What Does the Law Say When Your Neighbor Won’t Help With Fencing?

A neighbor may not automatically owe half the cost of a fence. State law, land use, fence type, agreements, and notice procedures can change the answer.

If your neighbor won’t help pay for a fence, whether you can require a contribution depends on the law where the property is located and on the kind of fence involved. There is no nationwide rule that automatically makes neighbors split every fence bill in half. Before building or repairing a fence, check your state’s rules and any relevant local requirements or property documents.

Does my neighbor have to pay half for a fence?

Not necessarily. State laws differ on whether adjoining owners must share costs, which fences are covered, how each owner’s share is calculated, and what notice or dispute process applies. The legal answer may also depend on whether the fence is a boundary or partition fence, sits entirely on one owner’s land, is being repaired or newly built, or separates land with different uses.

For example, Nebraska Revised Statute § 34-102 says: “When there are two or more adjoining landowners, each of them shall construct and maintain a just proportion of the division fence between them.” That is Nebraska’s rule, not a nationwide standard. Read Nebraska’s division-fence statutes.

How fence laws differ by state

These examples show why it is important to check the law for the property’s location. They are not a complete survey of state laws, and the details in the statutes can affect the result.

State What the cited law provides What to check
Nebraska Adjoining owners must construct and maintain a “just proportion” of a division fence. The statute describes written notice and a court process for seeking performance or contribution in specified circumstances. Who is liable, what notice must say, the waiting period, and the filing deadline. See Nebraska Revised Statutes, Chapter 34.
Kansas Kansas has a partition-fence framework. K.S.A. § 29-312 describes a specific exception under which an owner who decides not to improve adjoining land may, after written notice, avoid maintaining a portion while the land remains open and unimproved, subject to the statute’s conditions. Whether the land-use conditions and notice requirements for that exception apply. See Kansas K.S.A. § 29-312.
Ohio Ohio Revised Code § 971.07 addresses a claim for reimbursement of a proportionate share and an action to recover an unpaid share. Section 971.08 addresses limited entry onto adjoining property to construct or maintain a partition fence. Read the surrounding chapter and both provisions before deciding how to proceed: § 971.07 and § 971.08.
South Dakota Section 43-23-1 generally assigns each adjoining owner half the expense of erecting and maintaining a partition fence unless the owners agree otherwise. Section 43-23-5 provides a written notice-and-demand procedure when an owner neglects or refuses to erect or repair the required portion. Whether the fence and circumstances fall under these provisions, and how to follow the notice procedure: § 43-23-1 and § 43-23-5.
Vermont Section 3802 concerns maintenance where unimproved and unoccupied land adjoins another person’s occupied land, and gives the town selectboard a role in deciding whether the owner should be compelled to make a portion. Whether the statute’s particular land-use conditions apply. See Vermont Statutes, Title 24, § 3802.

What to check before building or repairing a fence

  1. Identify the property’s jurisdiction. Start with the state and local jurisdiction where the land is located. Local rules may matter, and the cited state examples do not establish the answer for every city or town.
  2. Determine what kind of fence is at issue. Check whether it is a boundary or partition fence, a fence wholly on one owner’s land, a repair to an existing fence, or a proposed new fence. Do not assume the rules are the same for all four situations.
  3. Read the applicable official rules. Check who is responsible, what qualifies as a legally recognized or reasonable fence, how costs are allocated, and whether written notice is required before work begins.
  4. Review relevant property documents and local requirements. An agreement, easement, lease, recorded document, HOA covenant, or local ordinance may affect the situation. The result cannot be determined without checking the provisions that apply to the property.
  5. Keep useful records. Save notices and proof of delivery, estimates, invoices, photographs, and any written agreement. These are sensible records to keep; they are not a universal statutory checklist.

What if the neighbor refuses to repair a shared fence?

Follow the dispute procedure that applies in your jurisdiction rather than assuming you can build first and recover money later. Some state laws specify written notice, waiting periods, a demand, or a route through a court or local official. Nebraska, Ohio, and South Dakota provide examples of formal procedures, but their requirements do not apply automatically elsewhere.

If the boundary itself is disputed, do not treat the location of an existing fence as proof of the legal property line. Check property records and consider qualified local boundary assistance where appropriate. The cited statutes do not determine the boundary of any particular parcel or establish that every dispute requires a survey.
