What Happened to the Airline Fee Disclosure Rule? The 2026 Legal Update

The Fifth Circuit vacated DOT’s 2024 fee-disclosure rule in February 2026. DOT later restored the prior ancillary-fee regulations, rather than ending airline fee disclosures altogether.

The Fifth Circuit vacated the U.S. Department of Transportation’s 2024 airline fee-disclosure rule on February 3, 2026. DOT then issued a final rule restoring the prior ancillary-fee regulations, which it describes as returning to standards established in 2011. The result: the 2024 rule’s expanded upfront-disclosure requirements are not the current rules. That does not mean airlines no longer have any fee-disclosure obligations.

What the 2024 rule would have required

DOT’s April 2024 rule required airlines and ticket agents to disclose certain fees upfront, including charges for a first or second checked bag, a carry-on bag, and changing or canceling a reservation. It also required baggage, change, and cancellation policies to be shown before a customer purchased a ticket. For applicable passenger-specific pricing, consumers could receive fee information reflecting rewards-program participation, military status, or a relevant credit card, or remain anonymous and see standard fees. DOT’s rule summary describes those requirements.

The rule was published on April 30, 2024, and had an effective date of July 1, 2024. Its compliance schedule phased in obligations over time: airlines were to share data with ticket agents by October 30, 2024, and make disclosures by April 30, 2025; larger ticket agents had an October 30, 2025 deadline, and small ticket agents had an April 30, 2026 deadline. Those were dates under the rule that was later vacated, not a current compliance schedule. GAO’s 2024 account records the schedule and the agency’s analysis.

Why airlines challenged the rule

In May 2024, Airlines for America and several airline companies asked the Fifth Circuit to review the rule. The challengers argued that DOT had exceeded its authority and that displaying more fee information could confuse consumers. Those were the airlines’ arguments, not court findings. DOT said it would vigorously defend the rule as a measure to protect travelers from hidden fees, according to the Associated Press’s report on the filing.

Southwest did not join the challenge. AP reported that the airline supported clear and consistent fee disclosure and said the rule would have little effect on its own practices. Airlines for America, by contrast, said the rule would “greatly confuse consumers” by inundating them with information. That was the trade group’s characterization, not an established effect.

Why the Fifth Circuit vacated the rule

On February 3, 2026, the Fifth Circuit ruled that DOT had not complied with the Administrative Procedure Act’s notice-and-comment requirements. DOT conceded that it had not provided additional notice and an opportunity to comment on a study critical of the rule. The court found that the procedural defect compromised the entire regulation because DOT had relied on that study in its cost-benefit analysis.

The court therefore vacated the 2024 rule. It did not decide all the other defects the airlines had alleged, describing those issues as premature given the agreed vacatur and DOT’s stated intention to redesign or rescind the rule. The Fifth Circuit opinion states: “We conclude that DOT failed to comply with this provision. Therefore, we must apply the APA’s ‘default’ remedy— vacatur.”

What rules apply now

After the court’s decision, DOT issued a 2026 final rule implementing the vacatur. DOT says the legal effect is to reinstate the rules that were in force before the 2024 rule and describes its action as restoring the ancillary-fee regulations to their pre-2024 text, returning to standards established in a 2011 rule. DOT’s 2026 final rule explains that action.

For travelers, the key distinction is that the 2024 rule’s expanded, specific upfront-disclosure package was vacated, while DOT’s follow-up restored the prior regulatory text. The available account of that action does not set out every restored 2011 requirement clause by clause, so it is not a basis for claiming that every fee category must—or need not—be displayed at a particular point in every purchase. Nor did the lawsuit erase all airline fee-disclosure rules. The verified change is the return to the prior regulatory regime as DOT describes it.

The available sources do not establish whether the 2026 DOT action has itself been challenged. Accordingly, the current-status description here reflects the Fifth Circuit’s vacatur and DOT’s 2026 final action, not a conclusion about any later litigation.

What the financial estimates did—and did not—show

GAO summarized DOT’s estimates of the 2024 rule’s expected annual effects. They were projections in the rule’s analysis, not measured consumer savings or realized outcomes. GAO reported them as DOT estimates, not as independently verified results:

These figures concern the rule that was later vacated; they should not be read as money consumers actually saved. The estimates and their attribution to DOT appear in GAO’s report.
