What Happens After a GST Demand Is Dropped: Refunds, Interest and Next Steps

After a GST demand is dropped, compare the signed order with your portal records. If you paid, a separate RFD-01 refund claim may be needed; interest depends on statutory conditions.

When a GST demand is dropped, check the signed order and the GST Portal record; neither a “dropped” status nor removal of a demand automatically returns money already paid. If you paid an amount covered by the order, you generally need to claim a refund separately in FORM GST RFD-01. Interest may be payable in certain delayed-refund cases, but it depends on the statutory basis, the order’s finality and the applicable notified rate.

What “dropped” means for your GST demand

The outcome depends on what the order actually does. It may withdraw or quash a demand, modify it, or send the case back for redetermination. Read the full signed order—including its authority, case reference, tax period, provisions, tax, interest and penalty components, and any directions about repayment or adjustment. A portal status alone does not establish that the demand has been fully extinguished or that a refund has been sanctioned.

A DRC-07 is a summary of a demand. Under rule 142 of the CGST Rules, when an order uploaded on the system is rectified or withdrawn, the proper officer uploads a DRC-08 summary. DRC-08A concerns certain demands under existing laws. Compare the applicable summary and electronic liability record with the order, and retain dated downloads or screenshots. The order and the case’s portal entries determine what should appear.

What to do next, based on your situation

Your situation What to check or do
The amount was not paid Check that the demand is no longer shown as recoverable and that the portal balance matches the order. If the record conflicts with the order, send the order and demand ID to the jurisdictional GST officer and keep the representation or grievance reference.
You paid some or all of the demand Identify the payment challan, ledger debit, demand ID and amounts paid under tax, interest and penalty. A dropped or modified demand does not itself return that payment; consider a separate refund claim.
The order changes the amount or remands the case Check which components and periods the order covers, whether any amount remains payable, and whether the matter is to be redetermined. Do not treat a partial change or remand as an unconditional cancellation of the entire demand.
An appeal has been admitted The GST Portal says it flags the balance disputed amount as non-recoverable after admission. That is a recovery status, not a refund sanction or payment.
  1. Match the order to the portal. Compare the demand summary and electronic liability record with the operative directions. If the demand was withdrawn or rectified, check for the corresponding DRC-08 summary where applicable.
  2. File separately if money is due back. Apply electronically in FORM GST RFD-01, linking the payment to the demand and explaining the basis for repayment. Attach the order and supporting records appropriate to the claim category.
  3. Track the application to its outcome. Keep the application receipt date, notices and replies, any provisional refund, final refund order and date funds arrive. Check whether the officer has adjusted the amount against another outstanding demand.
  4. Raise a mismatch promptly. If the portal still shows a demand contrary to the order, provide the order and demand ID to the jurisdictional officer and retain the reference. The cited rules do not establish one universal correction timeline.

How a GST refund claim is decided

Under the refund rules, a person claiming a refund of tax, interest, penalty, fees or another amount paid applies electronically in FORM GST RFD-01. The refund officer examines the claim. If satisfied that a refund is due, the officer issues RFD-06, which states the amount sanctioned and any adjustment against an outstanding demand.

If some or all of the claim appears inadmissible or not payable, the officer may issue RFD-08. The claimant may reply in RFD-09 within 15 days; rejection must follow an opportunity to be heard. The refund process is therefore separate from the decision to drop or change a demand, and a claim may be sanctioned, adjusted, partly rejected or rejected.

When interest may apply to a delayed refund

Section 56 of the Central Goods and Services Tax Act, 2017 provides different rules for specified delayed refunds. For a refund ordered under section 54(5), the general provision provides interest at a government-notified rate, capped at 6%, if the refund is not made within 60 days after receipt of the application. A separate provision covers a refund claim arising from an order of an adjudicating authority, Appellate Authority, Appellate Tribunal or court that has attained finality: if it is not refunded within 60 days after receipt of the consequent application, interest may be payable at a notified rate capped at 9%.

Those percentages are statutory ceilings, not confirmation of the rate currently notified or a promise that every dropped-demand refund earns interest. The order-based provision specifically requires finality. Record the application date, the basis of the refund, whether the order has attained finality, and the date the refund is made. Confirm the notified rate and how the provision applies to the particular case before calculating or claiming an amount.

Why a demand might be dropped

The legal reason matters. In Circular 185/17/2022-GST, dated 17 November 2022, CBIC explains a specific limitation situation: where a section 74 notice cannot be sustained and is treated as a section 73 notice, proceedings are to be dropped if the notice is outside the relevant section 73 limitation window described in the circular. Its examples describe a deadline of 2 years and 9 months from the annual-return due date, or from the erroneous-refund date, as applicable. The circular also discusses redetermination where the time limit is met. This is a fact-specific explanation, not a universal limitation rule for every GST demand, period or proceeding.

Appeal deadlines and recovery are separate questions

The GST Portal’s appeal FAQ states a general period of three months after communication of an order to appeal to the Appellate Authority. It also describes the non-recoverable flag for the balance disputed amount after an appeal is admitted. Confirm the deadline and any required pre-deposit under the law and the specific order before acting; do not confuse a recovery flag with repayment of money already paid.

Records to keep and when to seek help

  • The complete signed order and any later appellate, review or redetermination order.
  • DRC-07, any relevant DRC-08 or DRC-08A, and dated liability-record downloads or screenshots.
  • Payment challans, ledger debits and a breakdown by tax, interest and penalty.
  • The RFD-01 application and acknowledgement, RFD-08 notice and RFD-09 reply if issued, RFD-06 order, and proof of any refund or adjustment.
  • Any appeal filing, admission record, grievance or representation reference, and correspondence with the jurisdictional officer.

Consider case-specific advice from a chartered accountant, GST practitioner or tax lawyer if the order is partial, remands the case, leaves another demand outstanding, or the refund is rejected or adjusted. The complete order and payment ledger are important to evaluating those outcomes.
