What GST Notices Mean and How to Respond to Them

A GST notice can be a scrutiny query, demand proceeding or another compliance communication. Identify the form and legal provision, gather records, and follow the deadline and response route that apply to your notice.

A GST notice is an official communication asking you to explain a discrepancy, provide information, respond to a proposed tax liability, make a payment, or take another compliance step. It does not automatically mean you must pay immediately. The form, legal provision, tax period, instructions and deadline on your own notice determine what to do next.

What does a GST notice mean?

“GST notice” is a broad label for communications issued under different provisions of India’s GST law. One may ask you to explain a return discrepancy; another may begin a demand proceeding or request information. The notice’s form number and the section it cites are therefore more useful than the label alone.

Start by identifying the action requested. Is the authority asking for an explanation, documents, payment information, a response to a proposed liability, or something else? A notice that requests an explanation is not the same procedural stage as a later order recording a demand. Read the full communication and any accompanying summary or attachments before deciding whether to pay or dispute an amount.

The applicable law and process may change. Check the current statute, rules and notifications, and follow the instructions in the specific communication rather than relying on a deadline or form used for another GST matter.

How do I reply to a GST notice?

Work from the actual communication and create a record of every step. A clear, evidence-based response is easier to assess than a general denial or a bundle of unexplained documents.

  1. Verify and preserve the communication. Check the GST Portal and the taxpayer’s registered communications. Save the notice, its attachments, the portal status, the date it was received or served, and any acknowledgement. Do not rely on an unfamiliar message link; access the official portal through a channel you trust.
  2. Identify the procedure and deadline. Note the GSTIN, issuing authority, form number, statutory section and sub-section, tax period, issue date, service date, alleged discrepancy, requested action, proposed tax, interest or penalty, requested evidence, response method and deadline. These details determine which process applies.
  3. Reconcile the allegation against records. Depending on the issue, collect filed returns, invoices, ledgers, payment challans, credit notes, reconciliation workings, contracts and relevant correspondence. Trace each factual statement in your reply to a record. If figures differ, show what was compared, identify the difference and explain its cause rather than simply asserting that the return is correct.
  4. Prepare the response in the specified form and channel. Use the form and portal process for that notice. Scrutiny under rule 99 uses ASMT-11 for payment information or an explanation in response to ASMT-10. Under rule 142, a reply to a notice whose summary was uploaded in DRC-01 is furnished in DRC-06. Keep a copy of the submitted response and its acknowledgement.
  5. Submit by the deadline stated for this communication. Calendar the date and allow time to compile records and complete filing. Do not substitute a period remembered from another notice. If the notice allows an explanation or further time, follow the applicable rule and the officer’s instructions.
  6. Make a deliberate payment-or-dispute decision. Payment may be an option under some statutory routes, but the conditions and consequences depend on the provision and facts. Before paying a disputed amount, determine what the payment would resolve and whether any further response is still required.
  7. Escalate serious or complex matters promptly. Seek qualified GST advice if the notice alleges fraud or suppression, involves a significant amount, proposes cancellation or other serious action, or has progressed to an adverse order or appeal stage.

What to check before drafting your reply

Use the notice itself as a checklist rather than beginning with a generic response. Confirm that the GSTIN and tax period belong to the taxpayer and period concerned. Then identify each allegation separately: a notice may raise more than one discrepancy, and each one may need its own explanation and supporting record. Note whether the authority asks you to explain figures, submit specified documents, provide payment information, or respond to a proposed liability. These are not interchangeable requests.

Pay particular attention to the legal provision and the procedural stage. ASMT-10 points to scrutiny of returns under rule 99. DRC-01, by contrast, is an electronic summary that accompanies specified demand notices under rule 142. A DRC-07 summary is associated with specified orders, not simply the initial notice stage. The form alone is not a substitute for reading the complete notice, any referenced statement and its attachments.

Keep issue date and service date distinct in your notes. The notice may identify a response period, but the period that applies and how it is calculated depend on the relevant rule and communication. Record the date shown on the portal and the date you received or were served the document, then follow the particular instructions. If any part of the notice is missing or a referenced attachment is unavailable, preserve a record of that problem and promptly seek guidance on the appropriate way to address it.

How to make the explanation easy to follow

Structure the reply around the allegations, not around the order in which documents happen to be stored. For each point, state what the notice says, what your records show, why the apparent difference arose, and which attached record supports the explanation. A reconciliation schedule should identify the tax period and the figures being compared, and should link its totals to the relevant return and underlying ledger or invoices. Label attachments clearly and refer to them by name or number in the text.

If you accept a discrepancy or have made a payment, state that accurately and identify the relevant payment information. If you disagree, explain the basis for the disagreement with supporting records rather than relying only on a broad denial. Do not claim to have filed, paid or attached something unless you can verify it. Before submission, check that the response addresses each requested point, uses the required form and channel, and includes the intended supporting documents.

Which form do I use to reply to a GST notice?

Do not choose a form based on the word “notice” alone. These forms serve different functions under the rules; the form number and statutory provision in your communication should guide the response.

Form or communication What it indicates Response or next step
ASMT-10 A return-scrutiny discrepancy notice under rule 99. The officer informs the taxpayer of a discrepancy and seeks an explanation. Provide payment information or an explanation in ASMT-11, following the period specified in the notice and the rule. If the explanation is accepted, the officer informs the taxpayer in ASMT-12. CBIC: Assessment-Audit Rules
ASMT-11 The form used in the scrutiny process to give payment information or explain the discrepancy identified in ASMT-10. Answer the discrepancy with supporting records; if the explanation is accepted, the officer communicates that in ASMT-12. CBIC: Assessment-Audit Rules
DRC-01 An electronic summary that accompanies specified demand notices under rule 142. It is not a universal reply form. For a notice whose summary is uploaded in DRC-01, furnish the representation or reply in DRC-06. CBIC: CGST Rules, Chapter XVIII (PDF dated 1 January 2022)
DRC-02 An electronic summary of a statement under specified provisions, as described in rule 142. Read the accompanying statement and instructions to identify the applicable response. The cited rule does not make DRC-06 the response to every GST communication. CBIC: CGST Rules, Chapter XVIII (PDF dated 1 January 2022)
DRC-03, DRC-04 and DRC-05 Conditional payment-related forms under specified statutory routes: DRC-03 informs the proper officer of specified payments; DRC-04 acknowledges certain payments made before a notice or statement; DRC-05 is an order concluding proceedings in specified payment circumstances. Use only where the relevant provision and circumstances make the route applicable. These forms do not establish a general rule that paying any notice automatically closes the matter. CBIC: CGST Rules, Chapter XVIII (PDF dated 1 January 2022)
DRC-06 The reply form specified in rule 142 for a notice whose summary was electronically uploaded in DRC-01. Use it for that rule 142 reply route, following the notice and portal instructions. It is not a universal GST notice response form. CBIC: CGST Rules, Chapter XVIII (PDF dated 1 January 2022)
DRC-07 An electronic summary of specified orders under rule 142. It is associated with an order stage, not simply the initial notice stage. Review the underlying order and any applicable recovery or appeal instructions. Rule 142 says the order is treated as the notice for recovery. CBIC: CGST Rules, Chapter XVIII (PDF dated 1 January 2022)

The key distinction is procedural. ASMT-10 is a scrutiny discrepancy communication: the issue is the discrepancy identified in the return scrutiny process, and ASMT-11 is the route for the taxpayer’s payment information or explanation. The CBIC Assessment-Audit Rules guidance says the notice specifies the response period subject to rule 99’s stated limit and any further period the officer permits. If the explanation is accepted, ASMT-12 informs the taxpayer of that result.

A DRC-01 summary belongs to a different route: rule 142 provides for an electronic summary alongside specified demand notices. Where the notice summary was uploaded in DRC-01, the rule identifies DRC-06 as the response form. A DRC-02 summary relates to a statement under specified provisions; check the statement and its instructions rather than assuming that the reply route for a DRC-01 notice applies unchanged.

Payment-related forms also have distinct jobs. DRC-03 informs the proper officer of specified payments, while DRC-04 and DRC-05 relate to particular payment circumstances and their prescribed acknowledgement or conclusion. DRC-07 is different again: it summarizes specified orders, and rule 142 treats the order as the notice for recovery. An initial notice, a payment acknowledgement and a demand order should not be treated as interchangeable documents.

How long do I have to respond to a GST notice?

There is no single response period for every GST notice. The time allowed depends on the form, provision, type of proceeding and facts. Use the deadline and response instructions in the communication, and check the rule cited in it.

For an ASMT-10 scrutiny notice, CBIC’s rules guidance says the notice specifies the period for the taxpayer’s explanation, subject to the limit stated in rule 99 and any further period permitted by the officer. That is not a deadline to apply to a demand notice, information request or other process. The same caution applies to a date printed on an issue: check the service date and the rule governing how the response period is calculated.

If the deadline is approaching and records are incomplete, do not assume that silence or an informal message to the officer preserves your rights. Follow the notice’s permitted filing procedure and seek advice if you cannot comply or need to understand whether additional time is available.

Build a simple deadline record as soon as you receive the communication: note the date and method of service, the response date shown, the provision and form, and any instruction about asking for additional time. Save the portal acknowledgement when you file. A reminder based on another taxpayer’s notice, an older matter, or a different form is not a reliable substitute for the deadline in your own case.

What happens if I do not reply to a GST notice?

The outcome depends on the notice type, provision, allegations and procedural stage; the CBIC rules guidance does not establish one universal consequence for every failure to respond. A scrutiny query, a proposed demand and a later order are different processes, and a missed response can leave the authority to proceed under the applicable route without your explanation or evidence.

Do not treat a missed deadline as proof that a notice is harmless or that the amount is automatically final. Check the current position on the GST Portal, read any subsequent communication or order, and get prompt professional advice about the available procedural options. If an adverse demand order has already been issued, the appeal process and its filing deadline are separate from the deadline to answer the original notice.

First establish the present stage: is the communication still a request for an explanation, has a demand order been issued, or has a recovery-related summary appeared? Preserve each notice and order in sequence, including the service dates and portal acknowledgements. The right next step depends on that sequence and the section cited; do not assume that sending a late reply automatically reopens a concluded process or that payment is the only option.

Can I pay the amount in a GST notice instead of contesting it?

Sometimes a statutory route allows payment and specifies what happens next, but the option, timing, conditions and effect depend on the legal provision and facts. Rule 142 describes DRC-03 for informing the proper officer of specified payments, DRC-04 as an acknowledgement for certain payments made before a notice or statement, and DRC-05 as an order concluding proceedings in specified payment circumstances. These provisions should not be read as a blanket settlement option for every notice.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Before paying, compare the amount and period in the communication with your records, identify the provision under which payment is being made, and confirm whether payment resolves the matter or whether a reply is still needed. If you dispute the calculation or legal basis, understand the consequences of the proposed payment route before choosing it. The Central Goods and Services Tax Act is available from CBIC; check the current law and the provision cited in your notice.

Keep the distinction between paying an amount and obtaining closure clear. The forms described in rule 142 apply to specified circumstances, and the rule’s acknowledgement and conclusion steps are conditional. A payment receipt or a DRC-03 filing should not, by itself, be taken as proof that every allegation or proceeding has ended. Check what the applicable provision says will happen after payment and retain the related acknowledgement or order.

What if the communication is already a demand order?

Distinguish a notice proposing or seeking a response from a later order. Under rule 142, DRC-07 is the electronic summary for specified orders, and the order is treated as the notice for recovery. If you have received an order rather than an initial notice, read the order itself, check the portal record and identify the appeal procedure and deadline that apply to that order.

The GST Portal’s appeals FAQ states a minimum pre-deposit of 10% of disputed tax before filing an appeal against a demand order. This is a general statement in the portal FAQ, not a calculation for an individual case; verify current law, eligibility, the order involved and the filing deadline before relying on it. See GST Portal: FAQs on Appeals.

Do not confuse the appeal pre-deposit with payment options described for a notice-stage process. They concern different procedural questions. The portal FAQ’s 10% statement concerns the demand-order appeal process it describes; it does not mean that every recipient of a GST notice must pay 10% to reply. Confirm the order type, disputed-tax calculation, current eligibility requirements and filing deadline for the particular appeal.

Records to keep with your GST notice response

Keep a single case file so you can establish what the authority sent, what you relied on and what you submitted. Retain:

  • The original notice, attachments, any DRC summary or referenced statement, and the portal status.
  • A record of the issue date, date of service or receipt, deadline, and any permitted extension or follow-up communication.
  • The filed returns, invoices, ledgers, challans, credit notes, contracts and reconciliation worksheets relevant to the allegation.
  • The final response, supporting documents in the form submitted, submission acknowledgement and any later order or reply from the authority.

Keep the evidence connected to the point it supports. For example, label a reconciliation schedule by tax period and match its figures to the return and underlying ledgers; this makes a discrepancy easier to review than a large, unindexed upload.

Preserve an untouched copy of the communication as received, including its attachments, and keep a separate working copy for annotations. File portal acknowledgements with the final response, not just the draft. If the officer sends a subsequent communication, add it to the same chronology so that the original notice, your reply, any payment information and later order can be understood in order.

When to get professional GST help

Consider a chartered accountant, GST practitioner or tax lawyer where the amount is material, the notice alleges fraud or suppression, the matter risks cancellation or another serious consequence, the records do not reconcile, or an order has already been issued. Advice is particularly useful when you must choose between explaining, paying under a statutory route, and pursuing an appeal, because each choice can have different requirements and consequences.

This article is general information, not a determination of your tax liability or legal advice for an individual case. The cited CBIC rules PDF is dated 1 January 2022, while the CBIC rules guidance and GST Portal pages are live resources; verify the current law and your notice’s specific instructions.

Frequently asked questions

What does a GST notice mean?

It means an authority has sent an official communication requiring a response or another compliance step. It could concern scrutiny, a proposed demand, a request for information or another statutory matter. The form, legal provision and requested action determine what it means for your case; it does not automatically mean immediate payment is due.

How do I reply to a GST notice?

Verify the communication through the GST Portal, identify the form, provision and deadline, then compare the allegation with the relevant returns and source records. Use the response form and channel specified for that process, explain each point clearly, attach relevant evidence and save the filed response and acknowledgement.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Which form do I use to reply to a GST notice?

It depends on the notice. ASMT-11 is used for payment information or an explanation in response to an ASMT-10 scrutiny discrepancy notice. Rule 142 identifies DRC-06 for the reply to a notice whose summary was uploaded in DRC-01. Do not assume either form applies to every GST communication.

How long do I have to respond to a GST notice?

There is no universal GST notice deadline. Follow the period stated in your communication and check the governing provision. For ASMT-10, CBIC’s Assessment-Audit Rules guidance says the period is specified in the notice, subject to rule 99’s limit and any further period the officer permits.

What happens if I do not reply to a GST notice?

The consequence depends on the notice type, legal route and stage. The authority may proceed under the applicable process without your explanation or evidence, but there is no single consequence for every notice. Check the portal and any later order promptly and seek advice on options that may still be available.

Can I pay the amount in a GST notice instead of contesting it?

Some provisions provide conditional payment routes, but payment does not automatically close every GST matter. Check the section, amount, tax period and applicable conditions, and confirm whether a reply or further step is also required before choosing to pay.

Frequently Asked Questions

Does a GST notice always mean I have to pay?

No. A GST notice can ask for an explanation, documents or payment information, or relate to a proposed liability or another compliance issue. Read the requested action, form and legal provision before deciding what to do.

Can I use DRC-06 to respond to any GST notice?

No. Rule 142 identifies DRC-06 as the reply form for a notice whose summary was electronically uploaded in DRC-01. Other notices, including an ASMT-10 scrutiny discrepancy notice, have different response routes.

What is the difference between DRC-01 and DRC-07?

DRC-01 is an electronic summary accompanying specified demand notices. DRC-07 summarizes specified orders; rule 142 says the order is treated as the notice for recovery. Check whether you have received a notice or an order.

Does paying through DRC-03 automatically close my GST case?

Not in every case. Rule 142 describes DRC-03 and related acknowledgement or conclusion forms for specified payment circumstances. Whether proceedings conclude depends on the relevant provision and conditions.

What should I do if I have received a demand order?

Read the order and its DRC-07 summary, check the GST Portal and identify the applicable appeal procedure and deadline. The GST Portal appeals FAQ states a minimum pre-deposit of 10% of disputed tax for the demand-order appeal process it describes; verify current requirements for your case.

The Bottom Line

Do not treat “GST notice” as a single process. Verify the communication, identify its form and legal provision, reconcile the allegation against records, and respond through the correct channel by the deadline that applies to that notice. Payment, closure and appeal requirements are conditional; check the current law and get qualified help when the stakes or procedural stage warrant it.
