What the latest regulatory developments do—and do not—say
The Clarity Act vote
Ripple reported that the Clarity Act failed to advance in the Senate on September 15, 2026. Ripple said the vote did not change what it considers settled legal clarity for XRP; that is the company’s position, not an independent finding about the vote’s future implications. Ripple’s policy statement also said it had spent more than $150 million fighting for legal clarity in court. That amount is Ripple’s own statement, not an independently audited figure.
The SEC interpretation and court judgment are separate matters
An SEC-filed fund disclosure describes a March 2026 SEC interpretation listing XRP among 18 digital assets classified as digital commodities. The filing also summarizes the appeals’ dismissal in August 2025 and says the final judgment’s $125 million civil penalty remained in place. An agency interpretation, a court judgment and the failure of legislation are distinct developments; none should be treated as a single blanket ruling about every XRP transaction. Ripple’s FAQ summarizes the July 13, 2023 ruling by Judge Analisa Torres as finding that “XRP, in and of itself, is not a security.” That wording is Ripple’s description of the ruling, not a direct quotation from the judge, and it should not be generalized to all transactions involving XRP. Do XRP ETF flows appear to be driving the price?
ETF access exists, but the cited filings do not establish current demand. They identify funds whose shares are intended to reflect XRP’s price before expenses and liabilities; they do not, in the available material, provide current net flows or assets under management. Without those figures—and evidence connecting flows to price—it would be unsupported to say ETF buying or selling is driving XRP now.

ETF shares and direct XRP are different exposures. An ETF share is a fund interest designed to track XRP’s price before fund costs; direct XRP is the digital asset itself. The evidence here does not support recommending one over the other.

Ripple’s press center lists a September 29, 2026 announcement that CSD BR and Ripple would use XRPL to expand Brazil’s financial-market infrastructure. It also lists an October 6, 2026 announcement involving Ripple and Brevan Howard. These are company announcements and evidence of stated plans or relationships—not proof of completed implementation, XRP usage at scale or an effect on XRP’s market price. How to assess a claimed XRP catalyst
- Check what actually happened. Separate a proposal, announcement or agency interpretation from a completed action or final court judgment.
- Look for measurable market evidence. For an ETF claim, seek dated net-flow and assets-under-management data rather than assuming that a listing means buyers are entering.
- Distinguish adoption from token demand. A partnership or XRPL project does not by itself show that XRP is being used, at what scale, or that the use affects its market price.
- Treat timing and price claims cautiously. The cited sources do not identify a scheduled next catalyst or justify a price target.
