If an AI pricing tool suggests a price that appears to lose money, check the unit’s actual costs and sales, save the recommendation and its explanation, and ask the franchisor or vendor how the tool produced it. Before changing or refusing a price or promotion that may be required, review the franchise documents and get advice from qualified franchise counsel. A recommendation that looks unprofitable does not, by itself, establish that it is unlawful or that you may disregard it.
How can you check whether the recommendation is actually unprofitable?
Start with the economics of your own unit, not with the tool’s output or a menu price in isolation. Recalculate using the item’s actual costs and the charges that apply to your sales. Account for discounts and relevant taxes, and consider the sales mix: a price that appears workable on one item may not tell you whether the overall mix is profitable.
Keep the calculation tied to what the unit actually sells and pays. A gross selling price alone does not establish contribution margin or overall profitability. The FTC’s explanation of below-cost pricing is about antitrust principles, not a formula for calculating a franchise unit’s costs; it does not supply a universal margin or loss threshold for this decision.
What should you save and ask about the tool?
- Preserve the recommendation. Record the suggested price, date, item, unit or location, displayed rationale, and relevant settings or inputs. Keep the cost and sales records you used so you can reproduce the concern.
- Ask how the price was generated. Request the key inputs, assumptions, and objective behind the recommendation, and ask how inaccurate or unsuitable data can be corrected. Keep the response with your records.
- Clarify what the tool does. Ask whether it offers advice, changes prices automatically, or is connected to a required promotion. The answer affects what you can do next; do not assume a suggested price is either optional or mandatory.
This recordkeeping sequence is a practical way to assess and explain a concern, not a procedure prescribed by law.

Can you ignore the recommended price?
That depends on the franchise agreement and other applicable rules, not just on whether the output came from AI or appears unprofitable. Review the franchise agreement, operations manual, written pricing policy, and promotional rules for terms that address prices or required promotions. The owner’s authority can depend on the specific documents and applicable state law.
If the documents do not make your authority clear, ask the franchisor how the recommendation should be handled and consult a lawyer experienced in franchise matters before refusing a price or promotion that may be mandatory. The FTC’s franchise guidance provides general resources, including material on franchisee complaints and undisclosed fees; it does not decide whether a particular franchisor can require a particular price.

Does a below-cost recommendation mean the tool or price is illegal?
No. A price below your unit’s costs is not automatically unlawful. The FTC describes predatory pricing as a narrower concern involving an effort to exclude competitors and the ability to recoup losses later. An independent decision to price below cost does not necessarily harm competition. Those antitrust principles do not establish whether a price is sensible for your business or what your franchise documents require.
A separate question is whether the pricing system or its use involves coordination among competing businesses. The FTC and DOJ say competitors cannot use an algorithm to do what would be unlawful if done directly; shared pricing recommendations may raise antitrust concerns even when users retain some discretion. The FTC’s price-fixing guidance also distinguishes agreements among competitors from independent pricing decisions. Whether these principles apply depends on the facts and law. Do not coordinate prices with other franchisees; raise concerns through the franchisor, vendor, or counsel instead.

What does the recent McDonald’s lawsuit establish?
It establishes that allegations were reported, not that they were proven. On October 6, 2026, the Associated Press reported that a consumer had filed a federal lawsuit in Illinois alleging that McDonald’s AI-assisted pricing tool shares nonpublic information and contributes to price coordination. McDonald’s disputed the allegations and said AI does not set restaurant menu prices, franchisees do, and available tools are optional and do not automate, coordinate, or fix pricing. The report is not a court finding and does not establish the case’s later status. Read the Associated Press report with that distinction in mind.
