If a centralized crypto exchange fails, the bitcoin shown in your account can become inaccessible while withdrawals are suspended and a court-supervised insolvency process determines who is entitled to what. You may need to file or establish a claim, and recovery can be delayed, reduced, or unavailable.
The result is fact-specific. It depends on the exchange’s user agreement, the legal entity that contracted with you, how coins and records were held, the type of account, the governing law, and the orders in the particular proceeding. An account balance is not a guarantee of immediate access or full recovery.

What usually happens first when an exchange fails
A failure can unfold in several stages, but no single sequence applies to every company or jurisdiction. The following describes the issues customers commonly face in a U.S. insolvency proceeding.
Withdrawals may be halted
The exchange can stop withdrawals before or after filing for bankruptcy. That means a bitcoin balance remains visible in an account but cannot be transferred to a wallet. Even if you believe the coins are yours, access may wait until the exchange, a trustee, or a court resolves questions about custody and ownership.

A court process takes control
Once a bankruptcy or other insolvency case begins, court orders govern what the company can do with assets and customer accounts. Notices may explain whether a claims agent is handling submissions, what evidence is required, and when a claim must be filed. Those deadlines are specific to the case; a deadline from one exchange cannot be applied to another.
Customer claims are reviewed
You may have to prove your account balance and the amount or type of your claim. The court can require estimation or other procedures before claims are allowed. A claim is a legal request for payment or distribution, not a promise that the requested amount will be accepted or paid promptly.
Assets may ultimately be distributed
If the estate has assets available for customers and other creditors, distributions can occur under a court-approved plan or liquidation process. The amount and form of a distribution can depend on the estate’s records, competing claims, asset prices used for valuation, administrative costs, and the priority assigned to each claim.
Why your bitcoin may not be treated as property you can immediately retrieve
Custodial crypto arrangements do not have one universal legal treatment in insolvency. A 2026 SEC-filed company disclosure warns that digital assets held by a custodian could be treated as property of the custodian’s estate, with customers treated as general unsecured creditors. That treatment could produce a markdown or total loss. The same disclosure describes the issue as unsettled and dependent on the contracts and facts.
Other facts could support a different result, such as a court finding that particular assets are held for customers and should be returned. Even then, the ownership question can take time to litigate, and withdrawals can remain frozen while it is decided. Do not assume either that customers always own the coins in a segregated sense or that the exchange always owns them.

The account agreement is central
Read the terms that applied when you used the service, including later versions the agreement says are binding. Terms can define custody, lending, rehypothecation, title, dispute resolution, and which company is responsible. Marketing descriptions such as “custodial” or “segregated” do not, by themselves, establish the legal result in bankruptcy.
The contracting entity can change the answer
Large platforms often use multiple affiliates. The company named in the terms may differ from an entity that operates a wallet, holds assets, or files bankruptcy. In a March 9, 2023 opinion, the U.S. Bankruptcy Court for the Southern District of New York found Celsius Network LLC contractually liable under the relevant terms of use, rather than assuming every debtor or non-debtor affiliate had the same liability. That was a case-specific interpretation and does not predict the result for another exchange.
Account type matters more than the word “bitcoin”
Two customers holding the same amount of bitcoin on the same platform can face different legal questions if they used different products. Before assessing a possible recovery, identify the arrangement that created the balance.
| Arrangement | Questions that can affect the claim | Why the distinction matters |
|---|---|---|
| Ordinary spot custody | Which entity held the coins, what the terms say about title, and how customer records were maintained | The court may have to decide whether the assets are customer property or estate property |
| Lending or yield account | Whether you transferred title or authorized the platform to lend, reuse, or pledge assets | The claim may be contractual rather than a request for return of specific coins |
| Margin or derivatives account | Collateral rules, liquidation rights, and netting provisions | Losses, obligations, and valuation can be calculated differently from a spot balance |
| Wallet or payment service operated by an affiliate | The legal entity in the terms, the entity controlling keys, and any intercompany agreement | A claim against one company may not automatically be a claim against another |
This table identifies issues to investigate, not guaranteed outcomes. The governing law and the court’s orders control.
What the FTX and Celsius proceedings show
FTX: a claim still needs valuation
In a June 26, 2024 opinion, the U.S. Bankruptcy Court for the District of Delaware addressed estimation of digital-asset claims in the FTX case. The court wrote: “No bankruptcy court has ever estimated the value of cryptocurrency-based claims, nor, as far as I can determine, has any court ever conducted a valuation of crypto type assets.” The statement describes the novelty of that proceeding; it is not a general recovery rule.

The practical lesson is that a customer can have a documented balance and still face a dispute over how the claim is measured. The court may need to choose a valuation date or method, and the resulting allowed amount can differ from the number shown in an account at another time. Filing a claim does not establish the amount or the payment date.
Celsius: liability depended on the named company and terms
The Celsius opinion illustrates a different problem: identifying the party that owes the customer. The court’s finding concerning Celsius Network LLC turned on the language of the applicable terms of use and the facts before that court. It does not mean every exchange affiliate, lending product, or customer in another country will be treated the same way.
Are exchange-held bitcoins insured?
Do not assume that ordinary bitcoin held at a crypto exchange has the protections that apply to a bank deposit or an eligible securities brokerage account. The available U.S. materials do not establish blanket deposit insurance or securities-protection coverage for exchange custody.
SIPA is a separate brokerage framework
The Administrative Office of the U.S. Courts describes the Securities Investor Protection Act (SIPA) process for liquidating eligible brokerage firms. It explains how customer property may be distributed and how customers can become unsecured creditors if customer property and SIPC advances are insufficient. That is a distinct statutory regime. It should not be presented as a guarantee for bitcoin held at an ordinary crypto exchange.
Check the actual product and policy
A bank-linked service, broker, or exchange may use a different legal entity and contract from a stand-alone crypto platform. Any claimed protection must be checked against the product’s terms, the entity providing it, and the law governing the account. The existence of a familiar financial brand or a claim of “insurance” does not answer those questions by itself.

What to do before a failure
Keep an evidence file
Save records while you can still access them. Keep:
- Periodic account statements and screenshots showing balances.
- Complete trade history, including transaction IDs where available.
- Deposit and withdrawal records, destination addresses, and network details.
- Tax-lot or cost-basis reports if they are available.
- The user agreement and privacy or custody disclosures in force for your account.
- Emails or notices concerning freezes, conversions, lending, or changes to terms.
Store copies in more than one secure location. A claim reviewer may not have complete records after a platform failure, so your own contemporaneous evidence can be important.
Understand the custody trade-off
Keeping coins on a platform can make trading and recovery-of-access processes convenient, but it leaves access dependent on that platform, its records, and its agreements. Self-custody removes the exchange from that custody chain but transfers responsibility to you. A hardware wallet can keep signing keys offline, yet it does not guarantee recovery: losing the recovery phrase can permanently block access, and exposing it can let someone else spend the coins. No particular device is inherently a substitute for a sound backup and security plan.

What to do after an insolvency case begins
- Find the official case notice. Use the bankruptcy court docket, the court-appointed trustee, or the claims agent identified in a formal notice. Do not rely solely on social-media posts or unsolicited messages.
- Confirm the correct debtor. Match the company named in your account terms and statements to the entity listed in the case. A claim against one affiliate may not cover another.
- Read the claim instructions. Determine the form, supporting records, valuation rules, currency, and filing deadline stated for your case.
- Reconcile your amount. Compare the platform’s records with your statements, deposits, withdrawals, trades, and any transfers between products.
- Submit proof through the designated channel. Keep a complete copy of everything filed and confirmation that it was received.
- Monitor court orders. Plans, claim objections, valuation rulings, and distribution notices can change what is required and when.
Because claim estimation and ownership questions can be novel, professional legal or tax advice may be appropriate for a large or complex account. This general information cannot determine an individual claim.

Scams that appear after an exchange collapse
Failed platforms attract people who promise guaranteed recovery, early withdrawals, or priority treatment in return for an upfront fee or wallet credentials. No court notice can authorize a stranger to request your seed phrase. Verify every contact through the case’s official website or court filing, and never pay someone who guarantees a particular recovery percentage or date.
How to evaluate a custody arrangement in the future
Before leaving bitcoin with a platform, document answers to these questions:
- Which legal entity is my counterparty, and where is it organized?
- Does the product involve spot custody, lending, yield, margin, or derivatives?
- Do the terms say I retain title, or can the platform use or pledge the assets?
- Are customer holdings segregated, or are they recorded in an omnibus structure?
- What records will prove my ownership if the platform’s systems fail?
- What law and dispute forum apply?
- What, specifically, is insured or protected, and by whom?
- Can I withdraw directly to a wallet I control, and what operational limits apply?
These questions cannot eliminate platform risk, but they make the legal and operational trade-offs visible before a crisis.

What you can and cannot know in advance
You can preserve evidence, identify the contracting entity, understand the account product, and follow official instructions promptly. You cannot know in advance whether a future court will classify particular coins as estate property, how a claim will be valued, which affiliate will be liable, or what assets will remain for distribution. U.S. court and SEC materials show why those questions are decided case by case rather than by a universal rule for every exchange.
