Keep the complete notice and related correspondence, then prepare a dated explanation of what you believe is fraudulent and attach records that support the facts. If SSA has issued an initial determination, its general reconsideration process uses Form SSA-561; follow the deadline and submission instructions in your notice. Identity-theft reporting through the Federal Trade Commission (FTC) and a report to the SSA Office of the Inspector General (OIG) may also be appropriate, but they serve different purposes from an appeal.
Build your document packet around the SSA notice
There is no single evidence packet that SSA requires for every allegedly fraudulent retirement, disability, survivor, or Supplemental Security Income (SSI) claim. The useful records depend on what SSA decided and what facts you are disputing. Begin with the notice: it identifies the determination, gives a date, and should explain the route and deadline for challenging it. SSA says to follow the appeal process described in the notice. SSA’s Form SSA-561 page describes reconsideration, while its instructions tell claimants to identify the issue, explain why the determination is incorrect, and describe any additional evidence they are submitting.

Treat this as a way to organize evidence, not as an agency-prescribed checklist for every case. If the notice does not make clear which determination is being challenged or where to send the request, ask SSA for case-specific instructions before assuming that an identity-theft report or OIG complaint will challenge the decision.

Keep the entire SSA notice
Save every page of the notice, including any page that explains appeal rights, a deadline, or where and how to submit a request. Keep related SSA letters, forms, or other correspondence that helped reveal the claim. The notice lets you name the decision accurately instead of describing the matter only as “fraud” or “identity theft.” If you have more than one SSA letter, include the correspondence that shows how the matter developed and identify which determination you are appealing.

Record the notice date and the date you received it for your own timeline. Use the deadline and instructions printed in the notice as the case-specific guide; deadlines vary by type and stage of decision. Do not assume that a deadline described for one kind of appeal applies to another.
Make a dated account of what happened
Write a concise, factual statement that identifies the SSA action you dispute, when and how you learned of it, and why you believe it does not belong to you or is otherwise fraudulent. SSA’s reconsideration instructions call for stating why the determination is incorrect and describing additional evidence. The SSA OIG hotline guidance recommends providing the who, what, where, when, how, and why of suspected fraud.
Organize the account chronologically. Separate what you know directly from what you infer: for example, identify the notice or event you personally saw, then explain why it suggests that an unfamiliar claim or activity may involve your information. If you do not know who made a claim or how it was filed, say so rather than speculating. Explain each fact that supports your disagreement and connect it to a record you are enclosing, when one is available.

If SSA’s form does not leave enough room, its instructions allow a separate sheet. Put your name and the matter being appealed on the attached page so it remains associated with your request, and refer to the attachment in your explanation. The essential point is to make the disputed issue and your reason for challenging it understandable to the person reviewing the request.
Choose supporting records for the facts at issue
Attach records that substantiate points in your account. The SSA correspondence that first revealed the claim is often central because it identifies what action you are responding to. Other records may be useful if they directly support a factual point in your explanation. What is relevant depends on the allegation; the official guidance does not prescribe a universal set of records for every allegedly fraudulent benefit claim.
Do not treat an illustrative document as mandatory merely because it could be useful in another case. A record should help explain what happened, show why a claim or action is disputed, or document a relevant reporting step. If an item does not support a specific point, it may not clarify the reconsideration request. Keep your own copy of the notice, statement, forms, and records you submit so you can refer to the same packet if SSA asks a follow-up question.

Use the correct SSA appeal form and timing
For an initial determination, consider Form SSA-561
SSA identifies Form SSA-561, Request for Reconsideration, as the form for requesting reconsideration and says to send it to the local Social Security office. Use the notice to confirm the route for your case. The request should identify the decision or issue being appealed, explain why you believe it is wrong, and describe the evidence you are submitting. The related SSA operating instructions for preparing Form SSA-561 likewise direct the claimant to state why the determination is incorrect.

If SSA has not issued an initial determination, a reconsideration request is premature. In that situation, identify what stage the matter is at and use the notice or agency instructions for the action currently available rather than filing an appeal against a decision that does not yet exist.
Medical decisions have an additional form listed by SSA
For a reconsideration involving a medical decision, the SSA form page also lists Form SSA-827. Check the notice and the current form instructions to determine whether it applies to your particular matter; it is not a general identity-theft report or a replacement for SSA-561.

Use the notice deadline; the 60-day rule is limited
For Title II overpayment reconsideration, SSA’s operating instructions say a request is due within 60 days of the date of the initial overpayment notice. They also say a written request must clearly imply disagreement and that a late request may require a good-cause determination. That specific rule should not be generalized to every SSA decision or every type of alleged fraudulent claim. For your case, use the deadline in the notice and the applicable instructions. If a deadline appears to have passed, do not assume that you have no options: the cited SSA instructions describe a good-cause determination in the stated overpayment context, and the notice or SSA can clarify what applies to your situation. SSA’s instructions for Title II overpayment reconsideration explain that limited rule.

If someone used your identity
SSA directs identity-theft victims to the FTC and IdentityTheft.gov. The FTC’s recovery process generates an Identity Theft Report and a personalized recovery plan based on the information provided. Preserve a copy for your records and use it as identity-theft documentation where relevant to your account. SSA says it does not handle identity-theft issues; that direction does not mean an FTC report challenges an SSA determination for you. If SSA has made a decision against you, follow the appeal route in the notice as well.
If you suspect fraud involving an SSA program
Report suspected fraud, waste, or abuse involving Social Security, SSI, or Medicare programs to the SSA Office of the Inspector General. Its hotline guidance encourages a detailed account of the allegation. Include the who, what, where, when, how, and why to the extent you know them. This is a report to the agency’s OIG about suspected program fraud, not a reconsideration request. If you are also disputing a personal SSA determination, submit the appeal through the process stated in your notice.

If you file a police report
A police report may help document identity theft, but the FTC presents it as an option, not as a universal requirement for appealing an SSA decision. Its guidance suggests taking a copy of the FTC Identity Theft Report, photo identification, proof of address, and any other evidence of the theft when making a police report, and asking for a copy of the report. Keep that copy if you file one. The SSA sources do not establish photo ID, proof of address, an FTC report, or a police report as a standard document packet for every claim dispute; use your SSA notice or ask SSA what it needs in your specific matter. Assemble and check the packet before sending it
- Identify the decision. Use the notice to state exactly which determination or issue you dispute. Note its date and locate the appeal instructions.
- Check that an initial determination exists. If SSA has made a decision, use the reconsideration route where applicable. If it has not, do not frame the request as reconsideration of a decision that has not been issued.
- Write the dated explanation. Set out how you learned of the matter, what you believe is fraudulent, why you dispute the determination, and which facts are known versus uncertain.
- Match records to claims. Enclose the relevant SSA notice and correspondence, then add records that support specific factual points. Describe the additional evidence in the request.
- Complete the applicable appeal form and any relevant attachments. SSA identifies SSA-561 for reconsideration; for medical decision reconsideration, its form page also lists SSA-827. Follow the case-specific notice and instructions.
- Check the deadline and submission route in the notice. Do not substitute a deadline from a different type of SSA matter.
- Keep a copy of what you submit. Retain the complete packet, including any separate statement and identity-theft or police-report documentation you choose to include.
- Make separate reports when appropriate. Use IdentityTheft.gov for identity-theft reporting and recovery guidance, and the SSA OIG for suspected SSA program fraud. Neither is a substitute for the appeal route.
Before sending, make sure a reviewer can tell at a glance what SSA decision is being challenged, why you disagree, and what each attached record is intended to support. If an instruction in the notice conflicts with a general example elsewhere, the notice’s case-specific route and deadline should guide your next step; contact SSA for clarification if the determination or submission path remains unclear.
