government may be able to appeal if reversal would restore the existing jury verdict rather than require a new trial. In that posture, the appeal does not put the defendant through another jury trial.

Federal rule advisory materials describe this distinction in connection with judgments of acquittal entered after a guilty verdict. The governing statute, 18 U.S.C. § 3731, authorizes certain government appeals but does not override the constitutional prohibition on further prosecution where double jeopardy bars it.

How does this differ from an ordinary criminal appeal?

Appeals commonly follow an adverse outcome for the defendant, such as a guilty verdict. In a federal appeal, the appellant presents legal arguments in a brief, and the opposing party responds with reasons to uphold the decision or explain why an error did not affect it. The U.S. Courts outlines this process and the roles of the parties in its appeals overview.

Section 3731 includes a 30-day deadline for certain government appeals covered by the statute. That is not a general deadline for appealing a jury acquittal; the constitutional bar and the particular type of order determine whether an appeal is available at all.

Does cryptocurrency change the rule?

No cryptocurrency-specific appeal exception is established by these federal authorities. Whether a prosecution concerns alleged fraud, money laundering, or another offense involving digital assets does not itself determine whether the government can appeal. The key questions are the court’s jurisdiction, what ruling was entered, and what would happen if an appeal succeeded.

What should you check in a particular case?

The phrase “acquitted” can be used loosely in news reports. To understand what happens next, identify the official court and the exact disposition in the docket or opinion.

  • Who entered the acquittal? A jury’s not-guilty verdict is different from a judge’s judgment of acquittal entered after a guilty verdict.
  • What would a successful appeal do? Reinstating an existing verdict is distinct from ordering a new trial or further factual proceedings.
  • Which jurisdiction handled the case? The rules described here concern U.S. federal criminal cases. State and foreign proceedings may follow different rules.
  • Was it actually an acquittal? A dismissal or another ruling may be described informally as an acquittal, but its legal effect can differ.

Without the case’s court, country, and exact order, it is not possible to say whether a particular cryptocurrency prosecution can be appealed or what its status is.
