The council approved three variance requests 3–2 and a fourth unanimously, subject to changes intended to bring parts of the installation into compliance with local rules. The dispute centered on neighbors’ objections to the structures, traffic and security activity, and the homeowner’s representatives’ arguments about security needs and difficult terrain.
What did West Lake Hills decide?
The council approved three variance requests by a 3–2 vote and approved a fourth unanimously, according to KUT and The Texas Newsroom’s July 9, 2025 report. The decision allowed most of the fencing and gates to remain, with changes required or proposed to address local-rule compliance and concerns raised during the dispute.
The council’s action followed a different recommendation earlier in the process: in April, West Lake Hills’ zoning and planning commission unanimously recommended denying the variance requests. That recommendation was not the final decision; the city council later voted to approve the requests.
KUT reported that the agreed changes included replacing, lowering and improving the appearance of portions of the fencing, as well as changing the keypad arrangement at a front gate. The sources reporting the vote do not establish whether all required or promised work was completed afterward.

Why were neighbors objecting?
Residents who opposed the requests said the fencing and gates were too imposing for the residential street and had been installed without required city approvals. They also raised concerns about traffic backing up on a narrow cul-de-sac and the visible presence of security personnel. These are neighbors’ reported concerns, not findings that every effect was independently verified.
Paul Hemmer, a neighbor and HOA president according to the Austin Post’s July 8, 2025 preview, objected to the appearance of the fencing. At an earlier commission hearing, he argued that retroactive approval would reward conduct he opposed. Other residents did not share that position: Austin Post reported that two nearby residents submitted a letter supporting the requests and said they had not known the homeowner’s identity before it became public in reporting.

What did the homeowner’s representatives argue?
Representatives for the homeowner cited security needs and the property’s difficult terrain as reasons for the fencing and gate configuration. They also offered changes to address objections. Addressing the council, real estate attorney Racy Haddad said, “We’d like to be good neighbors. We’re trying to minimize the concerns that we’ve heard,” as quoted by KUT.
Council member Darin Walker described the topography as a property-specific hardship, saying it had nothing to do with the homeowner. An opposing council member, by contrast, argued that the requests exceeded what was usually approved and that alternatives had not been demonstrated, according to KUT’s account of the vote.

Who owns the home, and what are the reported property figures?
The home is in West Lake Hills, an Austin-adjacent city. KUT reported connecting Musk to it through public-records-request emails between city officials and representatives of Excession, a company KUT described as handling Musk’s personal wealth. Reports say an LLC bought the home on his behalf; they do not establish that Musk is named on the deed.
The property figures in coverage are not interchangeable: TechCrunch reported a $6 million purchase in 2022, while Austin Post reported a $6.24 million property valuation and a size of 6,900 square feet. These are outlet-reported figures, not an independently established appraisal or a single agreed price.
